Oftentimes it adds just the perfect amount of detail to the outside of the pillow and since I am not a big fan of piping or other more precise/fussy detailed finishes, I love the simple binding finish. It is both simple for us quilters to do and looks good!


The one thing I didn't have was just the right binding - and my friend and co-worker Sharon (hi Sharon!) found just the right black with gold print for a binding. Perfect - except I was 2" short. So I threw-in a little orange patch for personality.

A little over a year ago, the southern part of Louisiana became the target of Hurricane Ida. We evacuated for several days along with this quilt to finish the binding. Returning home to no power or water, we counted our blessings to still have a home.

RE: Classification of Halloween Costumes


Dear Ms. Aldinger:


 Your letter of May 9, 1989, on behalf of the Rite AidCorporation, addressed to our New York office, has been referredto this office for a binding ruling on the classification ofHalloween costumes under the Harmonized Tariff Schedule of theUnited States Annotated (HTSUSA).


FACTS:


 You submitted three costume samples for classification.The first sample, Item # 9930, is a woven nylon multi-coloredclown suit and matching cap, each with pompons of man-madefibers. The second sample, Item # 9926, is a monk costume withan attached hood that is constructed of knit polyester fabric andincludes a cord belt. The third sample, Item # 9928, is askeleton costume and accompanying hood, constructed of wovennylon. The samples are packaged for retail sale.


ISSUE:


 What is the classification of the Halloween costumesunder the HTSUSA?


LAW AND ANALYSIS:


 The General Rules of Interpretation (GRI's) set forththe legal framework in which merchandise is to be classifiedunder the HTSUSA. GRI 1 requires that classification bedetermined first according to the terms of the headings of thetariff and any relative section or chapter notes and, unlessotherwise required, according to the remaining GRI's taken inorder.


 Heading 9505, HTSUSA, provides for festive, carnival,or other entertainment articles. However, Legal Note 1(e) tothis Chapter excludes from this Chapter "fancy dress" of textilesof Chapters 61 or 62. Prior Customs ruling letters haveinterpreted masquerade or party costumes of textile materials tofall within the exclusion of the Legal Note. Halloween costumesare therefore classifiable in either Chapter 61 or Chapter 62 ofSection XI.


 The clown costume and the monk costume are retailpackages containing items that are classifiable under differentheadings. The clown costume package contains a clown suitcovered under Heading 6211, and a clown hat, classified underHeading 6505, each item with pompons, covered under Heading5808. The monk costume package contains a robe, classified underHeading 6114, and a cord belt, classified under Heading 5607.Note 13 of Section XI requires that textile garments of differentheadings be separately classified, even if put up in sets forretail sale. This Note, however, does not prevent singlegarments packaged with other items from being classified assets.


 Each package contains a single garment with other itemsand, consequently, is not within the exclusion of Section Note13. GRI 3 applies when goods are classifiable under two or moreheadings. GRI 3(b) covers goods put up in sets for retail sale.The Explanatory Notes, which represent the officialinterpretation of the HTSUSA at the international level, for GRI3(b) define "goods put up in sets for retail sale." Such goods:(a) consist of at least two different articles that areclassifiable in different headings, (b) consist of products putup together to meet a particular need or carry out a specificactivity, and (c) are put up in a manner suitable for saledirectly to users without repacking. The clown and monkcostumes therefore are sets, the specific activity being theparticipation in Halloween activities.


 GRI 3(b) requires classification of goods put up insets as if they consisted of the component that gives them theiressential character. The Explanatory Notes state that the factordetermining essential character may vary as between differentkinds of goods. The Notes suggest that essential character maybe determined by the nature of a component or material, its bulk,quantity, weight, or value, or by the role of a constituentmaterial in relation to the use of the goods. In each package,the garment imparts the essential character to the set. Thegarment has the greatest bulk, weight, and value, and it providesthe principal costume feature of the set.


 The garments are not identifiable as men's or women'sand therefore are considered women's garments. The design andconstruction of the garments do not permit them to be classifiedunder precise headings and, therefore, the items are classifiableunder "other" categories. The clown costume, constructed ofwoven nylon, is classified under subheading 6211.43.0090, HTSUSA,as other garments, women's or girl's, of man-made fibers, other.The monk costume, being constructed of knitted polyester, isclassified under subheading 6114.30.3070, HTSUSA, other garments,knitted or crocheted, of man-made fibers, other, other, women'sor girl's.


 The final item to be classified is the skeletoncostume. This costume consists of a garment and a hood, both ofwoven nylon. The Explanatory Note 9 to Heading 6505 requiresclassification of detachable hoods with the garments to whichthey belong; consequently, the hood is classified with theskeleton suit. The skeleton costume is classified undersubheading 6211.43.0090, HTSUSA, as other garments, women's orgirl's, of man-made fibers, other.


HOLDING:


 The clown costume, Item # 9930, and the skeletoncostume, Item # 9928, are classified under subheading6211.43.0090, HTSUSA, with a rate of duty of 17 percent advalorem, and fall within textile category 659. The monk costume,Item # 9926, is classified under subheading 6114.30.3070, HTSUSA,with a rate of duty of 16.1 percent ad valorem, and falls withintextile category 659. Garment and clothing accessories enteredas components of sets require separate visas and separatestatistical reporting for quota purposes, pursuant to thedirective of December 23, 1988, from the Committee for theImplementation of Textile Agreements. The textile category forthe clown hat, from subheading 6505.90.6060, HTSUSA, is 659, andthe textile category for the cord belt to the monk's outfit, fromsubheading 5607.50.4000, HTSUSA, is 669.


 Due to the changeable nature of the statisticalannotation (the ninth and tenth digits of the classification) andthe restraint (quota/visa) categories, you should contact yourlocal Customs office prior to importation of this merchandise todetermine the current status of any import restraints orrequirements.

Pal and his team of researchers are using biomass residues such as sawdust, wood residuals and agricultural waste, along with cellulose-based binding materials, to create more sustainable, inexpensive masks for Halloween.

Several companies are interested in commercializing this technology, and researchers like Pal are looking to move the masks up to a large scale where prototypes can be created. With help from potential partners, production can start with lumber companies supplying the sawdust and chemical companies producing the bio-based binding material. Testing could then begin on a product scale before the masks are sold to the general public. A patent is currently pending for the technology.
