Safe school environment

Immigration enforcement officers: Schools are generally prohibited from voluntarily granting immigration enforcement officers access to campus. They need a judicial warrant or court order.
Personal information: Unless explicitly required by law, schools are prohibited from
- requesting social security numbers
- inquiring about the citizenship or immigration status of students, their parents, or guardians.

BUSD REAFFIRMS Commitment to Student AND FAMILY Safety Regardless of Immigration Status

Dear Burbank Unified School District Community,

In light of recent news regarding immigration enforcement in the Los Angeles area, we want to take a moment to reaffirm our unwavering commitment to the safety and well-being of all our students, teachers, support staff, administrators and families.

While the regular school year has ended, we recognize that many in our community are still engaged in summer school sessions at some of our campuses, and our Burbank Adult School remains open. Please know that every BUSD site continues to uphold the highest standards of safety, with established protocols to immigration personnel requests for information. Some of our BUSD protocols include:

All schools and district office properties have a single point of entry.
All BUSD Personnel have received training on how to respond to Immigration and Customs Enforcement (I.C.E.) officials if they attempt entry.

Our schools should be safe spaces where every student has the opportunity to learn in an environment free from fear or disruption. We remain dedicated to fostering inclusive, welcoming spaces that honor the diversity of our community.

Tras las recientes noticias de imposición de medidas para control migratorio en el área de Los Ángeles, queremos reiterar nuestro compromiso inquebrantable de preservar la seguridad y el bienestar de todos nuestros estudiantes, maestros, personal de apoyo, administradores y familias.

A message from Superintendent Dr. John Paramo

Given the recent news that the Trump administration has removed the sensitive locations policy, the Burbank Unified School District wants to reiterate our commitment to ensuring all our students, regardless of immigration status, have access to a safe and secure learning environment.

The sensitive locations policy prevented Immigration and Customs Enforcement (ICE) agents from arresting immigrants in places such as schools, churches and hospitals. It is important to note that this policy change does not change our student’s constitutional rights to education or overrule state constitutional protections.

No student should have to come to school in fear, and no parent should fear for their child’s safety. Our students have a constitutional right to be educated in an accepting, safe environment, regardless of immigration status. No student will be denied enrollment in BUSD due to their or their family’s immigration status.

Information was recently sent to the BUSD community outlining their rights under the law. The district will print a declaration card that any student can carry that outlines their rights, including their right not to answer any questions. The card can be handed to the authorities if approached. However, this should not be necessary at any of our schools as we will not allow Immigration agents on any of our sites. Please know that the Board of Education and district and site leadership are resolved to do what is necessary to ensure a safe school environment for all.

As Los Angeles County Board of Education Superintendent Dr. Debra Duardo stated in her communication to school districts, “It is imperative that we stand united in our unwavering commitment to the education and well-being of every student within our county.”

Dadas las noticias recientes de la administración del presidente Donald Trump, relacionadas con la revocación de la política de “lugares sensibles”, el Distrito Escolar Unificado de Burbank quiere reiterarle nuestro compromiso de garantizar a nuestros estudiantes, un ambiente de enseñanza seguro y estable, independientemente de su condición migratoria.

La “Política de Ubicaciones Sensibles” con anterioridad impedía que los agentes del Servicio de Inmigración y Control de Aduanas (ICE según sus siglas en inglés) arrestaran a inmigrantes en lugares como escuelas, iglesias y hospitales. Es importante destacar que esta política no anula el derecho constitucional que tienen los estudiantes de recibir una formación educativa ni anula las garantías constitucionales del estado.

Ningún estudiante debería tener que asistir a la escuela con miedo, y ningún padre debería temer por la seguridad de su hijo. Nuestros estudiantes tienen la garantía constitucional de recibir una formación educativa en un entorno seguro y de aprobación inclusiva, independientemente de su condición migratoria. A ningún estudiante se le negará la inscripción al Distrito Escolar Unificado de Burbank (BUSD) por su condición migratoria ni la de su familia.

Recientemente, se envió un comunicado a la comunidad de BUSD detallando sus derechos de conformidad con la ley. El distrito imprimirá una tarjeta donde se estipulan las garantías constitucionales, así cómo, el derecho a no responder preguntas para que los estudiantes lo porten consigo a todas partes. La tarjeta podrá entregarse a las autoridades si llegará a ser necesario. Sin embargo, esto no debería ser necesario en ninguna de nuestras escuelas, ya que no permitiremos que agentes de inmigración ingresen a ninguno de nuestros colegios. Es importante que tomen en cuenta que el Consejo Directivo de Educación (Mesa Directiva de la Educación), y los que integran el grupo de liderazgo de la oficina del Distrito y los colegios, están comprometidos en hacer lo necesario que garantice un entorno escolar seguro para todos.

You have constitutional rights:

DO NOT OPEN THE DOOR if an immigration agent is knocking on the door.
DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you. You have the right to remain silent.
DO NOT SIGN ANYTHING without first speaking to a lawyer. You have the right to speak with a lawyer.
If you are outside of your home, ask the agent if you are free to leave and if they say yes, leave calmly.
If you are inside of your home, do not give the agent permission to enter your home based on your 4th Amendment rights under the United States Constitution unless the agent has a warrant to enter, signed by a judge or magistrate with your name on it. Ask the agent to slide the document under the door or show it to you through the window.

NO RESPONDA A NINGUNA PREGUNTA de un agente de inmigración si este último intenta hablar con usted. Tiene derecho a permanecer en silencio.
NO FIRME NADA sin hablar primero con un abogado. Tiene derecho a consultar un abogado.
Si se encuentra fuera de tu casa, pregunte al agente si tiene la libertad de irse, y si le dice que sí, váyase o aléjese con calma.
Si está dentro de su casa, no le de permiso al agente de entrar a su hogar de conformidad con las garantías que la constitución le otorga específicamente el derecho que incorpora la Cuarta Reforma de la Constitución de los Estados Unidos de América (“Fourth Amendment of the United States of América Constitution”, a menos que el agente tenga una orden judicial de ingresar a su hogar firmada por un juez o magistrado y a su nombre. Pida al agente que pase el dicho documento por debajo de la puerta o que se lo muestre a través de la ventana.
