Introduction

Welcome to Sale Crumb Trail ("the App"). By downloading, installing, or using this App, you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use the App.

1. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App.

2. Safe Operation & Driver Responsibility

You acknowledge that the App may be used in or near a motor vehicle and you agree to use it responsibly. You are solely responsible for complying with all traffic laws and regulations. Do not interact with the App in any manner that distracts you from the road or creates a safety hazard. Use hands-free features, such as Spoken Address Audio and Voice-to-Text dictation, whenever possible. We are not liable for any accidents, injuries, or property damage resulting from the use or misuse of the App while operating a vehicle.

3. User Content and Ownership

You retain full ownership of all content you create within the App, including but not limited to route trails, crumb markers, notes, and photos. The App does not claim any ownership rights to your content. All user content is stored locally on your device and is not transmitted to us or any third party.

4. Prohibited Uses

You agree not to use the App for any unlawful or prohibited purpose, including but not limited to:

• Attempting to circumvent the free trial period by any means, including the creation of multiple accounts.

• Using the App for any illegal activities or to violate the rights of others.

• Attempting to interfere with, compromise, or disable the App's functionality or security features.

• Using the App in any way that could damage, disable, overburden, or impair the App's performance.

5. Subscriptions and Payments

Free Trial:

The App offers a 14-day free trial period during which you have access to all premium features. The trial is tied to your device and Apple ID to prevent abuse.

Premium Subscriptions:

After the free trial, you may purchase a premium subscription (monthly or yearly) to continue accessing premium features. Subscriptions are managed through the Apple App Store and are subject to Apple's Terms and Conditions.

Auto-Renewal:

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your App Store account settings.

6. Refund Policy

All purchases and subscriptions are processed through the Apple App Store. Refund requests must be submitted directly to Apple. We do not process refunds directly.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, PERSONAL INJURY, OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO USE WHILE OPERATING A MOTOR VEHICLE.

9. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Any changes will be posted within the App, and the "Effective Date" at the top will be updated.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms of Use.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United States.

12.  Apple App Store Requirements 

You acknowledge and agree to the following regarding your use of the App downloaded from the Apple App Store:

• Acknowledgment: This agreement is concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the App and its content. 

• Maintenance and Support: We are solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services. 

• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

 • Product Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

 • Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. 

• Third-Party Beneficiary: Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof.
