Terms of Use (EULA)

By downloading or using Nuky Food Scanner ("the App"), you accept these Terms of Use. If you do not accept these terms, do not use the App.
1. License of Use
We grant you a **non-exclusive, non-transferable, revocable** license to use the App for your personal and non-commercial purposes, in accordance with these Terms and Apple's Standard EULA.
2. Premium Subscriptions
2.1 Subscription Plans
Nuka Food Scanner offers premium subscriptions through the Apple App Store:
- **Premium Monthly**: auto-renewing monthly subscription
- **Premium Annual**: auto-renewing annual subscription
2.2 Pricing and Billing
- Prices are displayed in the App and may vary by region
- Payment will be charged to your Apple ID account at confirmation of purchase
- Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- Subscriptions may be managed and auto-renewal turned off in your Apple ID Account Settings after purchase
2.3 Free Trial (if applicable)
- The free trial period starts upon subscription confirmation
- Any unused portion of a free trial period will be forfeited if you purchase a subscription
- Cancel at least 24 hours before the end of the trial to avoid being charged
2.4 Cancellation
- You can cancel your subscription at any time via:
**Settings > Apple ID > Subscriptions > Nuky Food Scanner**
- Cancellation takes effect at the end of the current billing period
- No partial refunds for periods already paid
2.5 Refunds
- All purchases are managed by Apple
- Refunds must be requested directly from Apple at: **https://reportaproblem.apple.com**
- We do not have the authority to issue direct refunds
3. Acceptable Use
You agree NOT to:
- Use the App for illegal purposes
- Attempt to hack, reverse-engineer, or modify the App
- Share your premium account with third parties (except via authorized Apple Family Sharing)
- Submit false, defamatory, or harmful content
- Resell or commercially exploit the App
4. Intellectual Property
The App, including its design, code, logos, and content, is the property of **Yassine [Your Last Name]** and is protected by copyright and intellectual property laws. Food product data may come from third-party sources (such as OpenFoodFacts) and is subject to their own licenses.
5. Disclaimer of Liability
5.1 Information Provided "AS IS"
Information provided by the App (nutrition, ingredients, etc.) is **for informational purposes only** and should not replace professional medical or nutritional advice.
5.2 No Health Warranty
We do not guarantee the accuracy or completeness of nutritional information. Always consult a healthcare professional for medical questions.
5.3 Service Availability
We strive to maintain the App available 24/7, but cannot guarantee uninterrupted service. We are not liable for temporary outages.
6. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount paid by you for the App in the past 12 months
- We are not responsible for third-party content (food databases, etc.)
7. Account Termination
We reserve the right to suspend or terminate your access to the App in case of:
- Violation of these Terms
- Fraudulent or illegal use
- Late payment of subscriptions
8. Changes to Terms
We may modify these Terms. Significant changes will be notified via the App. Continued use after changes constitutes acceptance of the new Terms.
9. Governing Law
These Terms are governed by **Moroccan law**. Any dispute will be settled by the competent courts of Meknès, Morocco, unless local consumer protection law applies.
