These Terms and Conditions (“Terms”) apply to the JAX app (the “Application”), created by MJB Studios LLC (the “Service Provider”) as a freemium service.
By downloading or using the Application, you agree to these Terms. Please read them carefully before continuing.
All content within the Application — including lessons, written materials, character dialogue, and behavioral techniques — is original and created by the Service Provider.
The program is not affiliated with or based on any third-party quit-smoking or quit-vaping methods, publications, or frameworks. Any similarity is purely coincidental.
All content is the intellectual property of the Service Provider. Copying, modifying, translating, or creating derivative works is strictly prohibited.
The Application provides behavioral education and motivational tools for general wellness and habit improvement.
It is not a medical or therapeutic intervention for nicotine addiction, withdrawal, or dependence.
By using the Application, you confirm that you:
Are at least 18 years old (or the age of majority in your jurisdiction).
Are not pregnant or breastfeeding.
Do not have any serious medical or psychiatric conditions requiring professional treatment, including but not limited to severe depression, psychosis, or substance-use disorders.
Understand that this Application is intended only for adults seeking personal growth and behavioral awareness.
If you do not meet these eligibility requirements, you must not use the Application.
The content in the Application — including lessons, coaching, and behavioral guidance — is for educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment, and it is not a substitute for professional medical care, therapy, or rehabilitation services.
The Application does not diagnose, treat, cure, or prevent nicotine dependence, substance-use disorder, or any other medical or psychological condition. It does not provide psychotherapy or mental-health counseling and should not be used as a replacement for such services.
You are encouraged to consult your physician or other qualified healthcare provider before making any health-related decisions, including quitting smoking or vaping. If you experience withdrawal symptoms, anxiety, depression, or health complications while attempting to quit, seek medical support immediately.
In case of a medical or mental-health emergency, call emergency services or go to the nearest emergency department. The Application is not intended for crisis intervention or emergency response. The content and statements in this Application have not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulatory body. Results may vary. The Service Provider makes no guarantees regarding effectiveness or specific outcomes.
Use of the Application is entirely at your own discretion and risk. The Service Provider assumes no responsibility for any direct or indirect consequences resulting from its use.
The Service Provider makes no promises or warranties that using the Application will result in quitting vaping, smoking, or any behavioral change. Individual results vary and depend on personal factors outside the Service Provider’s control.
Any testimonials or success stories in the Application or marketing materials represent individual experiences only and are not typical or guaranteed outcomes.
The Application may include access to community discussions, forums, or peer-support spaces (“Community Features”).
These are offered for motivation and mutual encouragement only.
Community Features do not provide professional advice and are not moderated by medical professionals.
Any statements made by other users, moderators, or community members are their own opinions and should not be relied upon as professional or medical guidance.
You are responsible for your own participation and for maintaining respectful interactions with other users.
By using the Application, you acknowledge that behavioral change involves uncertainty and personal responsibility.
You voluntarily assume all risks associated with your actions, decisions, and outcomes.
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Application.
Any cause of action you bring related to these Terms must be filed within one (1) year after the claim arises, or it is permanently barred.
You are responsible for maintaining the security of your device and access credentials.
Do not jailbreak or root your device, as this can compromise security and cause the Application to malfunction.
The Application requires an internet connection. The Service Provider is not responsible for reduced functionality due to poor connectivity, data limits, or device issues. You are responsible for any data or roaming charges billed by your mobile provider.

AppsFlyer
The Service Provider is not responsible for how these third parties collect, store, or handle data.
To improve the Application and contribute to general understanding of behavior change, anonymized and aggregated usage data may be analyzed for research and product-development purposes.
Such data will never identify you personally and will always be handled in compliance with applicable privacy laws and the JAX Privacy Policy. By using the Application, you consent to this limited, anonymized research use.
The Service Provider may update, modify, or discontinue the Application at any time without notice.
Updates may be required to continue using the Application. If discontinued, your right to use the Application ends, and you must uninstall it from your device.
If you make in-app purchases, you consent to limited sharing of usage data with Apple solely to assist in refund processing.
This may include non-personal details about your access to purchased content. All sharing complies with Apple’s refund policies.
These Terms may be updated periodically. Please review this page regularly for changes.
Updates take effect once posted.

These Terms are governed by and construed under the laws of the State of Michigan, United States, without regard to conflict-of-law principles.
