This End User License Agreement ("EULA") is a binding legal agreement between you (an individual or a single entity, referred to as "User", "You", or "Your") and the developers ("We", "Us", or "Our") that governs your use of the AI Tarot & Oracle Deck Builder mobile application, along with all associated media, printed materials, and electronic documentation (collectively, the "App").
By downloading, installing, accessing, or otherwise using the App, you explicitly agree to be bound by the terms and conditions set forth in this EULA. If you do not agree to the terms of this EULA, you must immediately delete the App from your device and cease all use.
Subject strictly to your continuous compliance with the terms of this EULA, We grant You a personal, revocable, non-exclusive, non-transferable, and limited license to download, install, and use the App solely for your personal, non-commercial purposes on a mobile device that you own or control.
This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
The App and all of its original content, features, functionalities, and underlying technology (including but not limited to source code, algorithms, databases, UI designs, and proprietary graphics) are owned exclusively by Us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
This EULA grants You no rights to use Our trademarks, service marks, logos, or brand names.
The App utilizes advanced Artificial Intelligence (AI) models provided by third parties (including OpenAI and Replicate) to generate tarot cards, oracle decks, and esoteric imagery based on text prompts provided by You.
Due to the evolving legal landscape surrounding AI-generated imagery, We do not claim exclusive copyright ownership over the visual assets you generate using the App. You may use the generated images for personal purposes. If you intend to use the images for commercial purposes (e.g., printing and selling physical tarot decks), You are solely responsible for ensuring that such use complies with local laws regarding AI-generated art.
You agree not to use the App to generate images that are:
Obscene, pornographic, or sexually explicit.
Extremely violent, gory, or depicting self-harm.
Defamatory, discriminatory, or promoting hate speech against any protected group.
Infringing on the copyrights or trademarks of third parties.
We reserve the right to suspend or terminate your access to the App if we determine that you are violating these content guidelines.
The App is designed for entertainment and artistic visualization purposes only. Any interpretations, symbolism, or esoteric meanings generated by the AI do not constitute professional advice (including psychological, medical, legal, or financial advice). We make no guarantees regarding the accuracy or validity of the tarot readings or symbols generated.
The core generation features of the App require an active subscription or the expenditure of purchased in-app credits.
Auto-Renewing Subscriptions: Subscriptions are billed on a weekly, monthly, or yearly basis depending on the plan selected. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Billing: Your App Store or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
Management: You may manage your subscriptions and turn off auto-renewal by navigating to your device's Account Settings after purchase.
Refunds: All purchases and subscription payments are final and non-refundable, except where strictly required by applicable consumer protection laws.
Your use of the App is subject to Our Privacy Policy, which is incorporated by reference into this EULA. By using the App, You consent to the collection, use, and sharing of your data (including text prompts sent to AI providers) as detailed in the Privacy Policy. We respect your privacy and do not collect personal identifiers unnecessarily.
THE APP IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE APP, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) ANY ERRORS OR OMISSIONS IN THE APP'S GENERATION OF IMAGES OR TEXT.
We reserve the right, in our sole discretion, to terminate or suspend your license and access to the App at any time and for any reason, with or without prior notice. Upon termination, all rights granted to You under this EULA will immediately cease, and You must destroy all copies of the App in your possession.
This EULA and your use of the App shall be governed by and construed in accordance with the laws of the jurisdiction in which the developers are established, excluding its conflicts of law rules.
