English: These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the application "STARGAZER" (hereinafter referred to as the "App") provided by KT Pixel Works (hereinafter referred to as the "Developer"). By downloading, installing, or using the App, the user is deemed to have agreed to these Terms.
日本語: この利用規約（以下「本規約」といいます）は、KT Pixel Works（以下「開発者」といいます）が提供するアプリケーション『STARGAZER』（以下「本アプリ」といいます）の利用条件を定めるものです。ユーザーは本アプリをダウンロード、インストール、または利用することにより、本規約に同意したものとみなされます。
1. Scope of Application / 適用範囲
English: These Terms apply to all users who use the App.
日本語: 本規約は、本アプリを利用するすべてのユーザーに適用されます。
2. Use by Minors / 未成年者の利用
English: If a user is a minor, the user shall use the App with the consent of a parent or legal guardian.
日本語: ユーザーが未成年者である場合、親権者その他の法定代理人の同意を得たうえで本アプリを利用するものとします。
3. Platform Terms, Purchases, and Refunds / プラットフォーム規約、購入および返金
English: If the App is distributed through Google Play, the App Store, or any other app distribution platform, the terms, payment rules, refund policies, and other conditions of such platform shall also apply.
日本語: 本アプリがGoogle Play、App Storeその他のアプリ配信プラットフォームを通じて配信される場合、当該プラットフォームの利用規約、決済条件、返金ポリシーその他の条件も適用されます。
English: In the event of any conflict between these Terms and the rules of the applicable platform, the platform’s rules shall prevail to the extent of such conflict.
日本語: 本規約と当該プラットフォームの規約等が矛盾する場合、その矛盾する範囲において、当該プラットフォームの規約等が優先されるものとします。
English: Purchases, cancellations, and refunds for the App shall be handled in accordance with the rules and policies of the app distribution platform through which the App was purchased.
日本語: 本アプリの購入、キャンセルおよび返金については、本アプリを購入したアプリ配信プラットフォームの規約およびポリシーに従って取り扱われます。
4. Handling of User Information / ユーザー情報の取り扱い
English: The handling of user information related to the App shall be in accordance with the Privacy Policy separately established by the Developer. By using the App, the user is deemed to have agreed to the Privacy Policy.
日本語: 本アプリに関するユーザー情報の取り扱いについては、開発者が別途定めるプライバシーポリシーに従うものとします。ユーザーは、本アプリを利用することにより、当該プライバシーポリシーに同意したものとみなされます。
5. Copyright and Intellectual Property Rights / 著作権および知的財産権
English: The Developer or rightful third parties retain all copyrights and other intellectual property rights regarding the programs, character images, music, sound effects, text, and all other data related to the App.
日本語: 本アプリに関するプログラム、キャラクター画像、音楽、効果音、テキスト、およびその他のすべてのデータに関する著作権その他の知的財産権は、開発者または正当な権利を有する第三者に帰属します。
English: Users may use the App for personal entertainment purposes in accordance with these Terms.
日本語: ユーザーは、本規約に従い、個人的な娯楽目的で本アプリを利用することができます。
6. Permission for Screenshots, Gameplay Videos, and Streaming / スクリーンショット、プレイ動画および配信の許可
English: Notwithstanding the preceding article, users may post screenshots, gameplay videos, live streams, reviews, and commentary videos of the App on social media, video-sharing platforms, or websites, including monetized content, provided that such use does not violate these Terms or applicable laws.
日本語: 前条の定めにかかわらず、ユーザーは、本アプリのスクリーンショット、プレイ動画、ライブ配信、レビュー動画、実況動画等を、SNS、動画共有サービス、ウェブサイト等に投稿・公開することができます。収益化された動画等での利用も可能です。ただし、本規約または適用法令に違反しない範囲に限ります。
English: However, users may not extract, redistribute, sell, or use the App’s images, music, sound effects, text, or other assets as standalone materials. Furthermore, the permission granted in this Article is strictly limited to use that is incidental to the aforementioned screenshots, gameplay videos, live streams, and reviews. It does not grant the user any right to use the App's assets independently.
日本語: ただし、ユーザーは、本アプリ内の画像、音楽、効果音、テキストその他の素材を単体で抽出、再配布、販売、または素材として利用することはできません。なお、本条は、スクリーンショット、プレイ動画、ライブ配信、レビュー動画、実況動画等に付随する範囲での利用を許可するものであり、本アプリ内の素材を単体で利用する権利をユーザーに付与するものではありません。
7. Prohibited Actions / 禁止事項
English: Users must not engage in any of the following actions when using the App:
Extracting, reproducing, modifying, distributing, selling, or publicly transmitting the data of the App, including images, music, sound effects, text, and other assets, except as expressly permitted under these Terms.
Reverse engineering, decompiling, or disassembling the program of the App, except where permitted by applicable law.
Illegally copying or providing the App to third parties as a pirated version.
Infringing upon the intellectual property rights, privacy, or other rights of the Developer or third parties.
Using the App in a manner that violates laws, regulations, public order, or morality.
Any other actions that interfere with or may interfere with the operation of the App, or that violate these Terms.
