Terms of Use — Forex Sessions: Smart Money

Please read these Terms of Use ("Terms") carefully before using the Forex
Sessions: Smart Money mobile application ("the app", "we", "us", "our"),
published by DueTrack. By downloading, accessing, or using the app, you agree
to be bound by these Terms. If you do not agree, do not use the app.
1. What the app is
Forex Sessions is an educational and utility tool for traders. It provides a
session/kill-zone clock, trading calculators, an economic-calendar view, a daily-bias
checklist, a personal trade journal, and an in-app learning academy of original
lessons on market structure and smart-money concepts.
The app is an information and study aid only. It is not a brokerage, exchange,
trading platform, signal service, robo-advisor, or financial institution, and it
does not execute trades or hold funds.
2. Not financial advice
Nothing in the app constitutes financial, investment, trading, tax, or legal advice,
or a recommendation, solicitation, or offer to buy or sell any currency, security,
commodity, contract, or other instrument.
- The lessons, frameworks (including "smart money" / ICT-style concepts), examples,
and chart diagrams are educational explanations of a way of thinking about
markets — a lens, not a promise. They describe how price *sometimes* behaves;
nothing is guaranteed to happen.
- The calculators show arithmetic based on the values you enter. They do not
tell you what, when, or whether to trade.
- The app provides no trading signals, alerts to buy/sell, or performance
predictions, and makes no representation about profitability.
You are solely responsible for your own trading and financial decisions. Before
making any decision, consider seeking advice from a licensed, independent financial
professional.
3. Trading risk warning
Trading foreign exchange, commodities (including gold), indices, contracts for
difference (CFDs), and cryptocurrencies is highly speculative, carries a high level
of risk, and is not suitable for everyone. You can lose some or all of your
invested capital, and in leveraged trading you may lose more than your initial
deposit.
- Past behavior, examples, or back-tested ideas are not indicative of future
results.
- Only trade with money you can afford to lose.
- Leverage magnifies both gains and losses.
- You accept full responsibility for, and all risk associated with, your trading.
If you do not fully understand these risks, do not trade.
4. Accuracy of data and calculations ("as is")
The app, and all content, prices, calculations, and calendar data in it, are
provided "as is" and "as available", without warranties of any kind, whether
express or implied, including accuracy, reliability, timeliness, completeness, or
fitness for a particular purpose.
- Market prices shown in the app are sourced from third parties, are
indicative only, may be delayed, inaccurate, or unavailable, and must
not be relied upon for order execution or as the official price from your
broker. Always confirm prices on your own trading platform.
- Calculator results are estimates based on the values you enter and on general
market conventions (for example, contract sizes and pip values). These conventions
vary by broker and instrument — always verify the figures against your own
broker before trading.
- Economic-calendar times, forecasts, and figures come from third-party
providers and may be incomplete, rescheduled, revised, or wrong.
We do not warrant that the app will be uninterrupted, error-free, or available at
all times.
5. Limitation of liability
To the maximum extent permitted by applicable law, in no event will DueTrack, its
owners, or contributors be liable for any trading or financial losses, lost
profits, or any indirect, incidental, special, consequential, or punitive damages
arising out of or related to your use of (or inability to use) the app, the data or
calculations within it, or any decision you make in reliance on it — even if advised
of the possibility of such damages.
Your sole and exclusive remedy for dissatisfaction with the app is to stop using it.
6. Subscriptions and payments
The app is free to download and use, with optional auto-renewing "Pro"
subscriptions (e.g. monthly and yearly), which unlock additional features such as
the advanced academy modules, alerts, the trade journal, and bias history.
- All purchases are processed by Apple through your App Store account. We do not
collect or store your payment details.
- Subscriptions auto-renew at the then-current price unless cancelled at least
24 hours before the end of the current period. Your account is charged for renewal
within 24 hours before the period ends.
- Any free trial period (if offered) automatically converts to a paid
subscription unless cancelled before it ends. Unused trial time is forfeited if you
purchase a subscription.
- You can manage or cancel a subscription anytime in your device's
Settings → Apple Account → Subscriptions. Deleting the app does not cancel a
subscription.
- Refunds are handled by Apple under its policies; we cannot issue App Store refunds.
Prices and the features included in Pro may change; any change applies to future
billing periods, not retroactively.
7. Your content and data
Your journal entries, daily-bias records, lesson progress, and preferences are stored
on your device and are not collected by us. You are responsible for your own data
and any backups (e.g. iCloud). See our Privacy Policy for
details. Deleting the app permanently removes this data.
8. Intellectual property
The app and its content — including the lessons, text, chart diagrams, calculators,
designs, logos, and software — are owned by DueTrack and protected by intellectual
property laws. You are granted a personal, non-exclusive, non-transferable,
revocable licence to use the app for your own non-commercial use. You may not copy,
reproduce, redistribute, resell, sublicense, reverse engineer, decompile, or create
derivative works from the app or its content, except as permitted by law.
9. Acceptable use
You agree not to misuse the app, including not to: use it for any unlawful purpose;
interfere with or disrupt it; attempt to gain unauthorized access to it or its
services; or circumvent any security, subscription, or technical limitation.
10. Third-party services
The app retrieves public market data and the economic calendar from third-party
providers (for example gold-api.com, frankfurter.app, Yahoo Finance, and
faireconomy.media / Forex Factory). We do not control these services and are not
responsible for their content, availability, accuracy, or their own terms and privacy
practices.
11. Children
The app is a general-audience educational and financial-utility tool intended for
adults and is not directed at children. Trading is an adults-only activity. Do
not use the app if you are under the age required to enter a binding contract in your
jurisdiction.
12. Changes and availability
We may update, change, suspend, or discontinue the app (or any feature) at any time.
We may also update these Terms; the updated version will be posted here with a new
"Last updated" date, and your continued use after a change means you accept the
revised Terms.
13. Termination
You may stop using the app at any time by deleting it. We may suspend or terminate
your access if you breach these Terms. Sections that by their nature should survive
termination (including Sections 2–5, 8, and 14) will survive.
14. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law
rules, except where mandatory consumer-protection laws of your country of residence
apply. Nothing in these Terms limits any non-waivable statutory rights you may have as
a consumer.
15. App Store terms (Apple)
The app is distributed through Apple's App Store. Your use is also subject to
Apple's Standard End User Licence Agreement (EULA)
(https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) and the App Store
Terms of Service. To the extent of any conflict between those Apple terms and these
Terms regarding the App Store licence, the Apple terms govern. You acknowledge that
Apple is not responsible for the app or its content, that Apple has no obligation
to provide support for it, and that Apple and its subsidiaries are third-party
beneficiaries of these Terms and may enforce them.
