Welcome to Scanner & Editor: PDF Tools, formerly known as Text.Picker (the “Application”).
The Application was previously distributed under the name “Text.Picker.” The change to “Scanner & Editor: PDF Tools” is a change of the Application’s name and branding only. References to “Text.Picker” in previous versions of these Terms, purchase records, subscription records, receipts, or related communications refer to the same Application. The name change does not cancel, replace, or otherwise affect any existing subscription, purchase, entitlement, or agreement.
These Terms of Service (“Terms”) govern your access to and use of the Application. In these Terms, “we,” “us,” and “our” refer to the provider of the Application.
By downloading, installing, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, access, or use the Application.
Description of the Service
Scanner & Editor: PDF Tools provides document scanning, PDF editing, signing, file conversion, export, and document management tools. Available functionality may vary by Application version, device, operating system, region, and subscription status.
No Account Required: You are not required to create an account or sign in to use the Application. We do not ask you to provide an account name, account password, or email address to create an Application account.
Local Data: Certain documents, preferences, history records, and other operational data may be stored locally on your device. Some features may require files or related data to be processed using third-party or remote services. Our handling of information is described in our Privacy Policy.
Premium Subscription: The Application offers premium subscription plans (“Subscriptions”) that provide unlimited use of the supported premium features included in the applicable plan, subject to these Terms and any reasonable technical, security, or fair-use restrictions necessary to protect the Application and its services.
Subscriptions, Fees, and Payments
2.1 Subscription Plans
The Application may be downloaded for free and may provide limited access to selected features. You may purchase a Subscription to unlock the supported premium features and use them without the usage limits applied to free users.
Available Subscription plans, prices, billing periods, introductory offers, trials, and included benefits are displayed in the Application before purchase. Prices may vary by country or region and are shown in the currency associated with your App Store account.
2.2 Billing and Payment Processing
All Subscription purchases are processed by the platform through which you obtained the Application, such as Apple’s App Store.
Payment will be charged to your platform account, such as your Apple Account, when your purchase is confirmed. We do not directly collect, view, or store your complete payment card or platform billing credentials.
Your purchase is also subject to the applicable platform’s terms and payment policies.
2.3 Automatic Renewal
Subscriptions automatically renew for the same billing period unless automatic renewal is turned off at least 24 hours before the end of the current subscription period.
Your platform account may be charged for renewal within 24 hours before the end of the current subscription period. The renewal price will be the price shown for your Subscription through the applicable platform, subject to any permitted price changes and notices required by the platform or applicable law.
2.4 Managing or Cancelling a Subscription
You may manage or cancel your Subscription through your platform account settings. For subscriptions purchased through Apple, you can manage your Subscription through your Apple Account or App Store subscription settings.
Deleting the Application does not automatically cancel an active Subscription.
Cancellation takes effect at the end of the current paid billing period unless the applicable platform or law provides otherwise. You will generally retain access to the subscribed features until that period ends.
2.5 Restoring Purchases
If supported, you may restore an eligible Subscription using the same platform account through which it was purchased. Subscription access is associated with the applicable platform account and not with an internal Application account.
The change of the Application’s name from Text.Picker to Scanner & Editor: PDF Tools does not require existing subscribers to purchase a new Subscription.
2.6 Refunds
Payments and refunds are administered by the platform through which the purchase was made. Refund requests must be submitted to that platform and are subject to its refund policies and applicable law. We do not directly approve or process App Store refunds.
License and Acceptable Use
3.1 License Grant
Subject to these Terms, we grant you a personal, revocable, limited, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Application on devices you own or control for personal, lawful purposes.
Your use of an iOS version of the Application must also comply with the Apple Media Services Terms and any applicable App Store usage rules.
3.2 Your Documents
You retain any rights you hold in documents, images, signatures, and other content that you import, scan, create, edit, or process through the Application.
You are responsible for ensuring that you have the necessary rights and permissions to use and process that content. Your use of the Application does not transfer ownership of your content to us.
3.3 Prohibited Conduct
You agree not to:
• Use the Application for an unlawful, fraudulent, infringing, or harmful purpose.
• Upload, process, modify, sign, or distribute content that you do not have the legal right or authorization to use.
• Forge signatures, falsify documents, impersonate another person, or use the Application to facilitate fraud or deception.
• Decompile, reverse engineer, disassemble, modify, or attempt to derive the source code of the Application, except where applicable law expressly permits such activity.
• Circumvent or interfere with Subscription controls, security features, usage restrictions, or access-control mechanisms.
• Use automated systems or excessive requests to disrupt, overload, damage, or impair the Application, its infrastructure, or any related service.
• Introduce malware, malicious code, or other harmful material into the Application or related services.
Intellectual Property Rights
The Application, including its software, interface, design, code, graphics, branding, and underlying technology, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.
Except for the limited license granted under these Terms, no right, title, or interest in the Application is transferred to you. You may not use the names “Scanner & Editor: PDF Tools” or “Text.Picker,” or any associated branding, in a manner that suggests sponsorship, affiliation, or endorsement without permission.
Third-Party Services
The Application may rely on third-party platforms, software development kits, file-processing services, or other service providers. Your use of certain features may therefore be subject to third-party terms and privacy practices.
We are not responsible for third-party services outside our control. However, this provision does not limit any responsibility that cannot legally be excluded.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
WE DISCLAIM, TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APPLICATION WILL ALWAYS BE AVAILABLE, SECURE, UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH EVERY DEVICE OR FILE, OR THAT EVERY SCAN, EDIT, CONVERSION, EXPORT, OR SIGNATURE WILL PRODUCE A PARTICULAR RESULT.
YOU ARE RESPONSIBLE FOR REVIEWING EDITED, CONVERTED, EXPORTED, OR SIGNED DOCUMENTS BEFORE RELYING ON, SHARING, OR SUBMITTING THEM.
Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE, OUR AFFILIATES, AND OUR SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DOCUMENTS, OR DATA ARISING OUT OF OR RELATING TO THE APPLICATION OR THESE TERMS.
Because the Application does not maintain an internal user account system, you are responsible for maintaining appropriate copies or backups of important documents and local Application data. We are not responsible for data lost because of device loss, deletion of the Application, operating-system changes, storage failure, or actions outside supported platform restoration procedures.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE APPLICATION OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APPLICATION OR SUBSCRIPTION DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $50.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Governing Law
These Terms are governed by the laws of the State of Alaska, United States, without regard to its conflict-of-law principles.
Nothing in this section deprives you of any mandatory consumer protection rights that apply under the laws of your country or region of residence.
Changes to the Application or These Terms
We may update, modify, suspend, or discontinue parts of the Application from time to time, including to add features, improve performance, maintain security, comply with legal requirements, or reflect changes to third-party services.
We may also update these Terms. When we do, we will publish the revised Terms and update the “Last updated” date. Where required by law, we will provide additional notice or obtain consent.
Your continued use of the Application after updated Terms take effect constitutes acceptance of those Terms, except where applicable law requires another form of consent.
