Terms of Use for Vinyl Identifier: Records Scan

Please read these Terms of Use ("Terms") carefully before using Vinyl Identifier: Records Scan ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Description of Service
Vinyl Identifier: Records Scan is a mobile application that uses artificial intelligence to identify vinyl records from photos. The App provides:
- Photo-based vinyl record identification
- Album details including artist, title, year, genre, label, and track list
- Estimated market value based on condition
- Personal collection management
- iCloud sync across devices
- Scan history
3. Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement.
4. Account and Security
4.1 Apple ID
The App uses your Apple ID for iCloud sync functionality. You are responsible for maintaining the confidentiality of your Apple ID credentials.
4.2 Subscription Management
Subscriptions are managed through your Apple ID. You are responsible for managing your subscription settings.
5. Subscription Terms
5.1 Subscription Options
The App offers the following subscription options:
- Weekly subscription with a 3-day free trial
- Yearly subscription
5.2 Free Trial
New users may be eligible for a free trial period. The free trial automatically converts to a paid subscription unless canceled before the trial ends.
5.3 Billing
- Subscriptions are billed through your Apple ID account
- Payment is charged upon confirmation of purchase (or after free trial ends)
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Renewal charges occur within 24 hours before the end of the current period
5.4 Cancellation
You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.
5.5 Price Changes
We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to subsequent billing periods.
6. Acceptable Use
You agree to use the App only for lawful purposes. You shall not:
- Use the App to infringe on intellectual property rights
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App to transmit harmful or malicious content
- Interfere with or disrupt the App's functionality
- Use automated systems or bots to access the App
- Share your subscription with others
7. Intellectual Property
7.1 App Ownership
The App, including its design, features, content, and code, is owned by us and protected by intellectual property laws.
7.2 User Content
You retain ownership of photos you take or upload. By using the App, you grant us a limited license to process your photos for identification purposes.
7.3 Third-Party Content
Album artwork, artist information, and other content displayed in the App may be owned by third parties. Such content is provided for informational purposes only.
8. Disclaimer of Warranties
8.1 "As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.2 Accuracy of Information
We do not guarantee the accuracy, completeness, or reliability of:
- Vinyl record identification results
- Estimated market values
- Album information and details
- Pressing or edition information
8.3 No Professional Advice
The App provides informational assistance only. It is not a substitute for professional appraisal, authentication, or valuation services. Always verify important information through trusted sources.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Any damages arising from your use or inability to use the App
- Any errors or inaccuracies in identification results or valuations
- Any decisions made based on information provided by the App
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
11. Third-Party Services
The App integrates with third-party services including:
- Google Gemini AI for image recognition
- Apple iCloud for data synchronization
- RevenueCat for subscription management
Your use of these services is subject to their respective terms and privacy policies.
12. Modifications to the App
We reserve the right to:
- Modify or discontinue the App at any time
- Change features, functionality, or content
- Update these Terms
Continued use of the App after changes constitutes acceptance of the modified Terms.
13. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
