AUTO-RENEWABLE SUBSCRIPTION AGREEMENT

This Subscription Agreement applies to auto-renewable subscriptions offered in InstaBeat Monitor & BP.

1. Available PlansTERMS OF USE

These Terms of Use govern your use of InstaBeat Monitor & BP, provided by Hong Kong Jiuying Network Technology Co., Ltd.

By downloading, accessing, or using the App, you agree to these Terms.

1. App Purpose

InstaBeat provides general wellness tools that may help users estimate heart rate, record wellness information, and review personal trends.

The App is not a medical device and is not intended to diagnose, treat, cure, prevent, or detect any disease or medical condition.

2. Camera-Based Measurements

Camera-based measurements analyze visual changes detected through your fingertip to estimate pulse and heart rate.

Results may be affected by:

• Finger placement

• Movement

• Lighting conditions

• Device model

• Camera or flashlight condition

• Skin temperature

• Circulation

• Environmental factors

The camera-based feature does not directly measure blood pressure.

Any blood pressure information shown in the App may be manually entered or presented as non-clinical wellness information. It must not replace a validated blood pressure monitor.

3. Medical and Emergency Disclaimer

Do not use the App to make medical decisions or delay professional medical care.

Never change medication, treatment, diet, or activity based only on information provided by the App.

If you experience chest pain, fainting, difficulty breathing, severe dizziness, an unusually fast or slow heartbeat, or another possible emergency, contact local emergency services immediately.

4. Eligibility

You must be legally capable of agreeing to these Terms. If you are below the applicable age of legal consent, you may use the App only with authorization from a parent or legal guardian.

5. License

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the App on Apple devices you own or control, subject to these Terms and Apple’s usage rules.

You may not:

• Copy, resell, sublicense, or commercially exploit the App

• Reverse engineer or attempt to extract source code except where permitted by law

• Bypass subscription, security, or access controls

• Use the App unlawfully or to harm other users or systems

• Misrepresent App results as professional medical findings

6. User Responsibilities

You are responsible for:

• Using the App according to its instructions

• Providing accurate information when entering data

• Keeping your device and Apple account secure

• Independently verifying health concerns with qualified professionals

• Using appropriate medical equipment when accurate measurements are required

7. Subscriptions

Certain features require an automatically renewing subscription.

Subscriptions are purchased and managed through Apple. Applicable prices, billing periods, introductory offers, and renewal terms are displayed on the App Store purchase confirmation screen before payment.

Additional subscription terms are described in the Subscription Agreement below.

8. Intellectual Property

The App, branding, designs, text, software, graphics, and related materials are owned by or licensed to Hong Kong Jiuying Network Technology Co., Ltd and are protected by applicable intellectual-property laws.

9. Availability and Updates

We may update, modify, suspend, or discontinue App features when reasonably necessary.

We do not guarantee that the App will always be available, error-free, compatible with every device, or capable of producing a successful measurement in every situation.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available.”

We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes consumer rights that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

The App must not be relied upon for emergency monitoring, diagnosis, or clinical decision-making.

12. Termination

You may stop using the App at any time.

We may restrict access when you materially violate these Terms, misuse the App, or create security or legal risks. Termination does not automatically cancel an App Store subscription.

13. Governing Law

These Terms are governed by the laws of Hong Kong, without limiting any mandatory consumer protections available in your country or region.

14. Changes

We may update these Terms. Continued use after the updated Terms become effective constitutes acceptance where permitted by law.
