BVE利用規約

＝Syokubeni21のBVEデータをダウンロードいただきありがとうございます。＝

この規約ではデータの"共通の"取り扱いについて定めています。必ずお読みください。

各データにおけるクレジットや個別の扱い方法については"ReadMe"に記載しておりますので、あわせてお読みください。

前提

・これより先では、下の語句は次のように記載する。

　車両データ、シナリオデータなどの関連するデータ＝BVEファイル

　@syokubeni21、その他関連人物＝制作者

　このBVEファイルをダウンロードし、使用する者＝使用者

　この規約（"必ずお読みください"）＝本規約

・万が一、本規約と矛盾する内容がほかで定められている場合、本規約を優先し適用する。

・制作者は本規約を改定することがある。その場合、改定1週間前に配布ページ等で予告を行う。改定された規約に同意できない場合は、BVEデータの使用を中止すること。

1. BVEファイルの扱い方

・使用者は制作者が作成したBVEファイルを無償でダウンロードし、使用することができる。

・使用者はBVEファイルの一切の内容を転載してはならない。

・BVEファイルを不特定多数に再配布してはならない。（一部または全部を改変した場合も含む）

・制作者は、このBVEファイルをダウンロードしたことにより発生した損害等の責任を一切負わない。

2. BVEファイルの商用利用について

・使用者はBVEファイルを商用利用できる。（収益化されたYouTubeチャンネル等も含む）ただし、以下の要件に従うこと。

　・概要欄や動画内、ページ内など、閲覧者の目に触れる場所に

　　「BVEデータ：@syokubeni21」を必ず記載する。

　・企業組織等で利用する場合は下記連絡先まで問い合わせること。

　　（個人のYouTubeの場合：連絡の必要はありません）

　・危険運転や常識を逸脱した行為をおこなった内容の公開は禁止。

　・政治、宗教関連組織での使用禁止。

　　（YouTubeチャンネルの場合：個人チャンネルは可能）

　・BVEファイルに組み込まれているプラグイン、その他素材に関する規約を確認し、

　　それに従うこと。（詳しくは "ReadMe" で確認）

　・BVEデータに一切の改変が加えられていないこと。

　　（ただし、指定車両の変更は可能とする）

　・BVEファイルの使用により使用者に発生した損害や責任を制作者は負わないことを理解する

3. 準拠法および管轄

・本規約の解釈、適用については日本国の法律に準拠するものとします。

・本規約またはBVEファイルに関連して生じる一切の紛争については、日本国の名古屋地方裁判所または制作者の指定する裁判所を第一審の専属的合意管轄裁判所とします。

借用したプラグイン、ストラクチャなどを除きすべての権利を@syokubeni21が保有しています。

なお、日本国を準拠法とします。

このBVEファイルに関してのすべての責任は制作者にあります。関連団体、企業等への問い合わせはお控えください。

= Thank you for downloading BVE data by Syokubeni21. =

This document outlines the common terms for handling the data. Please read it carefully.

Specific credits and usage rules for each data set are written in the included "ReadMe" file. Be sure to read that as well.

Prerequisites

・In this document, the following terms are defined as:

　Vehicle, scenario, and related data = BVE files  

　@syokubeni21 and related persons = Creator  

　Those who download and use this BVE file = User  

　This agreement ("Please read this carefully") = These Terms  

・If there is any conflict between these Terms and other documents, these Terms shall take precedence.

・The Creator may revise these Terms. If revised, notice will be posted on the distribution page at least one week in advance.  

　If you do not agree with the revised Terms, please discontinue use of the BVE data.

1. Handling of BVE Files

・Users may download and use BVE files created by the Creator free of charge.

・Users may not reprint any part of the BVE files.

・Users may not redistribute BVE files to an unspecified number of people. (This includes modified versions.)

・The Creator shall not be liable for any damage arising from the download or use of the BVE files.

2. Commercial Use of BVE Files

・Users are allowed to use BVE files for commercial purposes (including monetized YouTube channels), under the following conditions:

　・Credit must be clearly displayed as:  

　　“BVE Data: @syokubeni21”, in the description, in the video, or on a visible part of the page.

　・For use by companies or organizations, please contact us using the contact information below.  

　　(No contact is necessary for personal YouTube use.)

　・Content involving reckless driving or highly inappropriate behavior is prohibited.

　・Use by political or religious organizations is prohibited.  

　　(Personal YouTube channels are allowed.)

　・Be sure to check and comply with the licenses of any plugins or materials included in the BVE files.  

　　(Details are listed in the "ReadMe" file.)

　・No modifications may be made to the BVE files.  

　　(However, changing the specified train is permitted.)

　・Users understand and agree that the Creator assumes no liability for any damage or consequences arising from the use of the BVE files.

3. Governing Law and Jurisdiction

・These Terms shall be governed by and construed in accordance with the laws of Japan.

・Any disputes arising out of or in connection with these Terms or the BVE files shall be submitted to the exclusive jurisdiction of the Nagoya District Court of Japan or another court designated by the Creator as the court of first instance.

All rights (excluding borrowed plugins or structures) are held by @syokubeni21.  

These Terms are governed under the laws of Japan.

The Creator bears full responsibility for the BVE files.  

Please refrain from contacting related organizations or companies.

Please use the BVE files in accordance with the above rules.
