Terms and Conditions for Stress Out

1. Introduction

Welcome to Stress Out ("the App"). These Terms and Conditions ("Terms") govern your use of the Stress Out mobile application developed and operated by Crittion ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

2. Eligibility

The App is intended for users aged 9 years and older. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App and make any purchases.

By using the App, you represent and warrant that you meet the age requirements stated above.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You may not:

• Copy, modify, or create derivative works of the App

• Reverse engineer, decompile, or disassemble the App

• Rent, lease, loan, sell, or distribute the App

• Remove or alter any copyright, trademark, or other proprietary notices

• Use the App for any unlawful purpose

4. Subscription Services

4.1 Subscription Plans

The App offers the following subscription options:

• Monthly Subscription: $9.99 USD per month

• Yearly Subscription: $49.99 USD per year

4.2 Payment and Billing

• Subscriptions are billed through your App Store account (Apple App Store or Google Play Store)

• Payment will be charged to your App Store account upon confirmation of purchase

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• The cost of renewal will be the same as the initial subscription price unless we notify you otherwise

4.3 Free Trial (if applicable)

If we offer a free trial period, you will be charged the subscription fee after the trial period ends unless you cancel before the trial expires.

4.4 Cancellation

• You may cancel your subscription at any time through your App Store account settings

• Cancellation will take effect at the end of the current billing period

• No refunds will be provided for partial subscription periods

• Upon cancellation, you will retain access to premium features until the end of your current billing period

4.5 Changes to Subscription Prices

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscribers until their next renewal period, and we will provide advance notice of any price changes.

5. Refund Policy

All purchases are final. Refunds are handled according to the App Store's refund policy (Apple App Store or Google Play Store). Please contact the respective App Store for refund requests.

6. Intellectual Property Rights

All content, features, functionality, and materials in the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Crittion and are protected by international copyright, trademark, and other intellectual property laws.

7. User Conduct

You agree to use the App in a lawful manner and not to:

• Use the App in any way that violates any applicable law or regulation

• Attempt to gain unauthorized access to any portion of the App

• Interfere with or disrupt the App or servers connected to the App

• Use the App to transmit any malicious code or harmful materials

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free

• The results obtained from using the App will be accurate or reliable

• Any errors in the App will be corrected

The App is designed for relaxation and stress relief purposes only and is not a substitute for professional medical or mental health advice, diagnosis, or treatment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRITTION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App

• Any unauthorized access to or use of our servers

• Any bugs, viruses, or other harmful code transmitted through the App

• Any errors or omissions in any content

10. Indemnification

You agree to indemnify, defend, and hold harmless Crittion and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

11. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App or by other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the courts of India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

16. Entire Agreement

These Terms constitute the entire agreement between you and Crittion regarding the use of the App and supersede all prior agreements and understandings.