日本語: ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
本規約で明示的に許可されている場合を除き、本アプリのデータ（画像、音楽、効果音、テキストその他の素材を含みます）を抽出、複製、改変、配布、販売、または公衆送信する行為
法令により認められる場合を除き、本アプリのプログラムをリバースエンジニアリング、逆コンパイル、逆アセンブルする行為
本アプリを不正にコピーし、または海賊版として第三者に提供する行為
開発者または第三者の知的財産権、プライバシーその他の権利を侵害する行為
法令、公序良俗に違反する態様で本アプリを利用する行為
その他、本アプリの運営を妨げる行為、またはそのおそれのある行為、本規約に違反する行為
8. Disclaimer and Limitation of Liability / 免責事項および責任の制限
English: The Developer does not guarantee that the App will operate properly on all devices, including various screen aspect ratios, resolutions, hardware specifications, or OS versions.
日本語: 開発者は、本アプリがあらゆる端末（様々な画面アスペクト比、解像度、およびハードウェア仕様を含みます）またはOSのバージョンで正常に動作することを保証するものではありません。
English: The Developer does not promise permanent compatibility or update support for the App regarding future OS updates, changes to app distribution platform policies, or changes in device specifications.
日本語: 開発者は、将来のOSアップデート、アプリ配信プラットフォームの規約変更、端末仕様の変更等に対する本アプリの永続的な互換性およびアップデート対応を約束するものではありません。
English: The Developer shall not be held liable for any damages such as data loss, device malfunction, or other damages incurred by the user arising from the use of the App, except in cases of willful misconduct or gross negligence by the Developer. However, if the Developer is held liable for damages due to ordinary negligence under applicable laws (including consumer protection laws), the Developer’s liability shall be limited to direct and ordinary damages actually incurred by the user, and the maximum amount of compensation shall be limited to the amount paid by the user to purchase the App.
日本語: 開発者は、本アプリの利用に起因してユーザーに生じたデータ消失、端末の不具合その他の損害について、開発者に故意または重過失がある場合を除き、一切の責任を負わないものとします。ただし、消費者契約法その他の適用法令により、開発者が通常の過失による損害賠償責任を負わざるを得ない場合、開発者の責任は、ユーザーに現実に発生した通常かつ直接の損害に限られるものとし、その賠償額の上限は、ユーザーが本アプリの購入に際して支払った金額とします。
9. Changes to the Terms / 規約の変更
English: The Developer may modify these Terms when the modification is necessary and reasonable, such as for changes in laws, platform policies, App specifications, or service operations.
日本語: 開発者は、法令、プラットフォームの規約、本アプリの仕様、運営上の必要性等に応じて、合理的な範囲で本規約を変更することができます。
English: The modified Terms shall become effective at the time they are posted within the App or on the website designated by the Developer.
日本語: 変更後の規約は、本アプリ内または開発者の指定するウェブサイト上に掲示された時点で効力を生じるものとします。
10. Governing Law and Jurisdiction / 準拠法と管轄
English: These Terms shall be governed by and construed in accordance with the laws of Japan.
日本語: 本規約の解釈および適用にあたっては、日本法を準拠法とします。
English: Any and all disputes arising between the user and the Developer in connection with the App or these Terms shall be subject to the exclusive agreed jurisdiction of the Chiba District Court or the Chiba Summary Court in the first instance.
日本語: 本アプリまたは本規約に関してユーザーと開発者の間で生じた一切の紛争については、千葉地方裁判所または千葉簡易裁判所を第一審の専属的合意管轄裁判所とします。
11. Language / 言語
English: In the event of any discrepancy between the Japanese version and the English version of these Terms, the Japanese version shall prevail.
日本語: 本規約の日本語版と英語版の内容に相違がある場合、日本語版を優先するものとします。

13. Special Provisions for iOS Users / iOSユーザー向けの特則
English: The following terms apply only to users who download the App from the Apple App Store:
Acknowledgment: The user and the Developer acknowledge that these Terms are concluded between the user and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.
Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranties and Claims: The Developer is solely responsible for any product warranties, whether express or implied by law. Apple is not responsible for addressing any claims by the user or any third party relating to the App, including but not limited to product liability claims or claims that the App fails to conform to any applicable legal or regulatory requirement.
Third-Party Beneficiary: The user and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon the user's acceptance of these Terms, Apple will have the right to enforce these Terms against the user as a third-party beneficiary thereof.
日本語: 本条の規定は、Apple App Storeから本アプリをダウンロードしたユーザーにのみ適用されます。
確認: ユーザーおよび開発者は、本規約がユーザーと開発者の間でのみ締結されるものであり、Apple Inc.（以下「Apple」といいます）との間で締結されるものではないことを確認します。本アプリおよびその内容に関する責任は、Appleではなく開発者が単独で負うものとします。
メンテナンスおよびサポート: Appleは、本アプリに関するメンテナンスおよびサポートサービスを提供する義務を一切負いません。
保証および請求: 明示または黙示を問わず、製品保証に関する責任は開発者が単独で負います。Appleは、製造物責任に関する請求、または本アプリが適用される法令に適合しないという請求を含む、本アプリに関するユーザーまたは第三者からのいかなる請求に対しても責任を負いません。
第三者受益者: ユーザーおよび開発者は、AppleおよびAppleの子会社が本規約の第三者受益者であること、また、ユーザーが本規約に同意することにより、Appleが第三者受益者として本規約をユーザーに対して直接執行する権利を有することに同意するものとします。
