These Terms and Conditions of Use (the “Terms of Use”) apply to the Foody: AI Food Photo Enhancer website located at www.foody.app, all associated sites linked to www.foody.app by Appisode LLC, its subsidiaries, and affiliates, including Foody websites around the world (collectively, the “Websites”) and all apps developed by Appisode LLC (“Apps”). The Websites and Apps are the property of Appisode LLC (“Appisode”) and its licensors.

BY USING THE WEBSITES AND APPS, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE WEBSITES OR ANY OF THE APPS.

Appisode reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Websites and Apps following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Appisode grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Websites and Apps.

Content

All text, graphics, user interfaces, visual interfaces, photographs, uploaded home/office photos, AI-generated or AI-enhanced images, trademarks, logos, sounds, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel”, and arrangement of such Content, contained on the Websites and in the Apps is owned, controlled, or licensed by or to Appisode, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Websites and Apps may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, web site, app, or other medium for publication or distribution or for any commercial enterprise, without Appisode’s express prior written consent.

You may use information on Apps (such as data sheets, knowledge base articles, and similar materials) purposely made available by Appisode for downloading from the Websites or Apps, provided that you (1) not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose, and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

Your Use of the Websites or Apps

By using Foody: AI Food Photo Enhancer Privacy, you agree to the following:

You will only upload photos that you own or are authorized to use.
You will not upload, edit, or attempt to enhance images containing offensive, illegal, or copyrighted third-party materials without permission.
You understand that AI-enhanced images are generated outputs and may not always be accurate or realistic representations.
You will not use Foody for architectural, engineering, or legal purposes that require licensed professional advice.
You will not provide false personal information or create an account for anyone other than yourself without permission.
You will not create more than one personal account.
You will not share your password or otherwise jeopardize the security of your account.
You will not use the App if you are under 18.
You will not attempt to reverse engineer, copy, or misuse the AI technology used in the App.
You will not use the App or any Content for unlawful purposes or in violation of these Terms.

You acknowledge that you are executing this Terms of Use with Appisode alone. No third party is a party hereto, and no third party is making any direct or implied representations in connection with this Terms of Use or the Services delivered hereunder. You acknowledge that no third party has any liability related to this Terms of Use and the Services delivered hereunder, and hereby indemnifies any such third party in connection herewith.

AI Disclaimer

Foody provides AI-powered visual suggestions such as color changes, furniture removal, object replacement, or photo enhancement. These outputs are for illustration purposes only and do not represent actual renovations, structural changes, or professional design advice.

Appisode does not guarantee the accuracy, quality, or usability of AI-generated images for construction, valuation, real estate sales, or any other commercial decision-making process. Foody should be used solely as a creative and inspirational tool.

Other Terms and Conditions

Additional terms and conditions may apply to purchases of Apps and to specific portions or features of the Websites, including contests, promotions, or other similar features, all of which terms are made a part of these Terms of Use by this reference.

Accounts, Passwords, and Security

Certain features offered on or through the App may require you to open an account. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify Appisode immediately of any unauthorized use of your account or password, or any other breach of security.

Privacy

Appisode’s Privacy Policy applies to use of the Websites and Apps, and its terms are made a part of these Terms of Use by this reference. Additionally, you acknowledge that Internet transmissions are never completely private or secure.

Links to Other Websites

The Websites and Apps may contain links to other independent third-party websites (“Linked Websites”). These Linked Websites are provided solely as a convenience to our visitors. Appisode is not responsible for and does not endorse the content of such Linked Websites.

Disclaimers

APPISODE DOES NOT PROMISE THAT THE WEBSITES, APPS, OR ANY CONTENT, SERVICE, OR FEATURE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED. THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

You understand that AI outputs may vary and may not always be suitable for your intended use. Appisode disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose.

Limitation of Liability

Except where prohibited by law, in no event will Appisode be liable to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if Appisode has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold Appisode, its officers, directors, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against Appisode by any third party due to or arising out of or in connection with your use of the Websites or Apps.

Governing Law; Dispute Resolution
