These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for the use of the smartphone application (Package Name: jp.gr.java_conf.tunecode.counter, hereinafter referred to as the "Application") provided by TUNE CODE (hereinafter referred to as the "Provider").
1. The term "Provider" in these Terms refers to TUNE CODE, and the term "User" refers to an individual who uses the Application.
2. By using the Application, the User shall be deemed to have validly agreed to the content of these Terms, and these Terms shall be applicable.
1. The Provider may change these Terms at any time without obtaining the prior consent of the User.
2. If the Provider makes the change set forth in the preceding paragraph, the Provider shall determine the effective date of the revised Terms and shall notify or announce the revised content to the User in advance by posting it within the Application or on the website operated by the Provider, or by any other method deemed appropriate by the Provider.
3. The User shall comply with the revised Terms when using the Application.
1. The copyrights, trademark rights, other intellectual property rights, and any other rights related to the Application shall belong to the Provider or a rightful third party.
2. The User shall not copy, modify, reverse compile, reverse engineer, or otherwise infringe upon intellectual property rights beyond the scope of personal use, without the prior consent of the Provider.
1. The Provider makes no warranty regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the data provided through the Application.
2. The Provider shall endeavor to keep the data as accurate as possible in providing the Application. However, the Provider shall not be liable for any damages incurred by the User or any third party due to the use or inability to use the Application, except in cases of the Provider's willful misconduct or gross negligence.
3. Even if damages arise due to the Provider's willful misconduct or gross negligence, the Provider's liability for damages shall be limited to the total amount of usage fees actually paid by the User for the Application in the one-year period preceding the occurrence of the cause of such damages (or JPY 1,000 if the Application is provided free of charge).
The handling of the User's personal information and privacy information shall comply with the "Privacy Policy" separately established and posted by the Provider within the Application or on its website.
1. The formation, validity, interpretation, and performance of these Terms shall be governed by and construed in accordance with the laws of Japan.
2. If these Terms are prepared in English and a language other than English, in the event of any contradiction or discrepancy between the languages of such Terms, the English language shall prevail in all respects.
3. The District Court having jurisdiction over the Provider's address shall be the court of exclusive agreed jurisdiction in the first instance for the resolution of any disputes arising between the Provider and the User concerning the Application Service or these Terms.
