Introduction

Welcome to Cosmetics AI: Try On Face (the “App”), owned and operated by Appisode LLC (“Appisode,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the App and any related features, services, or content. By downloading, installing, registering for, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.

What the App Does
Cosmetics AI: Try On Face allows users to:

Upload selfies or facial images.
Upload cosmetic or beauty product images (e.g., makeup, skincare, accessories).
Use artificial intelligence (AI) to generate visual “try-on” results showing how selected products may appear on the user’s face.

All outputs are AI-generated visual simulations intended for preview and inspiration purposes only.

Eligibility

You must be at least 18 years of age to use the App.
By using the App, you represent and warrant that you have the legal capacity to enter into these Terms.
You agree not to use the App in violation of any applicable law or regulation.

Account Registration and Security

Certain features may require account creation.
You agree to provide accurate, current, and complete information and to keep it updated.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
You must notify Appisode immediately of any unauthorized use of your account or suspected security breach.
Appisode is not responsible for losses caused by unauthorized access resulting from your failure to secure your credentials.

License Grant

Subject to these Terms, Appisode grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes only.

You may not:

Copy, modify, distribute, sell, or sublicense the App or its outputs.
Reverse engineer, decompile, or attempt to extract source code or AI models.
Use the App for professional, commercial, advertising, or resale purposes without prior written consent.
Use the App to create unlawful, misleading, or deceptive content.

User Content

Submissions

The App allows you to upload images, including selfies and product photos, and to generate AI-enhanced visuals (collectively, “User Content”). You retain ownership of your original uploaded content.

License to Appisode

By uploading User Content, you grant Appisode a worldwide, royalty-free, sublicensable, transferable license to use, store, process, modify, display, and generate derivative AI outputs from your content solely for the purpose of operating, maintaining, and improving the App.

Prohibited Content

You agree not to upload or submit content that:

Infringes intellectual property, privacy, publicity, or likeness rights.
Contains explicit, pornographic, hateful, harassing, or discriminatory material.
Depicts minors, illegal activities, or deceptive representations.
Includes third-party faces or products without proper authorization.
Contains malware, viruses, or malicious code.

Appisode reserves the right to remove any content that violates these Terms.

AI and Visual Simulation Disclaimer

All try-on visuals are AI-generated simulations and do not represent real-world results.
Visual outputs may differ significantly from actual appearance due to lighting, skin tone, facial structure, product formulation, or application method.
The App does not provide cosmetic, dermatological, medical, or professional beauty advice.
Appisode makes no guarantees regarding accuracy, realism, suitability, or outcomes of AI-generated visuals.

The App is intended for creative, preview, and entertainment purposes only.

No Medical or Professional Advice

The App does not diagnose skin conditions, allergies, or sensitivities and does not replace consultation with licensed professionals. You should always consult qualified professionals before using cosmetic or skincare products.

Subscriptions and Payments

Certain features may require a paid subscription.

Payments are charged to your app store account upon confirmation of purchase.
Subscriptions automatically renew unless auto-renew is disabled at least 24 hours before the end of the current billing period.
Renewal charges occur within 24 hours prior to the end of the current period.
Any unused portion of a free trial, if offered, is forfeited upon subscription purchase.
Subscription management and cancellation are handled through your device’s account settings.
Fees are non-refundable except where required by law.

Restrictions on Use

You agree not to:

Use the App for unlawful, fraudulent, or deceptive purposes.
Interfere with or disrupt the App’s functionality or security.
Access the App using bots, scrapers, or automated systems without permission.
Upload content intended to mislead others or impersonate individuals or brands.

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”
APPISODE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.

Appisode does not warrant that:

The App will be uninterrupted, secure, or error-free.
AI-generated visuals will meet user expectations or reflect real-world outcomes.
Errors or defects will be corrected.

Your use of the App is at your own risk.

Limitation of Liability

To the maximum extent permitted by law:

Appisode shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, reputation, or data.
Appisode’s total liability arising out of or related to the App or these Terms shall not exceed US $100.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Appisode, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

Your use or misuse of the App.
Your violation of these Terms.
Your violation of any law or third-party rights.

Termination

Appisode may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. Upon termination, your license to use the App will immediately cease.

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts located in California, US.

Communications

By using the App, you consent to receive electronic communications related to your use of the App.

Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Appisode regarding the App.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any provision does not constitute a waiver.
Assignment: You may not assign these Terms; Appisode may assign them without restriction.

Feedback

Any feedback, suggestions, or ideas you provide may be used by Appisode without compensation or obligation.
