Terms and Conditions for Sell-X – Buy & Sell Items Quickly

Welcome to Sell-X  By downloading, accessing, or using the Sell-X– Buy & Sell Items Quickly app (“App”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the App. If you do not agree with these Terms, please do not use the App.

1. Introduction

Sell-X is a platform that connects buyers and sellers for trading new, preowned, and used goods locally. Sell-Xdoes not own, buy, or sell the items listed on the App and serves solely as an intermediary platform.

2. User Accounts

a. Account Registration

• To use Sell-X, users must create an account by providing accurate and up-to-date information such as a mobile number, email address, and other required details.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

b. Account Termination

• Sell-Xreserves the right to terminate or suspend your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities on the App.

• Users can delete their accounts at any time through the App’s account deletion feature.

3. User-Generated Content

a. Posting Ads

• Users can post ads for items they wish to sell, including accurate descriptions, real photos, and pricing. By posting an ad, you confirm that the content is true and complies with these Terms.

b. Prohibited Content

• Users must not post ads or content that:

  • Contains illegal or counterfeit goods.

  • Violates intellectual property rights.

  • Contains offensive, discriminatory, or harmful material.

  • Promotes fraudulent or misleading activities.

c. Responsibility for Content

• Sell-Xis not responsible for the accuracy or authenticity of user-generated content. Users are solely responsible for their listings and the accuracy of the information provided.

4. Subscription and Payments

a. Subscription Plans

• Sell-X offers subscription plans to access premium features. Details of available subscription plans are listed within the App.

b. Payment Methods

• Payments for subscriptions are processed via UPI or third-party payment gateways. Sell-Xdoes not store sensitive payment information such as UPI IDs or bank details.

c. Refund and Cancellation Policy

• Refunds are not applicable for any purchases. We appreciate your understanding .

5. Buyer and Seller Responsibilities

a. Buyer Responsibilities

• Buyers must verify the condition and authenticity of the item before making a purchase. Sell-Xis not responsible for disputes or issues arising between buyers and sellers.

b. Seller Responsibilities

• Sellers must provide accurate descriptions and real photos of items. Misleading or fraudulent listings are strictly prohibited.

c. Transactions

• All transactions are conducted directly between buyers and sellers. Sell-X does not facilitate or guarantee the completion of transactions.

6. Communication Between Users

a. In-App Messaging

• Users can communicate through text-based chat within the App to inquire about listed items. Sell-X does not monitor or assume responsibility for user interactions.

b. Prohibited Communication

• Users are prohibited from using the App to send spam, offensive, or harmful messages. Violations may result in account suspension or termination.

7. Prohibited Activities

Users must not:

• Use the App for illegal or unauthorized purposes.

• Post fraudulent or counterfeit goods.

• Attempt to hack, disrupt, or manipulate the App’s functionality.

• Collect or harvest other users’ personal data without consent.

8. Intellectual Property

a. Ownership

• Sell-X retains all rights, title, and interest in and to the App, including its design, features, and content. Users may not reproduce, distribute, or create derivative works based on the App without Sell-X'' prior written consent.

b. User-Generated Content

• By posting content on Sell-X , users grant Sell-X a non-exclusive, royalty-free, worldwide license to display, distribute, and promote the content on the App.

9. Limitation of Liability

• Sell-X is not responsible for any losses, damages, or disputes arising from:

  • The sale or purchase of goods through the App.

  • The accuracy or authenticity of user-generated content.

  • Unauthorized access to your account due to negligence on your part.

• The App is provided "as is," and Sell-X does not guarantee uninterrupted or error-free use.

10. Privacy Policy

Your use of the App is governed by our Privacy Policy (link to Privacy Policy), which outlines how we collect, use, and protect your personal information.

11. Changes to Terms

Sell-X reserves the right to update or modify these Terms at any time. Users will be notified of significant changes through the App. Continued use of the App after changes are made constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

a. Governing Law

• These Terms are governed by the laws of India.

b. Dispute Resolution

• Any disputes arising out of or related to these Terms or the App will be resolved through binding arbitration in Chandigarh, India, in accordance with the Arbitration and Conciliation Act, 1996.
