Terms of use and the privacy policy
General
The Willing app (hereinafter: "the app") is owned by the "To Help and Assist" Association (a registered association) (hereinafter: "the association") and is maintained by it and/or on its behalf.
The Terms of Use and Privacy Policy (hereinafter: "Terms of Use") are binding on any person who chooses to visit and/or use the Application (hereinafter: "The visitor") in any way. Access to the Application and use thereof or the information therein constitutes the Visitor's agreement to the Terms of Use.
The Association reserves the exclusive right, and may, at its sole discretion, update and/or change and/or cancel and/or suspend and/or delete the Terms of Use from time to time, in whole or in part, or add to them, without prior notice. Changes to the Terms of Use will enter into force upon their publication in the Application. The Visitor undertakes to comply with any additional restrictions that may be included and/or updated in the Application from time to time. Visiting and/or using the Application after such changes have been made will be deemed as the Visitor's consent to them.
The Terms of Use are written in the masculine gender for convenience and should be seen as referring to both male and female, with the necessary modifications.
Limitation of Liability
All information, content and materials displayed on the App, including, but not limited to, text excerpts, graphics, links, etc. (hereinafter: "the Materials") are provided for the benefit and/or convenience of visitors to the App of their own free choice, and are subject to all laws. In any case of conflict between the provisions of the law and the information on the App, only the provisions of the law will prevail.
All materials are presented in the application As Is and may include errors, inaccuracies, biases, etc. (hereinafter: "Errors in the Materials"). The Association is not responsible for errors in the Materials, and does not warrant or make any representation, express or implied, regarding the correctness, accuracy and completeness of the Materials and/or their suitability or unsuitability for any purpose and/or the identity of the owners of the rights therein and/or third party rights therein and/or that the Materials are free from computer viruses and/or malware and/or other cyber damage.
The Association may, at its sole discretion, change and/or edit the materials, as well as prevent access to the App and/or suspend it and/or discontinue the services provided in the App, in whole or in part, at any time and without notice, and the Association will not be liable for any loss and/or damage and/or malfunction of any kind resulting therefrom, including due to the inability to use the App for any reason whatsoever.
The visitor is aware of the above rule, and accepts sole responsibility for the use of the materials and/or reliance on them. The visitor waives any claim and/or demand and/or claim of any kind, against the association and/or anyone on its behalf, that they should have been aware of errors in the materials and/or any inconsistency as aforesaid, and that they should have refrained from publishing the materials.
It is strictly forbidden to harm and/or violate in any way the copyrights and/or trademarks and/or any other proprietary rights contained in the application. Also, no commercial use of the application may be made without the prior written consent of the association. In addition, it is strictly forbidden to collect information regarding the users of the application, including, but not limited to, selling, distributing and/or making commercial use of the materials and/or any other use in a manner that may harm another person.
The association and/or anyone on its behalf will not be liable for any loss and/or damage and/or malfunction of any kind, if any, arising from the visit and/or use of the application and/or the inability to use it, including, but not limited to, damage caused by the use of software applications downloaded through the application or activated as a result of the use of the application, including Internet applications.
The application and the materials and/or what is implied therein should not be considered professional advice and/or legal and/or other advice and should not be relied upon in any way.
For the avoidance of doubt, the association and/or anyone on its behalf shall not be liable for any claim and/or demand and/or lawsuit of any kind and for any reason whatsoever and/or for any damage, direct or indirect, resulting from the use of the application and/or the materials, including, but not limited to, due to changes made to the information appearing in the application by the visitor and/or any third party.
Links to external sites and content of third parties
The Association may include in the App links to websites and/or apps operated by independent third parties that are not owned and/or controlled by the Association (hereinafter: "the Links", "Third Party Sites"). The use of third-party sites is subject to the terms of use and privacy policy published therein.
The links are intended to facilitate the visitor's browsing and convenience only, and the Association has no responsibility whatsoever for the content displayed on third-party sites and for everything contained therein, including their quality, correctness and safety.
The publication of links in the App should not be seen as sponsorship and/or recommendation and/or preference by the Association for third-party sites and/or their approval, including any content and/or information and/or products displayed therein. To the extent that third-party sites offer products and/or services for sale, the Association is not a party to these transactions and will have no responsibility whatsoever in relation to them.
