1. Definitions

Artist: The individual producing the Commission. ("TheLivelyIre")

Client: The individual purchasing the Commission.

Commission: The form of service provided by the Artist to the Client per the Commission Agreement. “Commission,” “Art[work],” “Image[ry],” and “Project[s]” are used interchangeably herein and in Commission correspondence.

Commission Agreement: The discussion, documented via email or private internet messaging, in which the Artist and the Client agree to the subject matter and type of commission to be produced, the commission Price, the point in time in which the artist is expected to commence the start of work and - if applicable - the commission Deadline. Early termination circumstances, rush fees, Transfer of Copyright, and/or whether or not the Commission can be immediately displayed in the Artist’s portfolio.

2. General Terms

All drawings may or will include a subtle sign that you may not remove.

Client must be 18 years of age, or older.

Client and the Artist must use clear professional language, refraining from profanities and spam (repeated messages sent in short bursts of time).

3. Payment

Currency used is the Euro [€]

Commissions can be paid in full - or if over the price of 200€ - paid in up front split of 50% beforehand and 50% after approval.

4. Process and Delivery

Typical process of completing a commission lasts from 1 week, to up to 2 months. This will be discussed on a case by case basis.

Client will be notified of any potential circumstances that may occur and slow down the process.

Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product - unless specified.

5.  Revisions

First revision is included with the base price,  available for free.

Further revisions  may require additional payment , if  - for example-  the changes being made  do not align  with  originally agreed upon terms or if the references provided are not clear.

There are no revisions if the artist is given no clear direction!

6. Copyright /  Usage
   Artist "TheLivelyIre" retains all the copyright of the Artwork  -unless otherwise stated in the contract -

The Artwork may be used, by the artist, for:

• Self-Promotion

• Portfolio Examples

• Online Sharing on publicly and privately viewable Websites, Forums, Direct Messaging.

The Artwork may be used, by the commissioner, for: 

• Personal use

• Non-commercial Printing

• Sharing the artwork Online 

Examples of copyright infringement:

• Claiming the Artwork as your own.

• Engaging in the re-selling or commercial use of the Artwork, without purchase of the Copyright.

• Using the Artwork as part of a commercial product. For example-  a video game asset.

7. Customer Satisfaction - Refund Policy

Due to the nature of the services offered, there is a chance that, despite Artists best efforts, the Client is not satisfied with the final Project they receive.

The Client must understand that this does not necessitate the need of a refund.

Refunds are only avaiable if the Artist is unable to complete the commission under the specified agreement with the client.
