This Service Agreement (“Agreement”) is entered into between LEOMAX, its affiliates and licensors (“LEOMAX”, “we”, “us”), and you (“User”, “you”), governing your access to and use of the ASKARI SMART CAMERA mobile application, software, cloud services, devices, and related services (collectively, the “Services”).
By downloading, installing, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the Services. You also retain the rights to opt out of the service at any time.
You must be at least 18 years old, or the age of majority under Ugandan law, to use the Services. By using the Services, you represent that you meet this requirement and have legal capacity to enter into this Agreement.
If you are using the service on behalf of a legal entity, you further represent that you have the legal capacity and authority to bind the legal entity to these agreements. Proof of written authority may be required by Leomax.
If you do not meet this requirement, you must cease all use of the services. The user agrees to indemnify Leomax for violation of this clause.
Leomax reserves the right to suspend or terminate any user at its sole discretion with or without notice for reason of violation of this clause.
The Services may include, but are not limited to:
● Device connection and management
● Live video viewing and playback
● Alarm notifications
● Cloud storage and cloud-based features
● Software updates and technical support
These services are for informational purposes only to the user and there is no guarantee of notification being delivered in real time or that the service will prevent loss and or damage to property or life.
These services does not replace professional security monitoring or emergency services. You are solely responsible for maintaining alternative security measures and emergency response mechanism. Certain features may require compatible devices, internet connectivity, and/or paid subscriptions.
Leomax reserves the right to modify, suspend or discontinue any part of the service at any time without liability.
Leomax is not responsible for any interruption in services caused by third party failures, government suspensions on the service or device failure.
You may be required to create an account to access certain Services. You agree to:
● Provide accurate and complete registration information
● Keep your login credentials confidential
● Notify us immediately of any unauthorized use of your account
You are solely responsible for all activities conducted under your account. Leomax shall not be liable for any loss or damage arising from your failure to comply with this obligation.
You agree to:
● Use the Services only for lawful purposes
● Comply with all applicable laws and regulations of Uganda, including data protection, surveillance, and telecommunications laws
● Obtain any required consent before recording audio or video of individuals
● Not misuse, reverse-engineer, or interfere with the Services
You are solely responsible for ensuring your use of cameras and recordings complies with Ugandan law. Leomax shall not be liable for any loss or damage arising from your failure to comply with this obligation
LEOMAX may offer paid cloud-based services, including but not limited to cloud storage, video backup, extended playback, and advanced analytics (“Cloud Services”).
● Cloud Services are provided on a subscription or prepaid basis, as displayed in the App at the time of purchase.
● Fees are charged in advance and may be billed monthly, annually, or per plan selected.
● You authorize LEOMAX or its payment processors to charge your selected payment method for all applicable fees, taxes, and charges.
● Telecom carrier data plans and internet fee associated with your use of our App will be borne by you.
All payments for Cloud Services are final and strictly non-refundable, including but not limited to:
● Unused subscription periods
● Partial use of Services
● Account termination or deletion
● Device removal or replacement
● Service interruption due to user error, network issues, or incompatible devices
No refunds, credits, or exchanges will be provided unless required by applicable law.
LEOMAX reserves the right to change Cloud Service fees at any time. Any price increase will take effect only after thirty (30) days’ notice. Your continued use of the Services after the date constitutes acceptance of the new fee. If you do not agree to the change, you have the right to cancel your subscription without penalty before the new price applies.
Any changes will apply to future billing cycles and will be communicated through the App or other reasonable means.
We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. LEOMAX may:
● Modify, suspend, or discontinue any part of the Services
● Perform maintenance or updates that may temporarily affect availability. We are not liable for losses caused by service interruptions beyond our reasonable control.
All rights, title, and interest in the Services, including software, trademarks, logos, and content, are owned by LEOMAX or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or lawful business purposes.
Your use of the Services is subject to the ASKARI SMART CAMERA Privacy Policy, which forms part of this Agreement. Please review it to understand how we collect and process personal data.
LEOMAX may suspend or terminate your access to the Services if you:
● Violate this Agreement
● Engage in unlawful or abusive conduct
● Fail to make required payments
You may stop using the Services at any time. Termination does not entitle you to any refund.
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement.
However, nothing in this Agreement excludes or limits your statutory rights as a consumer in Uganda, including your right to redress for substandard or defective services.
To the maximum extent permitted by Ugandan law:
● LEOMAX shall not be liable for indirect, incidental, consequential, or punitive damages
● LEOMAX’s total liability shall not exceed the amount paid by you for the Services in the preceding 12 months
You agree to indemnify and hold harmless LEOMAX from any claims, damages, losses, or liabilities arising from:
● Your misuse of the Services
● Violation of this Agreement
● Violation of any law or third-party rights
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Uganda.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Uganda.
LEOMAX may update this Agreement from time to time. A thirty (30) days’ noitce of any material change will be given via your registered email or an in-app notification. If you do not agree to the revised Terms, you must stop using the Services before the changes take effect. Continued use of the Services after the 30 days’ notice constitute acceptance of the revised Agreement.
