When You File Bankruptcy

You can only receive a chapter 7 discharge once every eight years. Other rules may apply if you previously received a discharge in a chapter 13 case. No one can make you pay a debt that has been discharged, but you can voluntarily pay any debt you wish to pay. You do not have to sign a reaffirmation agreement (see below) or any other kind of document to do this.

Once your bankruptcy concludes, you will receive what is known as a bankruptcy discharge which states that your case is now closed and all debts included are no longer enforceable. Creditors listed in the petition can no longer contact you about your debt or file any legal proceedings against you. It is important to keep this document as you may need to present it should you apply for a loan in the future. However, if you have misplaced your discharge documents, you can still obtain a copy if you need it for any reason.

CONTACT THE CLERK OF THE COURT

The first place to check when you need a copy of your bankruptcy discharge papers is with the Clerk of the Court where your case was filed. Some courts will allow you to search the record online for free, while others charge a fee for searches. If you need copies of the document, there will be a fee as well. Copies of the document are often a charge per page. If it has been many years, the case may have been archived, so additional fees may apply.

Public Access to Court Records (PACER) is an electronic public access service that provides information on cases filed in federal court. In order to search the database, you must register with PACER,

Copy Sent By Clerk's Office: The Clerk's Office will mail a copy of the discharge to the debtor, the case trustee, and all creditors. The discharge will be mailed to the addresses shown in the debtor's list of creditors or in the schedules, whichever is filed later.

How to Get a Copy of Your Bankruptcy Discharge

Luckily, there are several ways you can go about replacing your copy of your official bankruptcy discharge. Following are three different methods you can use to obtain one:

1. Call the attorney who handled your case.

Many attorneys keep client files for several years before purging them. There is a good chance that your lawyer will still have a copy in his or her file. If not, he or she may be able to access the Court's records electronically to print the requested document.

If you are concerned about the document retrieval fees that your attorney may charge for this service, ask first! There's a good chance that he or she will provide this service at no charge. However, to avoid any unwelcome surprises, it is a good idea to find out in advance what fees will be charged. If it is more than you are willing to pay, explore your other options (see below) for getting a copy of the bankruptcy discharge.

2. Request it from the Bankruptcy Clerk's Office.

You can also request a bankruptcy discharge copy from the Clerk's office located in the district and division where the bankruptcy case was filed. The bankruptcy clerk will charge a small fee for this service. If the case has been closed for some time, there may be an additional retrieval fee for the Clerk to access their archived files.

3. Open a PACER account.

Do you know if your case was electronically filed with the bankruptcy court? If you filed bankruptcy within the past few years, there is a good chance that it was, and for cases that are electronically filed, many of the documents in the case are stored online in the Court's PACER system.
