Terms and Conditions — Symptom Tracker App

These Terms of Agreement, including the End User License Agreement ("Terms"), govern your use of the Symptom Log – Symptom Tracker mobile application ("App") provided by AlgoSoft Technologies Limited ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

PLEASE READ THE MEDICAL DISCLAIMER IN SECTION 8 CAREFULLY BEFORE USING THE APP.

1. Eligibility

You must be at least 16 years old to create an account. If you are under the age of majority, you may use the App only with the consent and supervision of a parent or legal guardian. You are responsible for ensuring you have the legal right to record any health information you enter, including information about a dependent you are authorized to track.

2. Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the applicable app store's usage rules. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works of the App except as permitted by law.

4. Free and Premium

Free users can record symptoms and daily notes in the weekly journal and track mood. A premium subscription unlocks advanced features, including the symptom heatmap, symptom and mood trends, trigger frequency analysis, period comparisons, doctor-ready reports, and CSV export. We may change the features in each tier at any time.

5. Subscriptions and Payments

Premium is offered as a subscription processed by Apple (In-App Purchase) through your store account, not by us:

• Payment is charged to your Apple ID at confirmation of purchase.

• Auto-renewing subscriptions renew automatically unless turned off at least 24 hours before the period ends.

• Manage or cancel anytime in your store account settings.

• Refunds are handled by Apple under their respective store policies.

6. Your Health Data and Content

You own the health information and content you enter, including symptoms, mood logs, notes, triggers, and reports. You grant us a limited, non-exclusive, royalty-free license to store, process, and display this information solely to provide the App's features to you. We do not sell your health data. You are solely responsible for any data you choose to export or share, including reports you send to a healthcare provider or family member. We handle your information as described in our Privacy Policy.

7. Acceptable Use

You agree not to use the App unlawfully, reverse-engineer or disrupt it, gain unauthorized access, or copy, resell, or redistribute it. We may suspend or terminate accounts that breach these Terms.

8. Medical Disclaimer

Symptom Tracker is a personal health-tracking and journaling tool provided for informational and self-management purposes only. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The App does not diagnose, treat, cure, prevent, or monitor any disease or medical condition, and its reports, charts, insights, and analyses are not a substitute for professional medical judgment.

• Always seek the advice of a qualified physician or other healthcare provider with any questions about a medical condition, symptoms, or treatment. Never disregard or delay seeking professional medical advice because of information in the App.

• Any decisions about your health, medication, or treatment should be made with your healthcare provider. We are not responsible for any health outcomes, decisions, or actions taken based on information from the App.

• The App does not detect emergencies. If you think you may have a medical emergency, call your doctor or local emergency services immediately.

9. Intellectual Property

The App and all related materials (excluding your content) are owned by or licensed to us and protected by intellectual property laws. "Symptom Log-Symptom Tracker" and our logos are our trademarks and may not be used without our prior written permission.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including sensitive health data: Symptom Tracker - Privacy Policy 

11. Disclaimers and Liability

The App is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any insight, pattern, or report will be accurate or complete. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or loss of data, and our total liability for any claim shall not exceed the amount you paid for the App in the 12 months before the claim.

12. Changes and Termination

We may modify, suspend, or discontinue the App or update these Terms at any time; continued use after changes take effect means you accept them. You may stop using and delete your account anytime. We may suspend or terminate your access for breach of these Terms. Sections that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles, and the courts of Dhaka shall have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.

14. App Store

For App Store downloads, these Terms are between you and us, not Apple; Apple is not responsible for the App or support, is a third-party beneficiary of these Terms and may enforce them, and you represent that you are not in a U.S.-embargoed country or on a restricted-party list. We, not the stores, are responsible for the App and any related claims.
