# Terms of Service

## 1. Acceptance of Terms

By downloading, installing, or using the Widgetopia mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other appropriate means. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

## 2. Description of Services

Widgetopia is a social mobile application that allows users to:

- Send photos directly to friends' home screen widgets

- Create and customize widgets, including countdown timers, status displays, mood bubbles, miss-you widgets, and sleep tracking widgets

- Track and share mood entries with friends

- Track sleep patterns using manual input, HealthKit data, or phone interaction patterns

- Connect with friends and share content through widgets

## 3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.

## 4. Account Registration

To use certain features of the App, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

- Provide accurate and complete information during registration

- Maintain the security of your account credentials

- Promptly notify us of any unauthorized use of your account

- Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms.

## 5. User Content

### 5.1 Your Content

You retain ownership of all content you submit, post, or share through the App, including photos, status updates, mood entries, and widget configurations ("User Content"). By submitting User Content, you grant Widgetopia a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App's features to you and the friends you choose to share with.

### 5.2 Content Restrictions

You agree not to submit, post, or share any User Content that:

- Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

- Infringes on any patent, trademark, copyright, trade secret, or other intellectual property or proprietary rights of any party

- Contains sexually explicit material involving minors

- Promotes violence, discrimination, or hatred against any individual or group

- Contains viruses, malware, or any other harmful code

- Impersonates any person or entity, or falsely represents your affiliation with any person or entity

- Violates the privacy or publicity rights of any third party

- Contains unsolicited advertising, spam, or promotional material

### 5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion and without prior notice. We are not obligated to monitor User Content but may do so at our discretion.

## 6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

- Use the App in any way that violates any applicable law or regulation

- Interfere with or disrupt the App, servers, or networks connected to the App

- Attempt to gain unauthorized access to any part of the App, other accounts, or computer systems or networks

- Use the App to transmit any unsolicited or unauthorized advertising or promotional material

- Use any automated means (bots, scrapers, crawlers) to access or interact with the App

- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App

- Remove, alter, or obscure any proprietary notices or labels on the App

- Use the App to harass, bully, stalk, or intimidate any other user

- Create multiple accounts for abusive purposes

## 7. Intellectual Property

### 7.1 Our Property

The App and its original content, features, functionality, design, and branding (excluding User Content) are and will remain the exclusive property of Widgetopia and its licensors. The App is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

### 7.2 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use such feedback for any purpose without obligation to you.

## 8. Third-Party Services

The App integrates with and relies on third-party services, including:

- **Apple services** (Sign in with Apple, HealthKit, Apple Push Notifications, WeatherKit)

- **Google services** (Google Sign-In, Google AdMob)

- **Supabase** (backend infrastructure, database, authentication, file storage)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

## 9. Advertising

The App displays advertisements provided by Google AdMob. By using the App, you acknowledge and agree that:

- Advertisements may be displayed within the App

- Ad content is provided by third-party advertisers and advertising networks

- We are not responsible for the content, accuracy, or availability of advertisements

- Your interactions with advertisements are between you and the advertiser

- Advertising partners may collect certain device and usage information in accordance with our Privacy Policy

## 10. Health Data

If you choose to use sleep tracking features that integrate with Apple HealthKit:

- HealthKit data access requires your explicit permission

- HealthKit data is used solely for sleep tracking features within the App

- HealthKit data is never used for advertising or marketing purposes

- HealthKit data is never shared with third parties

- You can revoke HealthKit access at any time through your device settings

- Use of HealthKit data is subject to Apple's HealthKit guidelines

The App does not provide medical advice. Sleep data and mood tracking features are for informational and personal wellness purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

## 11. Privacy

Your use of the App is also governed by our [Privacy Policy](PRIVACY_POLICY.md), which describes how we collect, use, and share your personal data. By using the App, you consent to our data practices as described in the Privacy Policy.

## 12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

- THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE

- THE RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE

- ANY ERRORS IN THE APP WILL BE CORRECTED

- THE APP WILL BE COMPATIBLE WITH YOUR DEVICE OR OPERATING SYSTEM

## 13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIDGETOPIA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

- YOUR USE OR INABILITY TO USE THE APP

- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP

- ANY USER CONTENT OBTAINED FROM THE APP

- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

## 14. Indemnification

You agree to indemnify, defend, and hold harmless Widgetopia, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

- Your use of the App

- Your User Content

- Your violation of these Terms

- Your violation of any rights of another person or entity

## 15. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied and is accessible through the App in a way that constitutes copyright infringement, please contact us at **justflowapp@gmail.com** with the following information:

- A description of the copyrighted work you claim has been infringed

- A description of where the allegedly infringing material is located in the App

- Your contact information (name, address, phone number, email)

- A statement that you have a good-faith belief that the disputed use is not authorized

- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

- Your physical or electronic signature

## 16. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

- Your right to use the App will immediately cease

- We may delete your account and User Content

- Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

You may terminate your account at any time by deleting it through the App settings.

## 17. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

- These Terms are between you and Widgetopia, not Apple. Widgetopia is solely responsible for the App and its content.

- Apple has no obligation to provide maintenance or support for the App.

- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

- Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection or similar legislation.

- In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Widgetopia, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

## 18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Widgetopia operates, without regard to its conflict of law provisions.

## 19. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction.

## 20. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

## 21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Widgetopia regarding the use of the App and supersede all prior agreements and understandings.
