TERMS OF USE AND CONDITIONS

These Terms of Use and Conditions govern the use of the Bonacesso application, including access control services through facial recognition. By using the Application, you agree to the terms and conditions described below. If you do not agree with the terms, do not use the Application.

1. Definitions
   1.1 User: Any person who uses the Application to access the services offered.
   1.2 Application: The software made available for mobile devices or other platforms, whose primary function is access control using facial recognition technology.
   1.3 Facial Recognition: Technology used by the Application to verify the User's identity by capturing and analyzing facial images.

2. Collection and Use of Personal Data
   2.1 Collected Data: For the Application to function, we collect facial data and other personal information necessary for facial recognition. This may include facial images, name, email, and other relevant information for creating and maintaining the access account.
   2.2 Use of Data: The personal data collected is used exclusively for the access control service, processed in accordance with our Privacy Policy. These data will not be shared with third parties, except when necessary to comply with legal obligations or when authorized by the User.
   2.3 Data Storage: Facial data will be stored securely, and the User may request the deletion of this data at any time, provided that it does not affect the functionality of the Application.

2.4 Data Retention Period: Facial data will be stored for a period of 1 year from the date of collection, or until the User requests deletion of their data, whichever comes first. This time frame is determined based on the operational needs of the access control service, allowing us to provide accurate and efficient user identification. We do not store facial data indefinitely to ensure privacy and comply with data protection regulations. Once the retention period expires or the data is no longer necessary for the intended purpose, the data will be securely deleted.

3. Consent for Use of Facial Recognition
   3.1 By using the Application, the User explicitly agrees to the collection and processing of their facial image for authentication and access control purposes.
   3.2 The User may revoke their consent at any time, but by doing so, they will lose the ability to use the Application effectively, as facial recognition is the primary method of authentication.

4. User Responsibilities
   4.1 The User is responsible for providing true, complete, and updated information when using the Application. If the provided data is incorrect or outdated, the Application's functionality may be compromised.
   4.2 The User must ensure that the use of the Application and its data is done securely, maintaining the confidentiality of their account and preventing unauthorized access.

5. User Rights
   5.1 The User has the right to access, correct, and delete their personal data at any time, in accordance with privacy policies and applicable legislation.
   5.2 The User may request the removal of their facial data, which will result in the loss of access to the facial recognition-based access control service.

6. Misuse of the Application
   6.1 The User agrees not to use the Application for illegal activities or to violate the privacy rights of other individuals.
   6.2 Any misuse, such as attempts to bypass the facial recognition system or access other users' information without permission, will result in the immediate blocking of the User's account and, if applicable, legal action.

7. Security
   7.1 We implement security measures to protect the collected data, including the use of encryption and other security protocols.
   7.2 However, we cannot guarantee absolute security, and the User acknowledges the risks associated with using technology and storing data on the internet.

8. Changes to the Terms
   8.1 Bonacesso reserves the right to modify these Terms at any time. Changes will be published in the Application and will take effect from the date of their publication. The User will be notified of significant changes.

9. Applicable Legislation
   9.1 These Terms are governed by the laws of the Federative Republic of Brazil, and any disputes will be resolved in the competent courts of this jurisdiction.

10. Privacy Policy
    10.1 The collection and use of the User's personal data are detailed in our Privacy Policy, which must be read and accepted by the User before using the Application.

11. Intellectual Property
    11.1 The intellectual property of the Bonacesso application, including but not limited to its source code, design, logo, trademarks, texts, graphics, and all functionalities associated with the service, is the exclusive property of Doctor247 Desenvolvimento de Software SA. All rights to these creations are protected by applicable copyright and intellectual property laws, both in Brazil and internationally. The User acknowledges that, by using the Application, they do not acquire any rights over Doctor247 Desenvolvimento de Software SA's intellectual property, committing not to reproduce, modify, distribute, or use any protected element without prior written authorization from the company.
