Please read these Terms of Use ("Terms") carefully before using Vegetable Identifier: Veggie ("the app," "we," "us," or "our"). By downloading, installing, or using the app, you agree to be bound by these Terms.
1. ACCEPTANCE OF TERMS
By accessing or using Vegetable Identifier: Veggie, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
2. DESCRIPTION OF SERVICE
Vegetable Identifier: Veggie is a mobile application that uses artificial intelligence to help you identify vegetables from photos. The app may offer free and paid (Premium or Boost) features. We reserve the right to modify, suspend, or discontinue any part of the service at any time.
3. ELIGIBILITY
You must be at least 13 years of age to use the app. By using the app, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization.
4. USE OF THE APP
You agree to use the app only for lawful purposes and in accordance with these Terms. You may not:
- Use the app in any way that violates applicable laws or regulations
- Use the app to harm, harass, or offend others
- Attempt to reverse engineer, decompile, or extract the app's source code
- Use automated means (bots, scripts) to access the app without our permission
- Resell, sublicense, or commercially exploit the app or its content
- Remove or alter any copyright, trademark, or other proprietary notices
We may suspend or terminate your access if we believe you have violated these Terms.
5. SUBSCRIPTIONS AND PAYMENTS
5.1 Premium and Boost
The app may offer subscription options (e.g., Premium or Boost). Subscription fees are charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your device's App Store subscription settings.
5.2 Refunds
Refund requests are handled by Apple in accordance with Apple's policies. We cannot process refunds directly. Contact Apple Support for billing issues.
5.3 Price changes
We may change subscription prices. Price changes will apply to new subscribers; existing subscribers will be notified in advance where required by law.
6. DISCLAIMERS
6.1 Identification results
The vegetable identification feature is provided for informational and educational purposes only. Results are generated by AI and may not always be accurate. Do not rely on the app for decisions involving health, safety, foraging, or consumption of unknown plants. When in doubt, consult an expert or avoid consumption.
6.2 No professional advice
The app does not provide medical, nutritional, or botanical expert advice. Content in the app (e.g., nutrition information, cooking tips) is for general information only and is not a substitute for professional advice.
6.3 "As is" service
The app and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. INTELLECTUAL PROPERTY
The app, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. "Vegetable Identifier: Veggie" and related names and marks are our trademarks.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the app.
- Our total liability for any claims arising from or related to the app shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD 100), whichever is greater.
- Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.
10. TERMINATION
We may terminate or suspend your access to the app at any time, with or without cause or notice. Upon termination, your right to use the app ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
11. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the jurisdiction in which the app operator resides, without regard to conflict of law principles. Any dispute arising from these Terms or the app shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts. If you are in the European Union or another region with mandatory consumer protection laws, your statutory rights remain unaffected.
12. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or by other reasonable means and updating the "Last updated" date. Your continued use of the app after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the app.
13. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies we make available in the app, constitute the entire agreement between you and us regarding the app and supersede any prior agreements.
