thehotgames (“thehotgames”) takes the intellectual property rights of others seriously and requires that our Users do the same. As a professional game publisher, all games on the thehotgames website are from game brokers GameDistribution and GameMonetize, follow GameDistribution and GameMonetize's user policies, and own all game copyrights from GameDistribution and GameMonetize.

thehotgames will respond to legitimate requests under the Digital Millennium Copyright Act ("DMCA"), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf. And we retain the right to remove user content on thehotgames that we deem to be infringing on the copyright of others. If you become aware of user content on thehotgames that infringes your copyright rights, you may submit a properly formatted DMCA request (see 17 U.S.C. § 512) to thehotgames.

DMCA Notice of Alleged Infringement ("Notice")

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to thehotgames’s Designated Copyright Agent. Upon receipt of Notice as described below, thehotgames will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site. Please note that if you fail to comply with all of the requirements of this section and of 17 USC § 512(c)(3) your DMCA notice may not be valid.

Procedure for Reporting Copyright Infringement:

If you believe that material or content residing on or accessible through Company’s websites or services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below:

1. A description of the copyrighted work or other intellectual property that you claim has been infringed;

2. A description of where the material that you claim is infringing is located on the Site;

3. An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not thehotgames, can contact you;

4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;

thehotgames may request additional information before removing any allegedly infringing material. In the event thehotgames removes the allegedly infringing materials, thehotgames will immediately notify the person responsible for posting such materials that thehotgames removed or disabled access to the materials. thehotgames may also provide the responsible person with your email address so that the person may respond to your allegations.

DMCA Counter-Notice Requirements

If it is not possible to come to an agreement with the reporting copyright owner, the content owner may submit a DMCA Counter-Notice to ylnrsyb.dev@gmail.com within ten (10) business days of the date of our notice. If we receive a valid counter-complaint, we will email a copy of the notice to the copyright owner. The Counter-Notice is a legal document and must comply with the requirements of the DMCA and must include the following:

Contact Information: Your name, title (if acting as an agent), physical address, email address, and phone number;

Content Identification: A reasonable identification of the material that has been removed or to which access has been blocked;

A statement under Perjury: The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled";

Consent to Jurisdiction: One of the following statements (as appropriate):

If based in the United States: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my provided address is located"

If based outside of the United States: “I consent to the jurisdiction of any United States Federal District Court in which thehotgames may be found"

Consent to service of process: The following statement: “I will accept service of process from the person who provided the original notification or an agent of such person"; and

Signature: An electronic or physical signature of the owner of the copyright or the person authorized to act on the owner's behalf.

thehotgames Policy Regarding Repeat Infringers

thehotgames does not condone or tolerate copyright infringement or any violation of the intellectual property rights of thehotgames or of others. thehotgames reserves the right to terminate the access and/or use privileges of any person who has been determined to be a 'repeat infringer' of the copyrights of thehotgames or others. thehotgames reserves the right to define the criteria by which thehotgames will determine that a person is a 'repeat infringer.' In the event that a repeat infringer is defined by statute, law, or regulation as applicable to 17 USC § 512, thehotgames will adopt that definition as a minimum standard. Without limiting thehotgames’s right to define 'repeat infringer,' as a general rule, thehotgames will define a 'repeat infringer' as any person or entity about whom thehotgames has received two or more DMCA Notices of Alleged Infringement. thehotgames will take into account all relevant facts and circumstances when determining whether or not the termination of access and/or use privileges of a 'repeat infringer' is appropriate.

REGARDLESS OF WHETHER thehotgames TERMINATES ACCESS AND/OR USE PRIVILEGES OF ANY PERSON OR ENTITY, 'REPEAT INFRINGER' OR OTHERWISE, thehotgames IN NO WAY WAIVES ANY RIGHT TO PURSUE ANY AVAILABLE REMEDY AT LAW OR IN EQUITY AGAINST COPYRIGHT INFRINGERS OR ANY OTHER INTELLECTUAL PROPERTY RIGHTS VIOLATORS, NOR WILL thehotgames INDEMNIFY OR PROVIDE LEGAL REPRESENTATION TO ANY ALLEGED INFRINGER IN ANY ACTION ARISING FROM THE ALLEGED INFRINGER’S USE OF ANY INFOTECH WEBSITE OR SERVICE, EXCEPT AS EXPRESSLY DESCRIBED IN THIS NOTICE.
