Speedy Rocket – Terms of Service

[Speedy Rocket] ("we," "us," or "our") operates the Speedy Rocket mobile application (the "Application").
Please read these Terms of Service ("Terms") carefully before using the Application. By accessing or using Speedy Rocket, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the Application.
1. License and Permitted Use
We grant you a personal, revocable, non-transferable, non-exclusive, and limited license to download, install, and use the Application on an iOS device owned or controlled by you, strictly in accordance with these Terms and the Apple App Store Terms of Service.
2. Service Functionality and Disclaimers
Service Nature: Speedy Rocket is a network utility tool that provides diagnostic features, including network speed tests, latency check (Ping, Jitter), and scenario-based diagnostic evaluations.
No Registration Required: The Application does not require user registration or account creation to operate.
Test Environment and Data: Speed test metrics are generated using public third-party infrastructure (such as Cloudflare public test nodes). Network performance metrics may fluctuate depending on your location, carrier, device status, and external server loads.
As-Is Basis: The service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the continuous availability, error-free operation, or absolute accuracy of any test results.
3. Data Privacy and Local Processing
Privacy-First: We respect your privacy. All diagnostic data, logs, and speed test histories generated within the Application are processed and stored locally on your device.
No Backend Storage: We do not operate server infrastructure to collect, store, or monitor your specific network data or browsing habits.
Third-Party Disclosure: Any queries to test regions or cloud endpoints are made directly from your device to third-party public nodes. Your interactions with these nodes are subject to their respective privacy terms.
4. Prohibited Conduct
You agree not to use the Application for any unlawful purpose or in any way that violates these Terms. Prohibited conduct includes, but is not limited to:
Attempting to decompile, reverse engineer, or disassemble the Application.
Automating network queries or creating excessive, repetitive traffic (DDoS or spam) that disrupts the public test resources utilized by the Application.
Modifying, distributing, or creating derivative works based on the Application's user interface, layouts, and unique brand assets.
5. Intellectual Property
All rights, title, and interest in and to the Application, including but not limited to the brand name "Speedy Rocket," unique visual assets, dark mode UI layouts, code structures, and proprietary features, are and will remain the exclusive property of [Your Company Name / Developer Name].
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use of or inability to use the Application.
Any technical inaccuracies, errors, or temporary service disruptions in network testing.
Any hardware performance changes, including unexpected device lag, battery depletion, or physical writable storage variations.
7. Apple Inc. Framework Agreement (EULA)
Acknowledgement: You acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. We, not Apple, are solely responsible for the Application and the content thereof.
Maintenance and Support: We are solely responsible for providing maintenance and support services for the Application. Apple has no obligation whatsoever to furnish any maintenance and support services.
Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide updated notices within the Application or update the "Last Updated" date at the top of these Terms.
