USE OF LAW ENFORCEMENT
I. Statement of Policy
The school department recognizes the benefit to students and their families of resolving student behavior issues in a school context. The school system, however, also recognizes that it has an obligation to protect its property and the health and well-being of all students and employees. In addition, as part of the larger community, the school acknowledges its obligation to report criminal activity on school grounds.
This policy concerns the relationship between the school and the law enforcement community ; the policy is not inclusive and serves only to set forth some basic guidelines concerning this relationship.
II. Immediate Danger to Health, Welfare of Property
A. If, in the discretion of an administrator, a student poses an immediate threat to his/her own health, welfare or safety, or the health, welfare or safety of any person, the administrator shall:
1. Take necessary action, not otherwise prohibited by school policy (or the student's individualized educational program), to secure the health and safety of the individuals involved;
2. Attempt to move the student from the unsafe situation and try to place the student in a safe environment;
3. If, in the judgment of the administrator, the student's continued presence on school grounds represents a danger to the health, welfare and safety of any individual, the administrator shall:
a. Attempt to contact the student's parent(s)/guardian(s) to assume physical responsibility;
b. If the parent(s)/guardian(s) is not available, call the person listed on the student's emergency card to assume physical responsibility;
c. If none of the individuals listed in steps a. and b. are available to assume physical responsibility for the student, contact the appropriate law enforcement agency to assume physical responsibility for the student;
4. An administrator should continue to attempt to reach parent(s)/guardian(s) or the person listed on the student's emergency card to inform them of the situation.
III. Violation of the Law
If, in the judgment of an administrator a student has violated the law, an administrator may notify law enforcement officials and shall notify parent(s)/guardian(s) and the Superintendent of Schools.
