Privacy Policy

TactThai ("we," "our," or "us") respects your privacy and is committed to protecting it. This Privacy Policy explains how we collect, use, and safeguard your information when you use our mobile application (the "App").

1. Information We Process

When you use TactThai, the following categories of data may be processed:

• Camera and Microphone input: We request access to your device's Camera (for image-based text translation) and Microphone (for voice translation). Captured audio and images are processed in real time solely to provide the translation service.

• Device and purchase identifiers: On Android, we use the identifier provided by the operating system (Android ID). It is sent to our server over an encrypted connection. The server stores a hashed version, a stable code derived from the identifier, to count free translations, check paid access, manage coupons, and prevent allowance resets through clearing data or reinstalling. This is a persistent identifier for the service, so we do not treat it as fully anonymous. It is required for server-based translations and there is no in-app opt-out. A separate random identifier is generated for purchase management through RevenueCat. Android ID is not sent to RevenueCat or the translation providers.

• Anonymous analytics and telemetry data: We collect anonymous, aggregated usage data (such as feature usage, request volumes, and technical metadata) securely through our infrastructure provider, Cloudflare. We use this strictly to improve the App's quality, monitor performance, and enhance your user experience. This data contains no personal identifiers, is not linked to your real-world identity, and is never used for marketing purposes.

• Subscription and purchase data: Information about your subscription status and one-time purchases (active/expired, plan type) is processed through the relevant app store and our subscription-management provider (RevenueCat). Our server verifies purchases and stores the access expiry date. The App also keeps a local copy of access status, as described under "Local Storage".

• App preferences and settings: Stored locally on your device.

We do not request your name, email address, phone number, or other directly identifying information.

2. How We Use Your Information

We use the data above strictly to:

• Provide the translation service (text, voice, image, and menu).

• Manage your subscription, free trial, one-time passes, and usage limits.

• Maintain the security, stability, and quality of the service, and improve the App based on anonymous usage patterns.

3. Third-Party Services and Sub-Processors

To deliver the service, TactThai shares data with the following trusted third-party providers, each of which is governed by its own privacy policy:

• OpenAI - Voice transcription and translation processing.

• Google Cloud AI services - Image, text, and voice translation processing.

• Cloudflare - Server infrastructure, security, and management of usage allowances and paid access. Service requests pass through Cloudflare. Our server stores a code derived from the device identifier, usage counters, and access and purchase records. Translation content is not stored in this access ledger. The infrastructure provider may also record operational details, such as IP addresses and request times, for security and reliability.

• RevenueCat - Subscription and one-time purchase management and entitlement verification.

• Apple App Store / Google Play - Payment processing and store-level account services.

We do not sell, rent, or share your personal data with advertisers or any external entities for marketing purposes.

4. Data Retention

Images and audio are sent for processing to provide translations. Our server does not store them in the access ledger. Retention by processing providers is governed by their policies. The code derived from the device identifier, usage counters, and access and purchase records are stored on our server to operate the service and prevent abuse. There is currently no automatic deletion period for these core records. The in-app deletion button and uninstalling the App do not remove them. Temporary request records are cleaned up separately. Purchase records held by RevenueCat and the app store are also subject to those providers' retention rules.

5. International Data Transfers

Our third-party processors operate globally. By using TactThai, you understand and agree that your data may be processed on servers located outside of Israel, including in the United States and the European Union, in accordance with the applicable safeguards of those providers (such as Standard Contractual Clauses or equivalent legal mechanisms).

6. Security

All communication between the App, our edge proxy, and our third-party providers is encrypted in transit using industry-standard TLS. While no method of transmission over the Internet is 100% secure, we take reasonable technical and organizational measures to protect your data.

7. Children's Privacy

TactThai is not intended for children under the age of 13. We do not knowingly collect or process personal information from children under 13. If you believe a child under 13 has used the App, please contact us immediately so we can take appropriate action. Users between the ages of 13 and 18 (or the age of majority in their country) must obtain the consent of a parent or legal guardian before purchasing a subscription, buying a one-time pass, or using features that require microphone or camera access.