Use of links and browsing of third-party sites, at the visitor's choice, is done at his sole responsibility and he undertakes to take all possible precautions to avoid damage due to browsing of third-party sites, including damage originating from a computer virus and/or malware and/or other harmful elements.
The association will not bear any responsibility for the links, third-party sites, and anything related to and resulting from them, including, but not limited to, any direct or indirect damage caused to a visitor who chooses to use the links and browse third-party sites. Likewise, the association has no responsibility whatsoever for the privacy rules of third-party sites, to the extent that they exist, and/or for the implementation of these rules and/or for a different privacy protection policy than that existing in the application and/or for a different level of security and a lower level than that existing in the application.
Location-based services and access rights
Some of the App Services are based on access permissions to information transmitted from the Visitor's device, including location permissions and/or wireless connections such as Bluetooth (hereinafter: "Access Permissions"). When installing the App and/or when using the Services, the Visitor must approve access permissions to the App required to provide the Services, otherwise some of the functions will not be available to the Visitor and/or it will not be possible to benefit from receiving services tailored to the Visitor.
It is the Visitor's sole responsibility to ensure that the device on which the App was activated is connected to the access permissions, that location services (GPS) and/or location and/or any other required wireless connection are activated, and that access permissions have been granted, including permission to identify his/her location. It is also the Visitor's sole responsibility to ensure that his/her device and/or cellular phone account are in good working order, in an area with reception, and allow for receiving text messages.
Damage limitation
In no event will the association and/or its employees and managers and/or anyone acting on its behalf and/or any entity related to it be liable to the visitor for any direct and/or indirect and/or consequential damage, financial or non-financial, including, but not limited to, loss of profit and/or reputation and/or information and/or software and/or any information in the visitor's operating system, which may be related in any way to the use of the application and/or due to the inability to use the application and/or any component thereof and/or third-party sites, even if the association and/or the aforementioned entities are aware of the possibility of such damage.
Indemnity
The visitor hereby undertakes to indemnify the association and/or its employees and managers and/or anyone acting on its behalf and/or any entity affiliated with it, for any demand and/or claim and/or damage and/or loss and/or loss of profit and/or payment and/or expense incurred by any of them, directly or indirectly, including attorney's fees and legal expenses, due to a violation of these Terms of Use and/or a violation of the law by the visitor and/or a claim and/or demand from any third party, including, but not limited to, as a result of content provided by the visitor and/or actions, including links, that he has taken.
Privacy Policy
The association respects the privacy of visitors to the app, and the app's privacy protection policy is detailed below. The purpose of the policy is to clarify the association's practices regarding visitor privacy and what is done with the information that the visitor provides and/or is collected by it when using the app.
General
When visiting the App, information about the visitor and/or statistical and aggregate information may be collected, as detailed below and in accordance with the law, including Amendment No. 13 to the Privacy Protection Law, 5741-1981. To the extent that the visitor does not agree to this privacy policy, he or she must refrain from using the App.Registration for services
In order to register for services on the App, the Visitor may be required to provide a number of items of information, including personal information about him, which may include methods of contact with him, e-mail address, credit card details, etc. (hereinafter: "Personal Information"). The Visitor is not legally required to provide personal information and is not required to provide it, however, without providing the requested data, including personal information in the mandatory fields, the Visitor may not be able to register for the App and/or for services that require registration. It should be emphasized that the Visitor must provide only correct, accurate and complete details. By filling in these details, the Visitor confirms their correctness, without detracting from the Association's authority to require the renewal of registration and/or change and/or deletion and/or addition of details at its sole discretion.
To the extent that personal information is required when registering for the App and/or for services on the App, the Visitor will be asked to provide only the information directly necessary for the provision of the services.Information collection
When using the application, information may be collected about the visitor, including, among other things, information about his habits, information and/or advertisements and/or offers and/or services that interested him, the categories he viewed, his location and/or the location of the means of communication through which he connected to the application, and more. It should be emphasized that the visitor provides the association with the information that personally identifies him knowingly and willingly. To the extent that the information collected must be kept in a database within the meaning of the law, the association will act accordingly.Use of information
To the extent that information about the visitor is collected, it will be used only in accordance with this privacy policy and the provisions of any law, and for the following purposes:For the purpose of registering for the application and/or using its services.
