These Terms of Use ("Terms") are a legal agreement between you ("User," "you") and BloomGames ("BloomGames," "we," "us," or "our"), the developer of the mobile game SpiderBloom! ("App" or "Game"), available on Google Play. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

The App is intended for a general audience and is not directed at children under the age of 13 (or the minimum age of digital consent in your country, if higher). If you are under this age, you may only use the App with the involvement and consent of a parent or legal guardian. If we become aware that we have collected personal information from a child in violation of applicable law, we will take steps to delete that information.

2. License to Use the App

Subject to your compliance with these Terms, BloomGames grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment on a device you own or control. This license does not grant you any ownership rights in the App.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App;

• Reverse engineer or attempt to extract the source code, except where permitted by law;

• Use cheats, automation software (bots), hacks, mods, or any unauthorized third-party software to modify or interfere with the App;

• Use the App for any unlawful purpose or in a way that disrupts other users' enjoyment of the App.

3. Virtual Items

The App includes virtual in-game currency ("Coins") and virtual items such as boosters (collectively, "Virtual Items"). Virtual Items:

• Have no real-world monetary value and are not redeemable for cash;

• Are licensed to you, not sold — you do not own them;

• May be earned through gameplay or, where offered, through watching optional rewarded advertisements;

• May be modified, managed, regulated, or removed by BloomGames at any time, with or without notice, without liability to you;

• Cannot be transferred, traded, or sold outside the App.

4. Advertising and Third-Party Services

The App displays advertisements, including rewarded video ads, served through third-party ad networks such as AppLovin MAX and its mediated ad partners. These networks may collect certain data (such as device identifiers and usage data) to serve and measure ads, subject to their own privacy policies and your device's ad-tracking settings.

The App may also use analytics services (such as GameAnalytics and PostHog) to understand gameplay behavior and improve the App. Use of the App constitutes your acknowledgment of this data collection.

5. Intellectual Property

The App, including its name, design, artwork, characters, code, sound effects, and all other content, is owned by Kledi Musai or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any such ownership to you.

6. User Conduct

You agree not to:

• Exploit bugs or glitches to gain an unfair advantage;

• Attempt to disrupt the App's servers or infrastructure;

• Impersonate BloomGames or misrepresent your affiliation with us;

• Use the App in any way that violates Google Play's policies.

7. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. You may stop using the App at any time by uninstalling it.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kledi Musai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROGRESS, OR VIRTUAL ITEMS, ARISING OUT OF YOUR USE OF THE APP.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by the laws of Albania, without regard to its conflict of law principles.

12. Google Play

Your use of the App is also subject to Google Play's Terms of Service. In the event of a conflict between these Terms and Google Play's terms regarding the operation of the platform itself, Google Play's terms will govern.
