What is Fair Use, Copyright Law, and Creative Commons? Fair use is the copying or use of a copyrighted material (images, audio, video, etc) for a "transformative" purpose (that is they "transform" the original work). Copyright Law basically grants monopoly protection for "original works of authorship." This law is a set of exclusive rights to protect creative works of the owner which have a date of expiration of 70 years or after the author's death. Creative Commons is a set of legal tools, a non profit organization, and global network inspired by willingness to for people to share creativity and knowledge, enabled by a set of open copyright licenses.
What is the Four Factor Test? In order to determine whether a particular use for creative works is fair these four factors are considered: The purpose and character of the use, The nature of the work, The amount and substantiality of the portion used in relation to the work as a whole, The effect of the use on the market or potential market for the original work.
What are the consequences when you violate copyright law? A legal cease and desist letter warning, payment of various fines, payment of "actual damages" to the person who was stolen from, payment of "statutory damages" to the person who was stolen from, additional awards by the court, confiscation of anything and everything pertaining to the case, possible jail time, and expulsion from school, a university, or job loss.
How will you uphold the laws and guidelines? Obtain written and legal permission from the owner/creator, engage in fair use, and cite any work where you are not the original creator.
