Welcome to NOAA Weather Radar & Forecast (hereinafter referred to as the "App").
These Terms of Use ("Terms") govern your access to and use of the App. By using the App, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree with any part of these Terms, please stop using the App immediately.

1. Acknowledgment Regarding Apple
You acknowledge and agree that these Terms are concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App, its content, and any services provided through the App.
Your use of the App must also comply with the Apple Media Services Terms and Conditions. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including but not limited to product liability claims or any claim that the App fails to conform to any applicable legal or regulatory requirement. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
2. Eligibility & Age Requirement
You must meet the minimum age requirements established by the applicable app store rating system to use the App.
By using the App, you represent and warrant that you have the legal capacity to enter into these Terms.
If you are under the required age, you may only use the App with the permission and supervision of a parent or legal guardian where required by applicable law.
3. Nature of Service (Weather Information Utility)
3.1 Weather Information Tool
NOAA Weather Radar & Forecast is designed to provide weather information, tropical cyclone tracking, radar visualization, wind information, and official weather alerts.
The App is provided as a utility tool to help users better understand weather conditions and potential risks.
3.2 No Professional Emergency Advice
The App is not affiliated with or operated by the U.S. National Weather Service (NWS). Weather information and alerts provided by the App are for informational and awareness purposes only.
Users should always follow instructions, warnings, evacuation orders, and safety guidance issued by official government authorities and emergency services.
3.3 Data Accuracy and Timeliness
We do not guarantee that the weather maps, tracking data, or alerts processed and displayed through the App are completely accurate or real-time. Official weather alert availability depends on NWS data availability, applicable weather service areas, geographic coverage, and information provided by official weather authorities.
4. Data Privacy & Processing
4.1 Data Minimization
We follow the principle of data minimization and only process information necessary to provide and improve our services. Your precise location may be transmitted to our servers for processing to provide requested location-based features, but we do not retain your precise location after the requested service has been completed. Precise location information is not stored in our server logs and is not included in our analytics events.
4.2 Local Storage
Certain information, such as app preferences, language settings, unit settings, and map preferences, is stored locally on your device to support App functionality. We do not use locally stored settings to identify you personally, and this data is generally removed when you uninstall the App.

5. Intellectual Property
We own all rights, title, and interest in the App, including software, source code, interface design, App features, trademarks, and related technology.
You are granted a limited, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple App Store Terms of Service. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the App without our prior written permission.
6. Prohibited Uses
You agree not to:
- Use the App to violate the rights of others.
- Attempt to bypass any security features.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
- Modify, distribute, or exploit any part of the App without authorization.
- Use the App for unlawful purposes.
7. Third-Party Services
To improve application performance, analyze usage, and maintain application stability, we use third-party services, including:
- Firebase (including Firebase Analytics, Firebase Crashlytics, and Firebase Performance Monitoring).
- ThinkingSDK.
These services may collect limited technical information, such as device information, app crashes, and usage statistics. We do not intentionally send precise location information or sensitive user-provided content through analytics events. Third-party services process information according to their respective privacy policies and service terms.
8. Notifications
The App may request permission to send notifications related to applicable official weather alerts. You may enable or disable notifications at any time through your device settings. If you disable notifications, you can continue using the main features of the App.
9. Changes to These Terms
We reserve the right to modify or update these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of these Terms. Your continued use of the App after changes become effective means that you accept the updated Terms.
10. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms, use the App for unlawful purposes, or attempt to harm or interfere with the App. Upon termination, your right to use the App will immediately end.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND AVAILABILITY.
We do not guarantee that the App will always operate without interruption or that features will meet your specific requirements.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes damages resulting from loss of data, errors in weather reports, or your use or inability to use the App.
13. Governing Law and Dispute Resolution
These Terms shall be governed by applicable laws. Before initiating any formal legal action, you agree to contact us first and attempt to resolve any dispute informally. Nothing in these Terms limits your rights under mandatory consumer protection laws applicable in your jurisdiction.
14. Language Prevailing Clause
These Terms may be translated into languages other than English, including but not limited to Portuguese and Spanish, for your convenience. In the event of any conflict, discrepancy, or inconsistency between the English version and any translated version of these Terms, the English version shall prevail and govern to the maximum extent permitted by applicable law.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to remain in full force and effect.