Improving and/or enriching and/or changing and/or canceling materials and services in the application.
Purchasing products and services in the application - including publishing information and content.
Adapting the ads that will be displayed when visiting the application to the visitor's areas of interest.
The association will not provide the visitor's personal information to advertisers. However, the association reserves the right to transfer statistical information, including aggregated statistical information, about the visitor and his/her practices to a third party. Statistical information transferred to a third party will not personally identify the visitor.
Visitor rights regarding collected personal information
The visitor may send a request to the email address support@willingapp.com to review his/her stored personal information, and in the appropriate case, to request that the said information be corrected or deleted. It is clarified that such requests do not reflect an absolute right, and that there may be situations in which the association may be entitled or obligated to refuse to provide, correct or delete the requested information, in whole or in part, along with reasons as required by the Privacy Protection Law.Electronic mailing
The Association may occasionally send information regarding the application, as well as marketing and advertising information, by e-mail to the visitor. Such information will be sent to the visitor only after he has given his consent thereto or in accordance with any law. The visitor may at any time revoke his consent to receive such e-mails, and upon his request the Association will cease to do so.Providing information to a third party
The Association will refrain, as far as possible, from transferring information, including the personal information of the visitor and/or information collected about his/her activity in the application, to third parties (insofar as this information and details personally identify the visitor), and will be entitled to do so in the following cases:If the Association receives information about the visitor that is published by him/her on his/her own initiative.
To the extent that the visitor purchases products and services from third parties that offer them for sale through the application, the information that they require for the purpose of the purchase will be transferred to those third parties.
If it is found that the visitor's actions violate the terms of use and/or are contrary to the law and/or constitute fraud and/or constitute an attempt to carry out such actions, the Association will be entitled to provide any information as required.
If a judicial order is received ordering the disclosure of the visitor's details or information about him/her to a third party.
In any dispute and/or claim and/or claim and/or demand and/or in any other legal proceeding if it takes place between the visitor and/or someone on his behalf and the association and/or someone on its behalf.
In any case in which the association believes that providing the information is necessary to prevent damage to a person and/or property of any kind.
If the association sells or transfers in any way the application's activities to any other body and/or merges and/or collaborates with another body and/or their activities merge, provided that this body accepts the provisions of this privacy policy.
Cookies
Cookies may be used in the application for the purpose of efficient and rapid identification of users of the application, for its ongoing and proper operation, for the collection of statistical data, for verification of details, for adaptation to personal preferences, and for information security. The information contained in the cookies is encrypted and the association uses this information with caution so that only it and/or someone on its behalf can read and understand the information contained in them. The visitor gives his permission to the association to use the cookies, as well as to use the information stored in them and to identify the visitor through it. To the extent that the visitor does not agree to the use of cookies, he can avoid this by changing the settings in the browser he uses, and he can also delete the cookies at any time. However, disabling cookies may prevent the visitor from using some of the services in the application.Information security
The Association makes an effort to maintain the confidentiality of the information provided to it by the visitor, while taking information security measures to preserve personal information and protect privacy. Although these measures reduce the risks of unauthorized intrusion into the Association's computers and the application, they do not provide absolute security. Therefore, the Association does not warrant that the application will be completely immune from unauthorized access to the information stored with it and/or in the application.Privacy Policy Changes
In any case where material changes are made to this policy in the provisions concerning the privacy policy and/or the use of personal information provided by the visitor, a notice will be published in the application.
Applicable law and jurisdiction
Any claim filed against the application and/or the association and/or its employees and managers and/or anyone acting on its behalf and/or any entity affiliated with it, in connection with any matter related to the application or arising therefrom, will be determined in accordance with Israeli substantive law, even if the rules of private international law accepted in Israel dictate otherwise.
Any claim filed against the application and/or the association and/or its employees and managers and/or anyone acting on its behalf and/or any entity affiliated with it in connection with any matter related to the application or arising therefrom, will be determined solely in the competent courts whose seat is in Tel Aviv-Yafo only.