8. Local Storage

Preferences, settings, and a copy of subscription or 14-day pass status are stored on your device. Access is also checked against the server, so local data is not the only record of entitlement. The 14-day pass is a consumable purchase and does not support purchase restoration or transfer to another device. Clearing data, uninstalling the App, or changing devices may result in loss of access to the remaining pass period.

9. Your Rights

You may delete all of your local data at any time by navigating within the App to: Hamburger menu (≡) → "My Account" (החשבון שלי) → "Delete My Data" (מחיקת הנתונים שלי) → Confirm "Delete" (מחיקה).

This action deletes the App's local data, including preferences and its local copy of access status, and attempts to log out the local purchase identifier from RevenueCat. It does not delete the device's Android ID, records on our server, or existing customer and purchase records at RevenueCat and the app store.

Please note:

• Deleting your data within the App does not automatically cancel an active Premium subscription. Active subscriptions must be managed and canceled separately through your account settings in the Apple App Store or Google Play Store.

• Clearing data or uninstalling the App may result in loss of access to the remaining 14-day pass period. The pass does not support restoration or transfer to another device. Refund requests are handled under the app store's refund policy.

For questions about server-held information or to request access or deletion, contact tactthaiapp@gmail.com. The App currently has no self-service option for deleting server records. Some information may need to be retained for fraud prevention, purchase verification, or legal requirements.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our service, technology, or legal requirements. The most recent version will always be available within the App and on this page, with an updated "Last updated" date at the top. Continued use of the App after changes are posted constitutes acceptance of the updated Policy.

Terms of Use

By downloading, installing, or using TactThai (the "App"), you ("you" or "User") agree to be bound by the following Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Age Requirement

You must be at least 13 years old to use TactThai. If you are between the ages of 13 and 18 (or the age of majority in your country), you may use the App only with the consent and supervision of a parent or legal guardian, who must agree to these Terms on your behalf. Children under the age of 13 are not permitted to use the App.

2. Service Description

TactThai is an AI-powered translation tool designed to assist with Hebrew-Thai translation across text, voice, image, and menu modalities. Translations are generated automatically by artificial intelligence and machine learning models and are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied.

3. Artificial Intelligence - Limitations and Critical-Use Warning

TactThai is powered by generative artificial intelligence (AI) systems. By their nature, AI models may produce:

• Inaccurate, incomplete, or out-of-context translations.

• Fabricated content that was not present in the original input (commonly referred to as "hallucinations").

• Inconsistent results between identical or near-identical inputs.
  
  

You must not rely on TactThai's output for any high-stakes purpose, including but not limited to:

• Medical information, food allergens, dietary restrictions, or any health-related decision. If you have a food allergy or medical condition, always verify menu items directly with restaurant staff or a qualified human translator.

• Legal, contractual, or official documents.

• Financial, business, or commercial decisions.

• Emergency, safety-critical, or law-enforcement situations.

In such contexts, please use a qualified human translator or other appropriate professional. We are not responsible for any loss, harm, injury, or damage resulting from reliance on AI-generated output.

4. Subscriptions and Payments

Premium features require an active paid access plan. Payments are processed securely through the relevant app store (Apple App Store or Google Play Store), in accordance with their terms.

• Annual Auto-Renewing Subscriptions: Annual subscriptions automatically renew unless canceled in your device's account settings at least 24 hours before the end of the current billing period.

• Prepaid Subscriptions (1-Month and 2-Month Plans): 1-month and 2-month plans are prepaid subscriptions that do not automatically renew. They are managed through your app store account, remain visible in the store's subscription-management center, and can be restored on devices signed into the same store account. Access expires automatically at the end of the paid period unless renewed.

• 14-Day One-Time Pass ("שבועיים"): The 14-day pass is a one-time consumable purchase, not a subscription. It does not auto-renew or appear in the store's subscription-management center. Access is granted for 14 days after server verification. If a pass is already active, another purchase adds 14 days to its remaining validity. Access status is stored on the server and in a local copy in the App. The pass does not support purchase restoration or transfer to another device. Clearing data, uninstalling the App, resetting or changing devices may result in loss of access to the remaining period. Refund requests are subject to the store's policy. Access begins when the purchase is verified.

