PRIVACY POLICY FOR TORNADO GALLERY

This Privacy Policy describes how Flockit (“we,” “us,” or “our”) collects, uses, and shares information about you when you use the Tornado Gallery mobile application (the “Services”).
1. INTRODUCTION
Tornado Gallery is designed to operate primarily in local mode. The privacy of your data is our absolute priority. Since the app does not require the creation of an account and does not upload your content to external servers, control of your data remains entirely in your hands.
2. WHAT INFORMATION DO WE COLLECT?
We collect only the information strictly necessary for the operation of the application.
Information You Voluntarily Provide
Communications: If you contact us directly for technical support, we may receive your email address and the content of your message.
Application Data and Permissions
To function properly, the app requires access to certain device features:
Gallery and Storage: Required to select images for encryption and to save encrypted/decrypted images in the destination folders.
Camera: If you choose to take a photo directly from the app to instantly encrypt it.
File Access: Required for automatic deletion of the original file (if selected by the user).
Please note: We do not collect or transmit to our servers the original images, encrypted images, or passphrases used for encryption. The entire process takes place locally on your device.
3. HOW DO WE USE YOUR INFORMATION?
We use the collected information to:
• Provide and maintain the app’s features.
• Manage the encryption and decryption operations requested by the user.
• Troubleshoot technical issues and bugs.
• Ensure the security of the application.
4. LEGAL BASIS FOR PROCESSING
We process your information only when we have a valid legal reason to do so, namely:
Consent: When you explicitly grant us permission to access your gallery or camera through system permissions.
Performance of a Contract: To provide you with the encryption service requested through use of the app.
Legitimate Interests: To improve the stability of the application.
5. SHARING OF INFORMATION
We do not sell or share your personal data with third parties. The only exception concerns compliance with legal obligations or the protection of our rights in the event of legal disputes, although, given that we hold no data about your files on our servers, our ability to provide any such information is practically nil.
6. DATA RETENTION
Local Data: Images and passphrases remain on your device. If you uninstall the app or clear the app’s data, locally stored information (excluding photos saved to the phone’s public storage) may be lost.
Communications: We retain support emails only for as long as necessary to resolve the request.
7. DATA SECURITY
We use advanced encryption protocols to protect your images. However, the security of the passphrase depends entirely on the user. Please be aware that:
• If you lose the encryption passphrase, we will be unable to recover your images.
• No electronic storage system is 100% secure, but Tornado Gallery’s “offline” approach drastically reduces the risk of remote attacks.
8. YOUR PRIVACY RIGHTS
Depending on your geographic location (e.g., GDPR in Europe), you have the right to:
• Access the data we hold about you (primarily your support communications).
• Request the deletion or rectification of your data.
• Revoke gallery or camera access permissions from your device settings at any time.
9. MINORS
Our Services are not directed to persons under the age of 13 (or 16, depending on the jurisdiction). We do not knowingly collect data from minors. If we discover that a minor has provided us with personal data, we will promptly delete it.
10. DO-NOT-TRACK CONTROLS
Since our app does not track web browsing activities and operates locally, Do-Not-Track (DNT) signals do not have a direct impact on the use of the application.
11. DISCLAIMER OF WARRANTIES – “AS IS” SOFTWARE AND LIMITATION OF LIABILITY

11.1 – Software Provided “As Is”
The Tornado Gallery application (the “Software”) is provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement of third-party rights, continuity of service, or freedom from defects. Flockit does not warrant that the Software is error-free, that its operation will be uninterrupted, or that the results obtained through its use will be accurate, reliable, or suited to the user’s specific needs.
11.2 – Full Exclusion of Liability for Improper, Unlawful, or Unauthorized Use
Flockit expressly and entirely disclaims any and all liability, whether direct or indirect, contractual, tortious, civil, criminal, or administrative, arising from or in any way connected to:
(a) any use of the Software inconsistent with the purposes for which it was designed, namely the local encryption and protection of personal images;
(b) any use of the Software in violation of applicable laws and regulations, including but not limited to laws concerning criminal matters, personal data protection, intellectual property, copyright, public order, or national security, under any applicable jurisdiction;
(c) any use of the Software for the purpose of concealing, disguising, or encrypting unlawful material, including by way of example material that infringes third-party rights, child sexual abuse material, material subject to seizure, or material otherwise constituting a criminal offense under applicable law;
(d) any damage, harm, financial or non-financial loss, consequential or incidental loss, direct or indirect, suffered by the user, by third parties, or by any other natural or legal person, as a result of the use, non-use, improper use, or malfunction of the Software;
(e) the irreversible loss of data or encrypted images resulting from the loss, forgetting, or improper use of the encryption passphrase, as such information is held exclusively by and under the responsibility of the user;
(f) any legal, judicial, regulatory, reputational, or financial consequence suffered by the user or third parties, arising directly or indirectly from the use of the Software in any form or manner.
11.3 – Sole Responsibility of the User
The user is solely and exclusively responsible for the use they make of the Software. By accessing and using the application, the user represents and warrants that they do so in full compliance with applicable law and the rights of third parties, assuming sole and full civil and criminal liability for such use. Flockit is not and shall not be liable in any way for consequences arising from use of the Software contrary to law, public order, morality, or the rights of third parties, and may not be joined, sued, or held responsible in connection with such conduct.
11.4 – Indemnification
The user agrees to indemnify, hold harmless, and defend Flockit, its directors, shareholders, employees, contractors, and successors in interest, from and against any claim, complaint, legal action, damage, loss, cost, or expense (including reasonable attorneys’ fees) brought by third parties and arising from the user’s use of the Software in violation of applicable law, this Policy, or the rights of third parties.
11.5 – Limitation of Liability to the Extent Permitted by Law
To the fullest extent permitted by applicable law, in no event shall Flockit be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, or business interruption, even if Flockit has been previously advised of the possibility of such damages.

We may update this Policy periodically to reflect changes in our practices or for legal reasons. We encourage you to review this page regularly. The date of the last update will always be indicated at the beginning of the document.
