Academic Intervention Services Regulation

Eligibility for academic intervention services for students in grade three (3) to grade eight (8) will be determined based on a two-step process:


  1. All students performing below the median scale score as identified on the grade 3-8 NYS ELA and Mathematics assessments within their grade and subject per the Commissioner’s Regulations § 100.2 shall be considered for AIS.


  1. Students identified to be considered for AIS pursuant to the first step set forth above, and/or students who do not have a grade 3-8 NYS ELA and Mathematics assessment score, shall receive AIS if they fall within one of the following criteria:


  • Performance below the 30th percentile in the Spring administration of Renaissance STAR assessment in Reading and/or Mathematics from the previous school year.

  • Performance below the 30th percentile in the Fall testing of the current school year in Renaissance STAR Reading and Mathematics.

  • ELL Students rated as either Entering or Emerging on the NYSESLAT.


Eligibility for academic intervention services for all other students will be determined based on a student’s performance on state assessment exams and/or in accordance with the uniformly applied district-developed district-adopted procedures. Eligible students will receive services consistent with law and regulations which shall commence no later than the beginning of the semester following a determination that a student is eligible for such services.


Since the Yorktown Central School District implements a Response to Intervention approach, students whose performance is only slightly higher than the benchmarks identified by the District for receiving AIS will be monitored by their teacher(s) and receive in class support to ensure their growth in accordance with the District’s Response to Intervention Plan.