• Refunds: Refunds are handled exclusively through the relevant app store, in accordance with its refund policy. We do not directly process refunds.

5. Acceptable Use and Fair Use Limits

You agree not to use the App:

• For any illegal, fraudulent, or unauthorized purpose.

• To translate or process prohibited, harmful, hateful, or malicious content.

• To attempt to reverse-engineer, decompile, scrape, or extract our code, AI models, or proprietary technology.

• To overload, attack, or otherwise interfere with the proper functioning of the App or its underlying services.

Fair Use and Usage Limits:

To ensure service stability and fair availability for all users, TactThai employs automated mechanisms to manage server load. If your usage exceeds reasonable, standard personal use within a specific timeframe, your translation requests may be temporarily limited or throttled (for example, you may receive a temporary limitation or "busy" error). We reserve the right to enforce these limits without disclosing exact numerical thresholds to prevent abuse and protect our infrastructure. Reaching a usage limit is normal under heavy use, is not considered a service defect, and does not entitle you to a refund.

6. Intellectual Property

All content, design, graphics, logos, source code, and proprietary technology within the TactThai App are the exclusive property of Yaakov Tourgeman (TactThai). You may not copy, reverse-engineer, modify, redistribute, or create derivative works of any part of the App without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TactThai, its developer, or its affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or any damages arising from reliance on AI-generated translations.

Our total aggregate liability to you for any and all claims arising out of or relating to the App or these Terms shall not exceed the greater of: (a) the total amount you paid to TactThai through the App in the twelve (12) months preceding the event giving rise to the claim, or (b) twenty US dollars (USD 20).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability shall be limited to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless TactThai, its developer, and its affiliates from any claim, damage, liability, or expense (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any applicable law or third-party right.

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or any applicable law.

You may stop using the App at any time. To delete local data, open the menu (≡), choose "My Account" (החשבון שלי), then "Delete My Data" (מחיקת הנתונים שלי), and confirm "Delete" (מחיקה). This does not delete Android ID or server and purchase-service records.

Deleting data in the App does not cancel an active subscription. Manage and cancel subscriptions separately through your app store account. Clearing data or uninstalling the App may result in loss of access to the remaining 14-day pass period, which does not support restoration or transfer. Server and purchase records may remain as described in the Privacy Policy.

10. Modifications

We reserve the right to modify these Terms, update the App, or adjust subscription and pass pricing at any time. Material changes will be reflected in the "Last updated" date at the top of this document. Continued use of the App after such changes constitutes acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or relating to your use of the App, shall be governed exclusively by the laws of the State of Israel, without regard to its conflict-of-laws principles. The competent courts of Tel Aviv-Jaffa, Israel, shall have exclusive jurisdiction over any such dispute, and you irrevocably submit to that jurisdiction.

The foregoing is without prejudice to any mandatory consumer rights that may apply to you under the laws of your country of residence and that cannot be waived by contract.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TactThai regarding your use of the App, and supersede any prior agreements or understandings, whether written or oral.

מדיניות פרטיות

TactThai ("אנחנו", "שלנו" או "אנו") מכבדת את פרטיותך ומחויבת להגן עליה. מדיניות פרטיות זו מסבירה כיצד אנו אוספים, משתמשים ושומרים על המידע שלך בעת השימוש באפליקציה הסלולרית שלנו ("האפליקציה").

1. מידע שאנו מעבדים

4. שמירת נתונים

תמונות וקטעי שמע נשלחים לעיבוד לצורך התרגום. השרת שלנו אינו שומר אותם במאגר ניהול הגישה. שמירת מידע אצל ספקי העיבוד כפופה למדיניות שלהם. הקוד הנגזר ממזהה המכשיר, מוני השימוש ונתוני הגישה והרכישות נשמרים בשרת כדי לנהל את השירות ולמנוע ניצול לרעה. כיום לא מוגדרת לרשומות העיקריות האלה תקופת מחיקה אוטומטית, והן אינן נמחקות באמצעות כפתור המחיקה באפליקציה או בעקבות הסרתה. רשומות זמניות של בקשות מנוקות בנפרד. נתוני רכישות אצל RevenueCat ובחנות כפופים גם לכללי השמירה של אותם ספקים.

