ARTICLE II: ARTICLES OF THE VILLAGE COUNCIL
Rule 20. President of Council.
The Mayor shall serve as the President of Council and shall preside at all sessions of the Council, but shall have no vote except in case of a tie. The President Pro Tempore shall have the privilege to vote when presiding in the absence of the Mayor. For the purpose of the Rules of the Council, “presiding officer” shall mean the Mayor, President Pro Tempore, or Interim Chairperson, whoever is present and qualified by the Rules of the Council to preside.
Rule 21. President Pro Tempore of Council.
During each organizational meeting of the Council, the Council shall elect from its number a member to serve as President Pro Tempore, who shall serve until the organizational session of the Council of the following fiscal year next after his election. When the Mayor is absent from the Village, or is unable for any cause to perform his duties, the President Pro Tempore shall become Acting Mayor, and shall have the same powers and perform the same duties as the Mayor. In such a case, the Mayor, when not incapacitated, shall temporarily transfer his powers and duties in written notice to the President Pro Tempore, which shall also state the day and time at which the Mayor shall return to reassume his powers and duties. The President Pro Tempore shall have the privilege to vote when presiding in the absence of the Mayor.
If a member of the Council who is serving as President Pro Tempore of Council resigns effective immediately, or is set to resign before the next regular session of the Council, the Mayor shall order the Council to convene in special session, during which a new member of the Council shall be elected to serve as President Pro Tempore of the Council.
In the case of the absence of the Mayor and the President Pro Tempore of Council when the majority of the members of Council are convened for a regular, special or emergency session, the Clerk of Council shall call the Council to order. The Clerk of Council shall call the roll, and if a quorum is found to be present, the Council shall forthwith move to appoint a member from its number to serve as Interim Chairperson who shall preside until the Mayor or President Pro Tempore of Council reappears. The Interim Chairperson shall not serve as such beyond adjournment of the session.
Rule 22. Clerk of Council.
Except as provided in paragraph (2) of this Rule, the Mayor shall, by and with the advice and consent of the Council, appoint a Clerk of Council, who shall be a resident of the Village. The salary of the Clerk of Council shall be set by the Council by resolution of the same upon appointment or employment. The Clerk of Council shall attend all sessions of the Council, document all proceedings of the Council and all votes and measures of the same, prepare minutes of the Council accurately reflecting its proceedings and referendums, and fulfill all additional duties as prescribed by the Rules of the Council.
In lieu of an appointed or employed Clerk of Council, the Clerk-Fiscal Officer shall serve as the Clerk of Council and execute all powers and duties afforded to the same. In such a case, the Clerk-Fiscal Officer need not be a resident of the Village.
The Clerk of Council shall have no privilege to vote.
Rule 23. Clerk Pro Tempore of Council.
During each organizational meeting of the Council, the Council shall elect from its number a member to serve as Clerk Pro Tempore, who shall serve until the organizational session of the Council of the following fiscal year next after his election. When the Clerk of Council or Clerk-Fiscal Officer is absent from the Village, or is unable for any cause to perform his or her duties, the Clerk Pro Tempore shall perform the same duties as the Clerk of Council.
If a member of the Council who is serving as Clerk Pro Tempore resigns effective immediately, or is set to resign before the next regular session of the Council, the Mayor shall order the Council to convene in special session, during which a new member of the Council shall be elected to serve as Clerk Pro Tempore.
In the case of the absence of the Clerk of Council and Clerk Pro Tempore, the Clerk-Fiscal Officer shall perform the duties of the Clerk of Council. If all three shall be absent, the Mayor shall designate a member of Council to serve as Acting Clerk of Council and execute all powers and duties of the same. Such member of Council shall continue in such role beyond the adjournment of the session.
Rule 24. Sergeant-at-Arms.
The Marshal or such member or members of the Police Department as he may designate, or a county deputy sheriff if designated by the Mayor, shall be Sergeant-at-Arms of all sessions of the Council. He, or they, shall carry out all orders and instructions given by the presiding officer for the purpose of maintaining order and decorum at the meeting of the Council. Upon instructions of the presiding officer, it shall be the duty of the Sergeant-at-Arms, or any designated peace officer present, to remove or place any person who violates the order and decorum of the meeting under arrest, and cause him to be prosecuted under the proper provisions of the Rutland Municipal Code, the complaint to be signed by the presiding officer.
