These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hong Kong Youypulian NetworkTechnology Co., Limited (“we”, “us”, or “our”) governing your access to and use of the iOS application DeepPulse (the “App”). By downloading, accessing, or using this App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use this App.

1. Service Description

DeepPulse is a mobile health reference tool designed for iOS users. The App utilizes the device’s camera to capture fingertip optical signal changes to calculate and estimate user heart rate. Users may complete heart rate measurement by placing a finger gently over the device camera lens. All measurement results are for personal daily health reference only.

2. Camera Permission Usage

This App requires camera permission to perform core heart rate detection functions. The camera is only activated when you actively initiate a heart rate test. During detection, the camera captures real-time optical streaming data for local calculation purposes. No photos, videos, or camera recordings are saved or uploaded to any server. You may disable camera permission at any time in your iOS device settings, which will disable the heart rate detection feature.

3. Medical Disclaimer (Critical for App Store Compliance)

DeepPulse is NOT a medical device and does not provide medical diagnosis, medical evaluation, or clinical testing services. All heart rate data, analysis results, and feedback displayed in the App are for general personal wellness reference only and cannot replace professional medical examination, diagnosis, treatment, or advice from licensed medical practitioners or medical institutions.

Heart rate measurements may be affected by lighting conditions, finger stability, device performance, skin condition, and user operation. Test results are approximate and may contain errors. If you experience physical discomfort, arrhythmia symptoms, or any health concerns, please consult a professional medical provider immediately. We assume no responsibility for decisions made based on App measurement data.

4. User Eligibility

You represent and warrant that you are at least 18 years of age or using this App under the supervision and consent of a legal guardian. You agree to use this App in compliance with local laws, Apple App Store policies, and these Terms.

5. Prohibited Activities

You agree not to:

- Reverse engineer, decompile, modify, crack, or attempt to derive the source code or algorithm of the App;

- Misrepresent the App’s measurement results as professional medical test data;

- Use the App for illegal, harmful, infringing, or commercial purposes;

- Interfere with the App’s security, functionality, or server systems;

- Copy, distribute, resell, or lease App functions or content without official written authorization.

6. Intellectual Property Rights

All intellectual property rights in the App, including but not limited to software code, algorithms, interface design, text, graphics, and trademarks, are owned exclusively by Hong Kong Youypulian NetworkTechnology Co., Limited. You are granted a limited, non-transferable, non-commercial, revocable license to use the App for personal wellness purposes only.

7. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms. Please review our Privacy Policy to understand our data collection and processing practices.

8. Service Availability & Modifications

We reserve the right to update, optimize, or adjust App functions at any time. We do not guarantee uninterrupted or error-free service. We may suspend service for maintenance, security updates, or compliance reasons without prior notice.

9. Limitation of Liability

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App, including but not limited to health judgment decisions based on measurement data.

10. Apple Third-Party Beneficiary Clause

You acknowledge that Apple Inc. and its affiliates are third-party beneficiaries of these Terms and may enforce these Terms against you. Apple is not responsible for the App, its content, or any support or maintenance services. All support, maintenance, and liability related to the App is solely the responsibility of Hong Kong Youypulian NetworkTechnology Co., Limited.

11. Revision of Terms

We may update these Terms from time to time. The updated version will be published within the App or on our official website. Continued use of the App after updates constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. Any disputes shall be resolved through friendly negotiation; if negotiation fails, disputes shall be submitted to the competent courts of Hong Kong.
