TERMS OF USE

These Terms of Use ("Terms") govern your use of the Tree Identifier: Wood & Leaf application (the "App") provided by Tilak Apps ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. ELIGIBILITY
You must be at least 13 years old and have the legal capacity to enter into these Terms to use the App. By using the App, you represent that you meet these requirements.
2. LICENSE AND USE
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms. You may not: copy, modify, or distribute the App; reverse engineer or attempt to extract source code; use the App for any illegal purpose; use the App to harass others or violate their rights; or remove any copyright or proprietary notices.
3. IDENTIFICATION RESULTS
The App provides tree and wood identification for informational purposes only. Results are not a substitute for professional advice. We do not guarantee the accuracy, completeness, or suitability of any identification or recommendation. Use identification results at your own risk. We are not liable for any decisions or actions you take based on the App’s output.
4. USER CONTENT
You retain ownership of photos and other content you submit. By submitting content, you grant us a license to use, process, and store it as needed to provide and improve the App (e.g., identification, analytics). You must not submit content that infringes others’ rights or that is illegal, offensive, or harmful.
5. SUBSCRIPTIONS AND PAYMENTS
Premium or Boost subscriptions are billed through your Apple ID. Payment is charged at confirmation. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple account settings. Refunds are subject to Apple’s policies. We may change subscription terms with notice; continued use after changes constitutes acceptance.
6. INTELLECTUAL PROPERTY
The App, including its design, text, graphics, and software, is owned by us or our licensors and is protected by copyright and other laws. "Tree Identifier: Wood & Leaf" and related marks are our trademarks. You may not use our trademarks or branding without our written permission.
7. PRIVACY
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
8. DISCLAIMER
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM PERMITTED BY LAW.
10. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
11. TERMINATION
We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your license to use the App ends. Sections that by their nature should survive (e.g., intellectual property, disclaimer, limitation of liability, indemnification) will survive termination.
12. CHANGES TO TERMS
We may modify these Terms from time to time. We will notify you of material changes by posting updated Terms in the App and/or updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the App.
13. GENERAL
These Terms constitute the entire agreement between you and us regarding the App. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved in the courts of [Your Jurisdiction].
