Terms and Conditions for Nearbyo – Buy, Sell & Connect Locally

Welcome to Nearbyo. By downloading, accessing, or using the Nearbyo app ("App"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using the App. If you do not agree with these Terms, please do not use the App.

1. Introduction

Nearbyo is a local marketplace platform that connects buyers and sellers for trading new, pre-owned, and used goods. Nearbyo does not own, purchase, sell, inspect, store, or deliver any products listed on the platform. Nearbyo acts solely as an intermediary platform that enables communication between users.

2. User Accounts

a. Account Registration

To use Nearbyo, users may be required to create an account by providing accurate and up-to-date information, including but not limited to a mobile number, email address, and profile details.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

b. Account Suspension and Termination

Nearbyo reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, abusive, or harmful activities.

Users may delete their accounts at any time through the account deletion feature available within the App.

3. User-Generated Content

a. Posting Listings

Users may post advertisements for items they wish to sell, including descriptions, photos, pricing, and location information. By posting a listing, you confirm that the information provided is accurate and lawful.

b. Prohibited Content

Users must not post content that:

• Promotes illegal, counterfeit, stolen, or prohibited goods.

• Violates intellectual property rights.

• Contains offensive, discriminatory, abusive, or harmful material.

• Includes misleading, fraudulent, or deceptive information.

• Violates applicable laws or regulations.

c. Responsibility for Content

Nearbyo is not responsible for the accuracy, legality, or authenticity of user-generated content. Users are solely responsible for their listings and interactions.

4. Subscription and Payments

a. Premium Features

Nearbyo may offer optional premium features, promotional packages, or subscription plans. Details of such offerings will be displayed within the App.

b. Payment Processing

Payments may be processed through UPI, Google Play Billing, or third-party payment gateways. Nearbyo does not store sensitive banking or payment credentials.

c. Refund Policy

Unless otherwise required by applicable law, all purchases, subscriptions, and promotional services are non-refundable.

5. Buyer and Seller Responsibilities

a. Buyer Responsibilities

Buyers are responsible for verifying the condition, ownership, authenticity, and suitability of items before completing any transaction.

b. Seller Responsibilities

Sellers must provide accurate descriptions, genuine photographs, and truthful information regarding their listings.

c. Transactions

All transactions are conducted directly between buyers and sellers. Nearbyo does not participate in, guarantee, or assume responsibility for transactions between users.

6. Communication Between Users

a. Communication Features

Nearbyo may provide in-app chat, call, and WhatsApp integration features to facilitate communication between users.

b. Acceptable Use

Users must not use communication features to:

• Send spam or unsolicited messages.

• Harass, threaten, or abuse other users.

• Share illegal, harmful, or inappropriate content.

Violations may result in account suspension or permanent removal from the platform.

7. Prohibited Activities

Users must not:

• Use the App for unlawful purposes.

• Post prohibited, counterfeit, or fraudulent products.

• Attempt to hack, reverse engineer, disrupt, or interfere with the App.

• Collect or misuse other users' personal information without consent.

• Circumvent platform rules or engage in deceptive practices.

8. Intellectual Property

a. Ownership

Nearbyo and its associated branding, design, features, logos, and content are owned by Nearbyo and protected by applicable intellectual property laws.

Users may not copy, modify, distribute, or create derivative works from the App without prior written permission.

b. User Content License

By posting content on Nearbyo, you grant Nearbyo a non-exclusive, worldwide, royalty-free license to display, reproduce, distribute, and promote such content for platform-related purposes.

9. Limitation of Liability

Nearbyo shall not be liable for:

• Any loss or damage arising from transactions between users.

• The accuracy, quality, legality, or authenticity of listings.

• Disputes between buyers and sellers.

• Unauthorized access to user accounts resulting from user negligence.

• Service interruptions, technical issues, or platform downtime.

The App is provided on an "as is" and "as available" basis without warranties of any kind.

10. Privacy Policy

Your use of Nearbyo is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Changes to Terms

Nearbyo reserves the right to update or modify these Terms at any time. Significant changes may be communicated through the App or other appropriate channels.

Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

a. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

b. Dispute Resolution

Any dispute arising out of or relating to these Terms or the use of the App shall be resolved through arbitration in Chandigarh, India, in accordance with the Arbitration and Conciliation Act, 1996.

13. Owner Information

Nearbyo is owned and operated by Gurwinder Singh, an individual proprietor.

Our goal is to provide a secure, reliable, and user-friendly local marketplace experience for buyers and sellers.
