These Terms of Use (the “Terms”) are a legally binding agreement between you (“you,” “your,” or “User”) and Vimorph (“we,” “us,” “our,” or the “Company”). These Terms govern your access to and use of the Vimorph mobile application (the “App”) and all related services, features, and content provided by the Company (collectively, the “Services”).
By accessing, downloading, installing, or using the Services, you acknowledge that you have read, understood, and agree to be fully bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Services and must immediately cease all use.
We reserve the right to modify, update, or revise these Terms at our sole discretion. We will notify you of material changes through the Services, via email, or by posting the revised Terms within the App. Your continued use of the Services after the effective date of such changes constitutes your acceptance of the revised Terms.
The Services are intended for use by individuals who are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is older. If you are considered a minor under applicable laws, you may use the Services only with the express consent and direct supervision of a parent or legal guardian. By permitting your use, your parent or legal guardian agrees to be bound by these Terms on your behalf.
Vimorph is dedicated to empowering creativity through AI‑powered image and video generation technology. We strive to maintain a safe, respectful, inclusive, and positive community for all users.
You agree to use the Services in compliance with these Terms and all applicable local, national, and international laws, regulations, and industry standards. You must not engage in any activity that disrupts, harms, or impairs the experience of other users or the operation of the Services.
To protect the integrity and safety of our community, you agree NOT to use the Services to create, upload, post, generate, transmit, store, or distribute any content or engage in any conduct that:
Contains or promotes sexually explicit material, nudity, or adult content;
Exploits, endangers, or depicts minors in a harmful, inappropriate, or abusive manner;
Incites, promotes, glorifies, or encourages violence, self‑harm, suicide, cruelty, or injury to any person or animal;
Promotes hate speech, discrimination, harassment, bullying, threats, or harm against individuals or groups based on race, ethnicity, religion, gender, gender identity, sexual orientation, disability, age, or any protected status;
Violates or infringes upon the intellectual property rights, privacy rights, publicity rights, or any other legal rights of third parties;
Constitutes illegal, harmful, deceptive, fraudulent, or infringing activities;
Violates any applicable law, regulation, or court order.
By uploading images, generating content, or submitting materials through the Services, you grant Vimorph the right to review, monitor, scan, and analyze such content for compliance with these Terms. We use automated systems and human moderation to enforce our policies.
We reserve the right, in our sole discretion, to remove, block, or delete any content that violates these Terms. We may also suspend, restrict, or permanently terminate your account for violations. Serious or repeated violations may be reported to law enforcement, regulatory authorities, or affected third parties.
The Services are provided on an “as‑is” and “as‑available” basis. We do not guarantee continuous, uninterrupted, secure, or error‑free operation of the Services. You access and use the Services at your own risk.
You are solely responsible for complying with all laws applicable to your use of the Services. The Services are not designed to comply with industry‑specific regulatory requirements such as HIPAA, FISMA, GLBA, or similar laws. If your use is subject to such regulations, you are prohibited from using the Services.
All intellectual property rights in the Services, including software, code, design, text, graphics, databases, trademarks, logos, and content (collectively, “Our Content”), are the exclusive property of Vimorph or its licensors and are protected by copyright, trademark, and other intellectual property laws worldwide.
Subject to your full compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, non‑sublicensable, and revocable license to access and use the Services for your personal, non‑commercial use only.
You may not copy, reproduce, modify, adapt, reverse engineer, decompile, disassemble, distribute, sell, license, or publicly display any part of the Services or Our Content without our prior written consent.
By submitting feedback, suggestions, ideas, or other materials to Vimorph, you grant us a perpetual, irrevocable, worldwide, royalty‑free, and fully sublicensable license to use, reproduce, modify, publish, and exploit such submissions for any purpose without compensation or credit to you.
You are solely responsible for:
All content you upload, generate, or transmit using the Services;
Ensuring you own or have full legal rights and consent to use all content you submit;
Complying with these Terms and all applicable laws;
Maintaining the confidentiality and security of your account login credentials;
All activities conducted under your account.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Vimorph EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Vimorph AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by the laws of the United States of America and the State of California, without regard to conflict of law rules. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction therein.