5. העברת נתונים בינלאומית

6. אבטחת מידע

כל התקשורת בין האפליקציה, שרתי הקצה שלנו וספקי הצד השלישי מוצפנת בעת ההעברה באמצעות תקן התעשייה TLS. למרות שאין שיטת שידור באינטרנט שהיא בטוחה ב-100%, אנו נוקטים באמצעים טכניים וארגוניים סבירים כדי להגן על הנתונים שלך.

7. פרטיות קטינים

העדפות, הגדרות ועותק של מצב המינוי או הפס לשבועיים נשמרים במכשיר. מצב הגישה נבדק גם מול השרת, ולכן הנתונים המקומיים אינם העותק היחיד של הזכאות. הפס לשבועיים הוא רכישה חד-פעמית מתכלה ואינו תומך בשחזור רכישות או בהעברת הגישה למכשיר אחר. מחיקת נתונים, הסרת האפליקציה או החלפת מכשיר עלולות לגרום לאובדן הגישה ליתרת הפס.

9. הזכויות שלך

באפשרותך למחוק את כל הנתונים המקומיים שלך בכל עת על ידי ניווט באפליקציה אל: תפריט (☰) ← "החשבון שלי" ← "מחיקת הנתונים שלי" ← אישור "מחיקה".

הפעולה מוחקת את הנתונים המקומיים של האפליקציה, לרבות ההעדפות ועותק מצב הגישה, ומנסה לנתק את מזהה הרכישה המקומי מ-RevenueCat. היא אינה מוחקת את מזהה Android של המכשיר, את הרשומות בשרת שלנו או את היסטוריית הלקוח הקיימת אצל RevenueCat ובחנות.

לשאלות על המידע שנשמר בשרת או לבקשת עיון או מחיקה, ניתן לפנות אלינו בכתובת tactthaiapp@gmail.com. אין כרגע באפליקציה אפשרות למחוק את נתוני השרת באופן עצמאי. ייתכן שנידרש לשמור מידע מסוים לצורך מניעת הונאה, אימות רכישות או עמידה בדרישות הדין.

3. בינה מלאכותית - מגבלות ואזהרת שימוש קריטית

TactThai מופעלת באמצעות מערכות בינה מלאכותית יוצרת (Generative AI). מעצם טבעם, מודלים אלו עשויים לייצר:

• תרגומים לא מדויקים, חסרים או מנותקים מהקשר.

• תוכן מומצא לחלוטין שלא היה קיים בקלט המקורי (תופעה המוכרת כ"הזיות" או Hallucinations).

• תוצאות לא עקביות בין קלטים זהים או כמעט זהים.

חל איסור מוחלט להסתמך על התוצאות של TactThai לכל מטרה הרת גורל או בעלת סיכון גבוה, לרבות אך לא רק:

• מידע רפואי, אלרגנים במזון, הגבלות תזונתיות או כל החלטה הקשורה לבריאות. אם יש לך אלרגיה למזון או מצב רפואי רגיש, עליך לוודא את רכיבי המנה ישירות מול צוות המסעדה או מול מתרגם אנושי מוסמך.

• מסמכים משפטיים, חוזיים או רשמיים.

4. מינויים ותשלומים

פיצ'רים מתקדמים (פרימיום) דורשים מסלול גישה פעיל בתשלום. התשלומים מעובדים בצורה מאובטחת דרך חנות האפליקציות הרלוונטית (Apple App Store או Google Play Store), בהתאם לתנאים שלהן.

• מינויים שנתיים מתחדשים אוטומטית: מינויים שנתיים מתחדשים באופן אוטומטי אלא אם יבוטלו דרך הגדרות החשבון במכשירך לפחות 24 שעות לפני תום תקופת החיוב הנוכחית.

