1. PARTIES AND ACCEPTANCE This Terms of Use and Privacy Policy is entered into between all real and legal persons downloading, accessing, or using the Starting XI • Football Manager application ("User") and the Application developers and right holders ("Management"). By installing, launching, or logging into the application, the User accepts, declares, and undertakes irrevocably that they have read, understood, and agreed to all terms of this agreement in full.
2. DATA COLLECTION AND USAGE To provide, maintain, and improve the Starting XI experience, Management may collect certain user data. This may include, but is not limited to, account credentials (e.g., username, email address), device information, and in-game progress. This data is strictly used for authentication, saving game states, displaying advertisements (via third-party networks like AdMob), and analyzing game performance to improve the application.
3. DATA SECURITY AND LIMITS OF LIABILITY Management takes technical and administrative measures in line with industry standards to protect the confidentiality and integrity of user data. However, due to the inherent nature of internet data transmission and digital storage systems, offering an absolute guarantee of security is technically not possible. Despite Management taking all reasonable security precautions, in the event of potential data losses resulting from cyberattacks, infrastructure provider outages, or technical vulnerabilities beyond control, liability is evaluated strictly within the maximum limits permitted by applicable legislation.
4. USER PASSWORD AND ACCOUNT SECURITY RESPONSIBILITY The User is solely responsible for the complexity, confidentiality, and preservation of the password created to access the account. Management cannot be held liable for unauthorized access or data loss resulting from the User's device being stolen, lost, infected with malware/viruses, or falling into the hands of third parties. Any operation performed through your account is directly the User's responsibility.
5. ACCOUNT AND DATA DELETION REQUESTS In compliance with data protection regulations and app store policies, the User has the right to request the complete deletion of their account and associated personal data at any time.
How to Request Deletion: Users can initiate an account deletion request directly within the application by navigating to the "Settings" or "Profile" menu and selecting the "Delete Account" option. Alternatively, users can send a direct deletion request via email to startingxifootballmanager@gmail.com
Data to be Deleted: Upon a verified request, the User's account details, in-game progress, team data, and personal identifiers will be permanently and irrevocably deleted from our active servers.
Data Retention Periods: Technical logs and security-related identifiers may be retained in a strictly anonymized format for a maximum of 30 days to prevent fraud, resolve technical disputes, and comply with legal obligations, after which they will be permanently destroyed.
6. SERVICE INTERRUPTIONS AND DATA LOSS Management does not guarantee that the application will operate uninterrupted, error-free, virus-free, or fully up-to-date. In the event that in-game progress, purchases, or user data are deleted, reset, or lost due to server maintenance, update errors, database corruption, hardware failures, or force majeure events (natural disasters, infrastructure issues, cyberattacks), no compensation, right, or refund claim can be asserted against Management.
7. THIRD-PARTY INFRASTRUCTURES The application utilizes third-party service providers for data storage, authentication, advertising (e.g., Google AdMob), and analytics processes. Management cannot be held liable for any damages that may occur due to failures, data leaks, security vulnerabilities, or service suspensions originating from the internal systems of these third-party services.
8. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, Management shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including loss of profits, data loss, loss of reputation, or device malfunctions) arising from the use of or inability to use the application.
9. AMENDMENTS AND ENFORCEABILITY Management reserves the right to unilaterally modify, update, or revoke the terms of this Privacy Policy and Terms of Use at any time without prior notice. Updated terms become effective immediately upon publication within the application. The User's continued use of the application implies unconditional acceptance of the modifications made.
