These Terms of Use (“Terms”) govern your use of AI Face SwapLab by Berik Jantikov (“Provider,” “we,” or “us”). They are a legal agreement between the user (“you”) and the Provider.
1. Acceptance
By downloading or using the App, you accept and agree to these Terms and our Privacy Policy.
2. Definitions
App: AI Face SwapLab mobile application.
User Content: Images uploaded by you for processing.
Face Data: Facial landmarks and embeddings derived from User Content.
Subscription: Paid access for premium features and unlimited swaps.
3. License and Usage
We grant you a non-exclusive, non-transferable license to use the App for personal and non-commercial purposes.
You agree not to use the App for illegal, harmful, or misleading purposes, including impersonation or deepfake distribution.
By using the application you agree to the following - If we receive a refund request for an in-app purchase from an end user, we reserve the right to provide Apple with information regarding the user's in-app purchase consumption. This includes the following data: app usage time, anonymous account identifier, the total amount spent, and the total amount refunded.
4. User Content & Face Data
You retain all rights to your uploaded photos.
By uploading, you grant us a license to process, temporarily store, and delete them solely to perform face swaps.
We do not access, store, or use photos or face data beyond this purpose.
You are responsible for ensuring your content does not violate the rights of others.
5. Subscriptions & Payment
The App offers:
One free swap per day for free-tier users.
Paid monthly/yearly subscriptions for unlimited high-resolution swaps.
Subscription fees are charged via App Store payment mechanisms.
Subscriptions automatically renew unless cancelled.
6. Account Security
You are responsible for maintaining the confidentiality of your account credentials and ensuring your information is accurate and secure.
7. Termination
Either party may terminate access at any time.
Upon termination, app usage stops and all your transient data is deleted.
8. Disclaimer of Warranties
The App is provided “as is.” We disclaim all warranties and are not liable for disruptions or content accuracy.
9. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the amount paid by you in the past 12 months. We are not liable for indirect or incidental damages.
10. Governing Law
These Terms are governed by the laws of Chile.
11. Miscellaneous
These Terms and the Privacy Policy constitute the entire agreement.
We may suspend services temporarily for maintenance.
