• I work on commissions in order of when they are paid. You can order priority queue/rush if you want your piece to be bumped up/prioritized.

•The final product may be slightly cropped for composition, but I can provide an uncropped version if needed.

• Each piece takes 5-12 hours, reflecting the pricing. Please understand that art is a luxury! Your character’s features may differ from my examples, as everyone is unique. By submitting a request, you acknowledge this, and there are no refunds for dissatisfaction with the style.

#02 [ TIMELINE: ]

• The client submits a commission request

#03 [ COMMUNICATION: ]

• If you do not respond to updates within 48 hours, work will continue

› Missed responses may result in forfeiting revision opportunities

• The artist will communicate frequently with the customer to:

› Inform the customer of the progress of the order.

› Let the customer give their opinion and guide the progress of the order.

› Send WIPs and final pieces.

#04 [ PAYMENTS: ]

✦ All payments are made through PayPal Invoices or through VGen's services.
✦ Client may never initiate a chargeback after the commission has been completed.

✦ Custom proposal: Client submits request form. The artist sends a custom scope, price, and time. The client pays to confirm.

✦ Instant order: The client pays a fixed price to submit the request form. Requests are auto-accepted and confirmed instantly.

✦ Commissions over $200 are available for payment plans.

• All payment plans must be discussed and approved before commissioning

✦ Payment (full price or first instalment) must be made within 48 hours of the proposal being sent

• Failure to pay within this timeframe will result in cancellation unless another arrangement was confirmed in advance

› Please do not submit a request unless you can meet the agreed payment terms.

#04 [ PRIORITY / RUSH FEES / DEADLINES / MERCHANDISE FEES: ]

✦ Waitlists are handled in chronological order. Customers can pay a rush fee on top of the final price to bump themselves up to the front.

• This doesn’t allow them to move ahead of commissions in progress. Once a commission has begun, the artist will do their best to complete it as quickly as possible, with no time constraints.

✦ All Fee pricing will be listed per service as stated:

• Rush fee: Commissions will be prioritized in my commission queue

• Deadlines: Commission must be completed before a certain date

• Vacation fee: Commissions will be worked on the Artist’s time off

#05 [ REVISIONS: ]

✦ A reasonable number of revisions at no extra cost is possible, the notion of reasonable being left to the artist's discretion. The customer can ask for a reasonable number of revisions before the commission is completed.

• Revisions after the art has been delivered are subject to the commission type.

• Up to 3 free revisions per phase are allowed prior to the shading stage

• Revisions apply to major changes (e.g., pose changes, outfit changes)

• Minor detailing requests do not count as revisions

• Revisions requested during the final stage are charged at $10 per revision

• Design-based commissions may receive additional flexibility at the artist’s discretion.

#06 [ REFUNDS: ]

✦ A legal right of retraction exists, but when an order is placed, the customer explicitly renounces this right of retraction so that commission begins immediately.
✦ Client may never initiate a chargeback after the commission has been completed.

• If a commission is cancelled before any work has begun, only the amount paid, excluding the deposit, will be refunded

› Once work has begun, no refunds are offered at any stage

✦ No refunds or cancellations are available for payment plans once initiated

• If a payment plan must be discontinued, the amount already paid will be applied toward alternative artwork or services of your choice, proportional to the value paid

› The scope, type, and timeline of this replacement work will be determined by the artist

#07 [ ART LICENCES: ]

✦ All commissions are for personal use only unless a different license is agreed upon before work begins. Commercial rights are not implied.

• All licenses granted are non-exclusive and non-transferable. Copyright remains with the artist at all times.

#07.1 [✔️PERSONAL ]

✦ Branding: (Profile Pictures/Banners/Schedules/Wallpapers)This includes posting your commission to your social media without promotional value (advertising)

• The Personal Use License allows the client to:

› Use the artwork as profile pictures, banners, headers, and icons

› Post the artwork on social media platforms

› Share the artwork publicly as long as it is not used to promote or sell a product, service, or paid content

• Personal use does not permit:

› Monetised promotion or advertising

› Use behind paywalls

› Digital downloads

› Physical or digital merchandise

› Redistribution, resale, or sublicensing

#07.2 [⚖️MONETIZED ]

✦ Marketing material: (Social Media Promotional Advertising/Digital & Physical Products/ Brand Collaborations & Sponsors/Streaming Platforms)

• This license permits use of the artwork for streaming and monetised online content, including:

› Use during live streams and recorded content

› Use in stream-related assets such as emotes, badges, overlays, panels, alerts, and stream screens

› Posting the artwork on Patreon or other paywall-based community platforms

› Offering the artwork as digital downloads for your community

› Monetised content on platforms such as Twitch, YouTube, and similar services

┃Important Note: Unless explicitly stated otherwise. Most stream-related services (including emotes, badges, overlays, and similar assets) already include this license in their base price.