• מינויים מראש (מסלולי חודש וחודשיים): תוכניות של חודש וחודשיים הן מינויים המשולמים מראש ואינם מתחדשים אוטומטית. הם מנוהלים דרך חשבון חנות האפליקציות שלך, נשארים גלויים במרכז ניהול המינויים של החנות, וניתן לשחזר אותם במכשירים המחוברים לאותו חשבון חנות. הגישה פוקעת אוטומטית בסוף התקופה ששולמה אלא אם כן תחודש.

• פס חד-פעמי ל-14 יום ("שבועיים"): הפס לשבועיים הוא רכישה חד-פעמית מתכלה ולא מינוי. הוא אינו מתחדש אוטומטית ואינו מופיע במרכז ניהול המינויים של החנות. לאחר אימות הרכישה בשרת ניתנת גישה ל-14 יום. אם קיים פס פעיל, רכישה נוספת מוסיפה 14 יום לתוקף שנותר. מצב הגישה נשמר בשרת ובעותק מקומי באפליקציה. הפס אינו תומך בשחזור רכישות או בהעברת הגישה למכשיר אחר. מחיקת נתונים, הסרת האפליקציה, איפוס המכשיר או החלפתו עלולים לגרום לאובדן הגישה ליתרת הפס. בקשות להחזר כפופות למדיניות החנות. הגישה לשירות מתחילה עם אימות הרכישה.

• החזרים כספיים: החזרים מטופלים אך ורק דרך חנות האפליקציות הרלוונטית, בהתאם למדיניות ההחזרים שלה. איננו מעבדים החזרים כספיים באופן ישיר.

5. שימוש מקובל ומגבלות שימוש סביר

אתה מסכים לא להשתמש באפליקציה:

• לכל מטרה בלתי חוקית, הונאה או פעולה שאינה מורשית.

• כדי לתרגם או לעבד תוכן אסור, פוגעני, מסית או זדוני.

• במטרה לנסות לבצע הנדסה לאחור (Reverse Engineering), פירוק קוד (Decompiling), כריית נתונים (Scraping) או חילוץ של הקוד, מודלי ה-AI או הטכנולוגיה הקניינית שלנו.

• כדי להעמיס, לתקוף או להפריע בכל דרך אחרת לתפקוד התקין של האפליקציה או של תשתיות השירות שלה.

שימוש סביר ומגבלות שימוש:

כדי להבטיח יציבות שירות וזמינות הוגנת לכלל המשתמשים, TactThai מפעילה מנגנונים אוטומטיים לניהול עומסי שרת. אם השימוש שלך חורג משימוש אישי סביר וסטנדרטי בפרק זמן מסוים, ייתכן שבקשות התרגום שלך יוגבלו או יושהו זמנית (לדוגמה, ייתכן שתקבל הודעת הגבלה זמנית או שגיאת מערכת עסוקה). אנו שומרים לעצמנו את הזכות לאכוף מגבלות אלו מבלי לחשוף את הרף המספרי המדויק, וזאת כדי למנוע ניצול לרעה ולהגן על התשתית שלנו. הגעה למגבלת שימוש היא מצב תקין בזמני עומס כבד, אינה נחשבת לפגם בשירות ואינה מזכה אותך בהחזר כספי.

6. קניין רוחני

כל התוכן, העיצוב, הגרפיקה, סמלי הלוגו, קוד המקור והטכנולוגיה הקניינית בתוך אפליקציית TactThai הם רכושו הבלעדי של יעקב תורג'מן (TactThai). אינך רשאי להעתיק, לבצע הנדסה לאחור, לשנות, להפיץ מחדש או ליצור יצירות נגזרות מכל חלק של האפליקציה ללא הסכמתנו מראש ובכתב.

