Welcome to Vakee. These Terms of Service ("Terms") are a legally binding contract between you and the Vakee Team ("Vakee," "we," "us"). These Terms govern your access to and use of the Vakee application and any related services (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms, our Privacy Policy, and our Child Safety Policy. If you do not agree to these Terms, you must not access or use our Service.
You must be 18 years of age or older (or the age of legal majority in your jurisdiction) to use Vakee. By creating an account, you represent and warrant that you meet this requirement.
You are responsible for all activity that occurs under your account. You agree to:
Provide accurate information when creating your account.
Maintain the confidentiality of your password and account credentials.
Notify us immediately at help@vakee.live if you suspect any unauthorized access to your account.
Your account is for your personal use only and is non-transferable. You may not sell, lend, or share your account with anyone else.
By creating or maintaining an account, you agree to receive service-related communications necessary to operate and secure your account. These essential communications include account verification, password resets, security alerts, and policy updates. Opting out is not available for service communications while your account is active.
Where permitted by applicable law and based on an appropriate legal basis, by creating an account and agreeing to these Terms you may also receive marketing and promotional communications from us by email. These communications may include product updates, new feature announcements, personalized recommendations, special offers, and other promotional content.
You may opt out of receiving marketing communications at any time by using the channel-specific method provided in the message (for example, an “Unsubscribe” link in marketing emails) or by contacting us at help@vakee.live.
Opting out of marketing communications will not affect service-related communications described in Section 2.3.1 above.
If we offer promotional SMS/text messages in the future or in regions where SMS marketing is available, we will provide opt-out instructions in the SMS message and you can opt out by following those instructions or by contacting help@vakee.live.
Your use of Vakee is conditional on your adherence to our rules. We reserve the right to suspend or terminate accounts that violate these standards.
You agree not to:
Use the Service for any illegal, fraudulent, or harmful purpose.
Harass, bully, intimidate, threaten, or harm another person.
Impersonate any person or entity or create a profile for anyone other than yourself.
Use bots, scripts, scrapers, or other automated means to access the Service or collect data.
Interfere with, disrupt, or place an unreasonable load on the Service or our systems.
Reverse-engineer, decompile, or attempt to extract the source code of our software.
Violate the intellectual property rights of Vakee or any third party.
You may not post, share, or transmit any content that:
Endangers Children: Vakee has a zero-tolerance policy for Child Sexual Abuse Material (CSAM) and any content that exploits, abuses, sexualizes, or endangers minors. This includes any depiction of child nudity, content promoting harm to minors, or attempts to groom or contact minors. Violations will be reported to law enforcement. Is Sexually Explicit or Pornographic: This includes depictions of sexual acts or nudity intended for sexual gratification.
Constitutes Hate Speech: Content that attacks or demeans an individual or group based on race, ethnicity, religion, disability, gender, age, or sexual orientation is forbidden.
Depicts or Promotes Violence: This includes graphic depictions of violence or threats of violence against any person or group.
Is Defamatory or Infringes on Privacy: Do not post content that is libelous, slanderous, or shares someone's private information without their consent.
Contains Viruses or Malicious Code: Any content containing software viruses or other harmful code is prohibited.
You retain ownership of the content (including photos, text, and other materials) that you post on Vakee ("Your Content").
By posting Your Content, you grant Vakee a worldwide, non-exclusive, royalty-free, transferable license to host, use, store, copy, modify, distribute, publish, and process it for the purposes of operating, developing, providing, and improving the Service.
We reserve the right, at our sole discretion, to block or remove any of Your Content that we believe violates these Terms or is otherwise objectionable, without prior notice. Vakee is not a storage service; you are responsible for backing up Your Content.
ALL PURCHASES OF VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE.
For users on Android, all billing, payments, and refunds for subscriptions and in-app purchases are handled exclusively by Google through Google Play. You must submit any request for a refund through Google Play and/or Google support. Vakee cannot issue refunds directly.
If you experience a billing issue or other problem, you can contact our customer support team so we can help investigate the issue and guide you to the appropriate support channel:
In-App: Contact us via the in-app customer support chat
Email: Send details to help@vakee.live with the subject line "Refund Request – [Your Account ID]". Include evidence such as screenshots, transaction records, or error logs to expedite review.
Any refund decisions are made by Google in accordance with Google Play’s policies and processes.
You may terminate this agreement at any time by deleting your account through the in-app settings.
We may suspend or terminate your account at any time and for any reason, including if we believe you have violated these Terms or if your use of the Service poses a risk to us or other users. Where reasonably possible, we will provide you with notice.
Upon termination, your right to use the Service ceases immediately. We may retain or delete Your Content in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, VAKEE DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, VAKEE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL VAKEE'S AGGREGATE LIABILITY EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE AMOUNT YOU PAID VAKEE, IF ANY, IN THE PAST SIX MONTHS.
You agree to indemnify and hold harmless Vakee and its affiliates from any claims, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of the Service or your violation of these Terms.
All intellectual property rights in the Service are owned by Vakee. You may not use our branding, logos, or trademarks without our prior written consent. To report infringement, please contact us at help@vakee.live.
The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.
We may revise these Terms from time to time. The most current version will always be posted on our platform, and if we make a significant change, we will notify you. Your continued use of Vakee after any changes constitutes your acceptance of the new Terms.
