Xioverse NFT Terms and Conditions

1. Introduction

Welcome to Xioverse. These Terms and Conditions ("Terms") govern your purchase, ownership, and use of Xioverse NFTs. By acquiring or interacting with a Xioverse NFT, you agree to these Terms.

2. Ownership and License

2.1 No Intellectual Property Transfer

Purchasing a Xioverse NFT does not grant ownership of the underlying intellectual property (IP) or artwork. You receive a limited, non-exclusive, non-sublicensable, non-transferable license for personal and limited commercial use.

2.2 Permitted Uses

• You may display, use, or trade the NFT on blockchain-compatible platforms.

• You may commercialize the NFT for products, content, or services generating up to $500,000 USD in revenue.

2.3 Extended Commercial Use

• If you generate more than $500,000 USD in revenue using a Xioverse NFT, you must obtain an extended license by contacting us at elvis@xioverse.com.

2.4 Restricted Uses

• You may not claim copyright, trademark, or other IP rights over the NFT.

• You may not use the NFT for mass commercial production beyond the $500,000 threshold without permission.

3. Interoperability & Usage

Xioverse NFTs are designed for cross-game integration but will function only within Xioverse-approved channels and platforms. We do not guarantee compatibility with unauthorized platforms or applications.

4. Modifications & Reselling

• You are free to modify or customize the NFT for personal use.

• You may resell the NFT on secondary marketplaces, subject to automatic royalties as described in Section 5.

5. Royalties & Fees

5.1 Secondary Sales Royalties

Xioverse enforces a 10% royalty on all secondary sales, payable via smart contract. This fee is automatically deducted when an NFT is resold.

5.2 Rentals & Platform Fees

• Xioverse retains the right to impose rental fees, including royalties for game developers, on NFTs rented through our platform.

• Fees for upgrades, customizations, or additional services will be determined separately and announced when applicable.

6. Prohibited Uses

You may not use Xioverse NFTs for:

• Hate speech, discrimination, or any form of harassment.

• Fraudulent, misleading, or deceptive activities.

• Any illegal activity under international law.

Xioverse reserves the right to revoke access to its services for users found violating these terms.

7. Disclaimers & Liabilities

• Platform Independence: Xioverse is not liable if a game or platform integrating our NFTs discontinues support. Your NFT remains accessible on blockchain-supported platforms.

8. Jurisdiction & Dispute Resolution

• These Terms shall be governed by the laws of the United Arab Emirates.

• Any disputes shall be resolved through binding arbitration in accordance with international arbitration standards, waiving the right to litigation in court.

9. Amendments & Updates

Xioverse reserves the right to update these Terms. Continued use of Xioverse NFTs constitutes acceptance of any revisions.
