By downloading, installing, or using Vizy ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
Vizy is an AI-powered video generation application that allows users to:
- Transform images into videos using artificial intelligence
- Generate videos from text prompts
- Access various AI models for creative content generation
Eligibility
You must be at least 13 years old to use Vizy. By using the App, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent.
Account Registration
You may need to create an account to access certain features. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
AI-Generated Content
Understanding AI Limitations
- AI-generated content may not always be accurate, appropriate, or as expected.
- Results vary based on input quality, complexity, and AI model capabilities.
- AI models are provided by third-party services (fal.ai) and may change over time.
- Generation times and quality are not guaranteed.
Your Responsibilities
You agree NOT to use Vizy to:
- Create illegal, harmful, or dangerous content
- Generate content that infringes on others' intellectual property rights
- Produce deepfakes or misleading content intended to deceive
- Create content depicting minors in inappropriate situations
- Generate content promoting violence, hate speech, or discrimination
- Harass, defame, or harm others
- Violate any applicable laws or regulations
- Circumvent any content moderation or safety measures
Content Ownership
- Your Inputs: You retain ownership of images and prompts you provide.
- Generated Content: You receive a license to use AI-generated videos for personal and commercial purposes, subject to these Terms.
- Restrictions: You may not claim AI-generated content as purely human-created when disclosure is legally required or ethically expected.
Intellectual Property
Our Rights
The App, including its design, features, and underlying technology, is owned by Vizy and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use our trademarks without permission
- Remove any proprietary notices
Third-Party Content
Some AI models and features are provided by third parties. Their respective terms and licenses apply to their services.
Subscriptions and Payments
Pricing
- Subscription plans and credit packages are available through the App.
- Prices are displayed in the App and may vary by region.
- We reserve the right to change prices with notice.
Billing
- Payments are processed through Apple App Store.
- Subscriptions auto-renew unless cancelled before the renewal date.
- Refunds are subject to Apple's refund policies.
Credits
- Credits are used for AI video generation.
- Unused credits from subscriptions do not roll over.
- Purchased credit packs do not expire.
- Credits are non-refundable and non-transferable.
Prohibited Activities
You agree not to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's operation
- Use automated systems (bots, scrapers) without permission
- Resell or redistribute the service
- Abuse free trials or promotional offers
- Share account credentials
Disclaimers
"AS IS" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee
We do not guarantee that:
- The App will be uninterrupted or error-free
- AI-generated content will meet your expectations
- Results will be accurate or suitable for any purpose
- Defects will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIZY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption
- Computer damage or system failure
- Content generated by AI
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
Indemnification
You agree to indemnify and hold harmless Vizy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or share using the App
Termination
By You
You may stop using the App at any time. To delete your account, contact support@vizy.app.
By Us
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in fraudulent activity
- Create harmful content
- Abuse the service
Effect of Termination
Upon termination:
- Your license to use the App ends
- You lose access to your account and credits
- Provisions that should survive will remain in effect
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through:
- In-app notifications
- Email (if provided)
- Updated "Last Updated" date
Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution
Informal Resolution
Before filing a claim, you agree to contact us at support@vizy.app to attempt informal resolution.
Arbitration
Any disputes shall be resolved through binding arbitration rather than court, except for small claims court eligible matters.
Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vizy regarding the App.
