Welcome to youdontsay, a mobile word game application (the "App") provided by migapka sp. z o.o. ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our App and any related services (collectively, the "Services").
By downloading, accessing, or using our App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
The Service
youdontsay is a word game that challenges players to describe words to their teammates without using a list of forbidden words. A key feature of the App is the use of voice recognition technology, processed on your device, to detect the use of these forbidden words during gameplay.
2. Eligibility
To use our Services, you must be at least 13 years old or the minimum age required in your country to consent to the processing of your personal data. If you are under the age of 18, you must have your parent's or legal guardian's permission to use the App and they must agree to these Terms on your behalf.
3. User Accounts
To access the full features of the App, you are required to log in using your Google account (Google Auth). You are responsible for all activities that occur under your account and for keeping your account credentials confidential. You agree to notify us immediately of any unauthorized use of your account.
4. Data Collection and Privacy
Your privacy is important to us. Our Privacy Policy, which is an integral part of these Terms, explains in detail how we collect, use, and protect your personal data. Here is a summary of our data practices:
Personal Data: We collect information you provide when you log in via Google Auth, such as your name and email address.
Game Data: We store data about the games you've played to enhance your user experience, for instance, by preventing the repetition of game cards.
Voice Transcriptions: To enable the core gameplay feature of detecting forbidden words, the App will access your device's microphone during gameplay to capture and transcribe your speech.
Processing: The speech-to-text transcription is performed locally on your device using the built-in capabilities of your mobile operating system (Android or iOS).
Storage and Security: The resulting text transcriptions of your gameplay are stored on secure MongoDB servers located in Belgium. We implement appropriate technical and organizational measures to protect this data, and access is restricted to authorized personnel.
Purpose: The primary purpose of storing these transcriptions is for the functionality of the game. We may also use this data in an anonymized and aggregated form for analytics to improve the App's features and performance.
Data Retention: We will store your personal data, including game data and voice transcriptions, for a period of one year. You have the right to request the deletion of your data at any time by contacting us at youdontsay@youdontsayapp.com.

5. User-Generated Content
In the event that future features of the App allow you to create content, you will retain ownership of any intellectual property rights that you hold in that content. However, by submitting content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content works better with our Services).
6. Acceptable Use
You agree not to misuse the Services. For example, you must not:
Attempt to interfere with the proper working of the App.
Use the App for any illegal or unauthorized purpose.
Attempt to decompile, reverse engineer, or otherwise attempt to obtain the source code of the App.
Use the App in a way that could be harmful to us or any third party.
7. Future Monetization
youdontsay is currently free to use. We reserve the right to introduce monetization features in the future, which may include, but are not limited to:
Advertisements: Displaying ads within the App.
Donations: Offering an option for users to make voluntary donations.
In-App Purchases: Selling digital goods, such as new card decks or features.
Subscriptions: Offering premium features for a recurring fee.
Sale of Anonymized Data: We may sell or license anonymized and aggregated data, including transcription data, to third parties for research or commercial purposes. This data will not be linked to any individual user.
We will provide you with notice of any changes to our monetization model and any applicable terms.
8. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available" without any warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, migapka sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
9. Termination
We may suspend or terminate your access to the Application at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
10. User Account Deletion
You have the right to delete your account in the Application at any time. Account deletion results in the permanent and irreversible deletion of all your personal data associated with that account, including game data and voice transcriptions stored on our servers, in accordance with our Privacy Policy and applicable data protection laws. Any anonymized or aggregated data that cannot be linked back to an individual user may remain in our systems.
To delete your account, you may use a dedicated function within the Application (if made available) or send an explicit account deletion request to the email address: youdontsay@youdontsayapp.com. Upon receiving such a request, we will take all reasonable steps to permanently delete your data within the statutory period.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the Application or on our website. You are advised to review these Terms periodically for any changes. Your continued use of the Application after the posting of revised Terms means that you accept and agree to the changes.
12. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Warsaw, Poland.
