CHAPTER 174: MOTOR VEHICLES, TRAFFIC AND TRANSPORTATION

OPERATION OF MOTOR VEHICLES ON VILLAGE PROPERTY (§§174.01)

§ 174.01. MOTOR VEHICLES PROHIBITED; PENALTY.

(A) Except as otherwise authorized pursuant to division (B) through (E) of this section, no person shall, without permission of the Mayor, President of the Rutland Youth League, or caretaker appointed by the Rutland Youth League, operate a motor vehicle on the grounds of the Sammy “Red” Robinson Baseball Field, except in areas where the operation and parking of motor vehicles is authorized and designated.

(B) A motor vehicle may be operated on the Sammy “Red” Robinson Field by a member of the Rutland Volunteer Fire Department, or any member of an emergency medical rescue service, for the purpose of the health and safety of individuals.

(C) A motor vehicle may be operated on the Sammy “Red” Robinson Field for the purpose of preparing and setting up a lawful fireworks display.

(D) A motor vehicle may be operated on the Sammy “Red” Robinson Field for the purpose of performing general or specific maintenance on the Field.

(E) A motor vehicle may be operated on the Sammy “Red” Robinson Field for other purposes when authorized pursuant to division (A) of this section.

(F) As used in this section, “motor vehicle” has the same definition as provided pursuant to §70.01 of the Municipal Code.

(G) Whoever violates this section shall be guilty of a minor misdemeanor and shall be fined not more than $50.00 in addition to costs assessed by the Mayor’s Court.

(H) As used in this section, “Sammy Red Robinson Field” means, of the Sammy Red Robinson baseball field complex, the baseball diamonds and the area of grass immediately surrounding the baseball diamonds and that section of grass restricted as clearly marked by posted signage. The President of the Rutland Youth League may post signage communicating “NO MOTOR VEHICLES BEYOND THIS POINT PURSUANT TO RUTLAND MUNI. CODE §172.04 - FINE, $50” at the expense of the Rutland Youth League.

PUBLIC ROADS (§§176.02—176.09)

§ 174.02 BRICK STREET CLASSIFIED AS ALLEY.

(A) Brick Street in the Village of Rutland is hereby classified by law as an alley as defined pursuant to R.C. § 4511.01(XX).

(B) Notwithstanding the classification as provided pursuant to this section, Brick Street shall retain its current legal name, “Brick Street”.

(C) In consequence of the classification of Brick Street as an alley, said street shall be subject to all requirements and specifications determined by law for alleys, including the revision of its current posted speed limit from 25 miles per hour to 15 miles per hour.

(D) The Mayor, or his designee, is hereby authorized and directed to cause the erection of signage communicating the revised speed limit of 15 miles per hour in accordance with the Ohio Manual of Uniform Traffic Control Devices.

PARKING (§§176.10—176.19)

§ 174.10 PARKING ON CURB; ROAD VERGE.

(A) No person shall park a motor vehicle with any tires of the same upon a street curb.

(B) No person shall park a motor vehicle with the right hand tire or tires of the same upon the right hand side of the street curb, or upon the road verge.

(C) As used in this section:

(1) “Motor vehicle” has the same definition as provided in § 70.01 of the Municipal Code, or section 4511.01 of the Ohio Revised Code.

(2) “Road verge” means the strip of grass or plants, and sometimes also trees, located between a roadway and a sidewalk.

(D) This section shall not apply when a motorist has been authorized by the Mayor, Street Commissioner or Village Marshal to park his or her motor vehicle contrary to this section.

(E) This section shall not apply to an emergency vehicle as defined pursuant to § 70.01 of the Municipal Code, or section 4511.01 of the Ohio Revised Code, or to a motor vehicle owned and operated by the municipality, or a motor vehicle commandeered and or utilized by the Street Commissioner, when such vehicle is engaged in the maintenance, repair or improvements of streets, sidewalks, signage, stormwater sewers, light posts, banners or flags, or other Village owned assets maintained within the public right-of-way.

(F) Whoever violates division (A) of this section shall be guilty of unlawful parking upon a curb, a minor misdemeanor and shall be fined not more than $25.00.

(G) Whoever violates division (B) of this section shall be guilty of unlawful parking upon a road verge, a minor misdemeanor, and shall be fined not more than $25.00.

§ 174.19 PARKING CITATIONS - PROCEDURE.

(A) Whoever is found in violation of a municipal ordinance, or applicable section of the Municipal Code, regulating the parking of motor vehicles, or prohibiting certain parking acts of the same, he or she may receive an administrative parking citation issued by the Police Department, Street Commissioner, Code Enforcement Officer, Parking Enforcement Officer, or any other municipal official or officer so designated by the Mayor.

(B) Any person receiving an administrative parking citation shall be allotted until the next date on which Mayor’s Court shall convene for a hearing next after the date of the issuance of the same, to remit payment of the fine indicated upon the citation in full to the Mayor or Clerk of Mayor’s Court.

(C) If any person receiving an administrative parking citation desires to contest the parking citation, or the fine thereof, he or she shall appear before the Mayor’s Court and the Clerk of Mayor’s Court shall create a case file for such person and enumerate the same upon the Mayor’s docket. Such person shall be heard by the Mayor’s Court, be informed of their rights and provided an opportunity to waive their rights and enter a plea. Based upon the plea entered, the Mayor’s Court shall lawfully hear and dispose of the parking citation, except that the incarceration of any defendant convicted of a municipal ordinance, or applicable section of the Municipal Code, regulating the parking of motor vehicles, or prohibiting certain parking acts of the same, shall be prohibited.

(D) The Village Marshal may impound a motor vehicle registered to a person who has received four or more parking citations within a twelve month period, or who has failed to remit payment of his or her parking citation.