7. הגבלת אחריות

במידה המרבית המותרת על פי החוק, בשום מקרה TactThai, המפתח שלה או שותפיה לא יהיו אחראים לנזקים עקיפים, מקריים, תוצאתיים, מיוחדים, לדוגמה או עונשיים, לרבות אך לא רק אובדן רווחים, אובדן נתונים, פגיעה בהזדמנויות עסקיות, פגיעה במוניטין או כל נזק הנובע מהסתמכות על תרגומים שנוצרו על ידי בינה מלאכותית.

החבות הכוללת והמצטברת שלנו כלפיך בגין כל התביעות הנובעות או הקשורות לאפליקציה או לתנאים אלו, לא תעלה על הסכום הגבוה מבין השניים: (א) הסכום הכולל ששילמת ל-TactThai דרך האפליקציה ב-12 החודשים שקדמו לאירוע שהקים את עילת התביעה, או (ב) עשרים דולר ארה"ב (20 USD).

תחומי שיפוט מסוימים אינם מתירים החרגה או הגבלה של נזקים מסוימים; במקרים כאלה, חבותנו תוגבל למידה המרבית המותרת על פי חוק.

8. שיפוי

אתה מסכים לשפות ולפטור מאחריות את TactThai, המפתח שלה ושותפיה מכל תביעה, נזק, חבות או הוצאה (לרבות שכר טרחת עורכי דין סביר) הנובעים משימוש לרעה שלך באפליקציה, מהפרת תנאים אלו, או מהפרת כל חוק ישים או זכות של צד שלישי על ידך.

9. סיום התקשרות

אנו רשאים להשעות או להפסיק את גישתך לאפליקציה בכל עת, עם או ללא הודעה מוקדמת, אם אנו סבורים באופן סביר שהפרת תנאים אלו או כל חוק ישים.

באפשרותך להפסיק להשתמש באפליקציה בכל עת. למחיקת הנתונים המקומיים, פתח את התפריט (☰), בחר "החשבון שלי", אחר כך "מחיקת הנתונים שלי" ואשר "מחיקה". פעולה זו אינה מוחקת את מזהה Android או את הרשומות בשרת ובשירותי הרכישה.

מחיקת הנתונים באפליקציה אינה מבטלת מינוי פעיל. יש לנהל ולבטל מינויים בנפרד דרך חשבון החנות. מחיקת נתונים או הסרת האפליקציה עלולות לגרום לאובדן הגישה ליתרת הפס לשבועיים, שאינו תומך בשחזור או בהעברה. נתוני שרת ורכישות עשויים להישאר כמפורט במדיניות הפרטיות.

10. שינויים בתנאים

אנו שומרים לעצמנו את הזכות לשנות תנאים אלו, לעדכן את האפליקציה או להתאים את תמחור המינויים והפסים בכל עת. המשך שימוש באפליקציה לאחר שינויים כאלה מהווה הסכמה מלאה לתנאים המעודכנים.

11. הדין החל וסמכות שיפוט

תנאים אלו, וכל סכסוך הנובע או קשור לשימוש שלך באפליקציה, יהיו כפופים בלעדית לחוקי מדינת ישראל, מבלי להתחשב בכללי ברירת הדין שלה. לבתי המשפט המוסמכים בתל אביב-יפו, ישראל, תהיה סמכות שיפוט בלעדית על כל סכסוך כזה, ואתה מסכים באופן בלתי חוזר לסמכות שיפוט זו.

האמור לעיל אינו פוגע בכל זכות צרכנית קוגנטית שעשויה לחול עליך על פי חוקי מדינת תושבותך ושלא ניתן לוותר עליה בחוזה.

12. הפרדת סעיפים

אם הוראה כלשהי מתנאים אלו תיקבע כלא חוקית או בלתי ניתנת לאכיפה על ידי בית משפט מוסמך, הוראה זו תשונה או תוסר למידה המינימלית הנדרשת, ושאר ההוראות יישארו בתוקף מלא.

13. ההסכם המלא

תנאים אלו, יחד עם מדיניות הפרטיות, מהווים את ההסכם המלא והבלעדי בינך לבין TactThai בנוגע לשימוש שלך באפליקציה, ומחליפים כל הסכם או הבנה קודמים, בין אם בכתב ובין אם בעל פה.