• Restrictions:

› Artwork may not be resold as a standalone asset

› Artwork may not be sublicensed, transferred, or redistributed

› Physical merchandise use is not permitted under this license

#07.3 [ 💸COMMERCIAL ]

✦ Creation, re-selling, and distribution of value-added or derivative digital or physical end products made with the commissioned asset by the Licensee (CLIENT) with commercial usage granted from Licenser (TARTKATT): (Digital & Physical Merchandise. ]

• This license permits use of the artwork for physical merchandise, including but not limited to:

› T-shirts

› Stickers

› Prints

› Pins, charms, and other tangible goods

• Conditions:

› Must be discussed and approved before commissioning

› Artist credit is required

› Does not transfer ownership or copyright

› Does not allow resale of digital artwork files

┃Disclaimer: For merchandise; I am not responsible for how many orders you are to expect. If you end up selling lower than what you paid for, I do not offer refunds. If you end up selling more than you expected, I do not require you to pay any more merch fees. If you sell 500+ orders and pick the lesser fees, I will then require royalties to be set up with me ASAP.

#08 [ INTELLECTUAL PROPERTY RIGHTS: ]

✦ I reserve the right to post the commissioned work on social media and in my portfolio.

✦ I, the artist, retain full and exclusive copyright to all artwork created. The client may not claim the artwork as their own or use it for any purpose outside the agreed license.

✦ The client is granted a license for use of the artwork. I retain full copyright at all times. This license does not permit use of the artwork in content that promotes or supports discrimination, harassment, or violence against individuals or groups based on gender identity, sexual orientation, race, religion, disability, or other protected characteristics.

✦ If the client is found to be using the artwork in such content, I reserve the right to fully revoke the license.

✦ I reserve the right to decline any commission if I deem myself unable to take it on.

#09 [ AI POLICY & PROHIBITED USE: ]

✦ AI Policy

• AI-generated references may be refused or charged extra for redesign

• I do not draw from AI outputs

• Submitting self-generated AI images may result in blacklisting

• Feeding my artwork into AI systems is strictly prohibited

✦ Prohibited Uses (Unless Explicitly Approved)

• Printed merchandise

• Promotional goods or services

• NFTs (will never be accepted under any circumstances)

✦ You may not:

• Claim the artwork as your own

• Resell or redistribute the artwork

• Alter, trace, or edit the artwork without permission

• Allow third parties to modify the artwork

• Use the artwork for AI training or generation

#10 [ CREDIT: ]

✦ When posting the artwork on social media, streaming platforms, or content creation sites, credit is required, preferably with a direct @ mention.

#11 [ BLACKLISTING: ]

✦ Failure to comply with any part of these Terms of Service may result in:

• Immediate termination of service

• Revocation of usage rights

• Blacklisting from future commissions

✦ In the event of a violation of these Terms of Service, including but not limited to hate speech or discriminatory use, the artist reserves the right to terminate the commission and revoke the license without refund.

✦ You, the client, are getting a license for the work provided by myself. I retain full copyright for the work and CAN revoke license use if the following are found of you engaging in the following:

• Homophobia/transphobia

• Anti-semitism/racism/bigotry

• Abusive/manipulative behavior/blackmail 

• Any other hateful rhetoric

• You will not reflect my work. 

#12 [ Live2D SPECIFICs: ]

✦ Model turnaround: 3-6 months. (can be more when communicated with the client)

✦ At this time, I MAINLY draw ONLY the Art for L2D riggers. 

✦ If you have a rigger, I will work closely with them if they provide their details and consent to do so.

✦ The rigger may edit small things like layer order or the names/situation of folders. Or cut a PNG differently to customize their rig process.

✦ The rigger may NOT heavily edit the OG artwork unless I give permission, or I can change it myself if requested.

✦ The rigger may NOT edit the final appearance of the RIG where it will misrepresent my artwork in any shape or form. (ex, moving the layer order on certain parts to appear where they should not)

✦ I am not responsible for the success of your VTuber career. Refunding/chargeback-ing me because you are not satisfied with your growth is not a valid excuse for a refund. Please spend your money responsibly.
