1. THE SPIRIT OF THE OCEAN
Our Philosophy: Our team lives and breathes the ocean. Whether we are fishing, whale watching, or exploring the lagoon, we genuinely want to show you the best of Aitutaki.
Good Vibes Only: Only come if you are prepared to have FUN! A positive attitude is required to ensure a great experience for everyone onboard.
Nature’s Rules: For Whale Watch & Swim and Lagoon tours, we are guests in a wild environment. Sightings and interactions depend entirely on the animals behavior and nature’s conditions.
Fishing vs. Catching: Remember, it’s called Fishing, not Catching. While our Captain will always try their best, success is never guaranteed.
2. BOOKING & REFUND POLICY
Booking & Payment: A 50% deposit is required to confirm your charter. The remaining balance must be paid 7 days prior to departure.
Departure Policy: There is a no refund policy once the trip has departed.
Early Return: Should a passenger become unwell and request to be returned to the wharf, the Captain will make the final decision regarding the termination of the charter or returning to wharf. There will be NO refund.
No-Catch/No-Sighting: In the event that no fish are caught or no whales are sighted, there will be NO refund, as this is a chance taken on any nature-based trip.
Pre-Trip Cancellations:
8+ Days Notice: Full refund minus a 20% percent fee, less credit-card fees or online payment fees.
72 Hours to 7 Days Notice: 50% refund, less credit-card fees or online payment fees.
Less than 72 Hours / No-Show: No refund issued.
Weather: If the Captain cancels due to unsafe conditions, we will reschedule or you will receive a 100% refund, less credit-card fees or online payment fees.
Travel Insurance: We strongly recommend you have travel insurance to cover any unforeseen personal cancellations or travel delays etc, as our cancellation policy will apply regardless of the reason.
3. FISH & SHARED CATCH POLICY (Fishing Charters)
Ownership: All catch is owned by The Aitutaki Collective.
The Share: We aim to give everyone an opportunity to catch a fish. We will provide you with a fair share of the day's catch (typically enough for a meal per paying participant).
Availability: This is strictly dependent on the day’s catch. We reserve the right to provide no fish if there is not enough caught to distribute.
4. LAGOON & WHALE WATCHING SAFETY
Interactions: All whale swims and lagoon activities are conducted under strict safety guidelines. The Captain’s word is final regarding whether it is safe to enter the water.
Physical Fitness: Guests must be confident swimmers for "Swim with Whales" or snorkeling activities. Please disclose any medical conditions at the time of booking.
5. EQUIPMENT & LIABILITY
Gear Care: We provide high-quality snorkeling gear and fishing tackle. Damage or loss due to negligence will be charged at replacement cost.
Personal Items: Guests participate at their own risk. The Aitutaki Collective is not responsible for personal injury or the loss/damage of personal items (cameras, phones, etc.).
Liability: Guests participate at their own risk. The Aitutaki Collective is not responsible for personal injury.
