1. BINDING LEGAL AGREEMENT AND ACCEPTANCE OF TERMS

By accessing, downloading, installing, or using the mobile application Spectrum Quiz (hereinafter referred to as the "App"), you (the "User") acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service in their entirety. This document constitutes a comprehensive, binding legal contract between the User and the Developer. If you do not agree with every single provision, sub-point, and condition of this agreement, you are strictly prohibited from using the App and must delete all copies from your devices immediately. Continued use of the App signifies your irrevocable and ongoing acceptance of these terms and any future modifications.

2. ABSOLUTE LIMITATION TO ENTERTAINMENT & FICTIONAL PURPOSES

Spectrum Quiz is developed, published, and provided EXCLUSIVELY FOR ENTERTAINMENT AND RECREATIONAL PURPOSES. * Fictional Content: All scenarios, dialogues, questions, and "correct" answers within the App are works of fiction, creative expression, or extreme generalization. They do not reflect the complexity of real-world human interactions, professional standards, or cultural norms.

• No Diagnostic or Clinical Value: The App is NOT a medical device, a psychological assessment tool, or a therapeutic instrument. It has not been clinically tested, reviewed, or approved by any medical, psychiatric, or mental health professionals.

• No Educational or Professional Guarantee: While the App discusses social skills, "masking," and etiquette, it provides ZERO GUARANTEE of any improvement in social performance, cognitive ability, relationship success, or professional advancement.

3. COMPREHENSIVE WAIVER OF ALL PROFESSIONAL ADVICE

The User hereby acknowledges and agrees that the App DOES NOT under any circumstances provide:

• Psychological or Medical Advice: The App must never be used as a substitute for professional counseling, therapy, diagnosis, or treatment.

• Career, Legal, or Business Advice: The "correct" answers regarding job interviews, workplace behavior, or business etiquette are fictional scripts and DOES NOT constitute professional career coaching or legal guidance.

• Relationship Counseling: Any content regarding dating or social etiquette is subjective, fictional, and intended for amusement only. NEVER DISREGARD PROFESSIONAL ADVICE OR DELAY SEEKING IT BECAUSE OF ANY CONTENT READ OR EXPERIENCED WITHIN THIS APP. RELIANCE ON ANY INFORMATION PROVIDED BY THE APP IS SOLELY AT YOUR OWN RISK.

4. FULL LEGAL DISCLAIMER & MAXIMUM LIMITATION OF LIABILITY

PLEASE READ THIS SECTION WITH EXTREME CARE. IT LIMITS YOUR LEGAL RIGHTS.

• ZERO DEVELOPER LIABILITY: To the fullest extent permitted by law, in no event shall the Developer, their affiliates, or partners be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of your use of the App.

• Scope of Damage Protection: This limitation of liability covers, without limitation:

  • Personal & Social Harm: Emotional distress, social anxiety, psychological trauma, ruined relationships, failed dates, or damage to social reputation.

  • Professional & Financial Loss: Failed job interviews, loss of employment, professional sanctions, or loss of potential income.

  • Technical Damage: Hardware malfunctions, battery degradation, data loss, or unauthorized access to your device.

  • Third-Party Conduct: Liability for the content, privacy practices, or accuracy of advertisements served by third-party networks (e.g., Google AdMob).

5. MANDATORY INDEMNIFICATION: USER RESPONSIBILITY FOR ALL LEGAL COSTS

YOU HEREBY AGREE TO BE FINANCIALLY RESPONSIBLE FOR ALL LEGAL OUTCOMES RELATED TO YOUR USE OF THE APP.

• User Liability for Legal Defense: You agree to defend, indemnify, and hold the Developer harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees, expert witness fees, court costs, and legal disbursements) arising from your use of the App, your violation of these Terms, or any actions you take in the real world based on the fictional content of the App.

• Full Reimbursement Requirement: If the Developer is sued or a legal claim is brought against the Developer due to your conduct, interpretation, or misuse of the App, you agree to pay for all legal defense costs incurred by the Developer in full. You shall be solely responsible for any settlement amounts, judgments, or legal fees, ensuring the Developer suffers ZERO financial loss.

6. TOTAL DISCLAIMER OF WARRANTIES ("AS-IS" BASIS)

The Developer provides the App on an "AS IS" and "AS AVAILABLE" basis with all faults. To the maximum extent permitted by applicable law, the Developer expressly disclaims all warranties of any kind, whether express, implied, or statutory, including:

• Warranties of merchantability or fitness for a particular purpose.

• Warranties that the App will be secure, uninterrupted, timely, or error-free.

• Warranties regarding the accuracy, reliability, or "correctness" of any content provided. Your use of the App is at your own sole and absolute risk.

7. ADVERTISING, MONETIZATION, AND THIRD-PARTY SERVICES

• Monetization: The App is supported by third-party advertising via Google AdMob. Advertisements may appear approximately every seven (7) questions.

• No Control Over Content: The Developer does not control, endorse, or guarantee the accuracy, legality, or safety of products or services advertised by third-party networks.

• Tracking: Third-party providers may use tracking technologies (like Advertising IDs) to serve ads. By using the App, you consent to this data processing by third parties.

8. DATA PRIVACY AND PROTECTION

• Non-Collection Policy: The Developer does not personally collect, store, or sell your name, email, or sensitive personal identification data.

• Children's Privacy: This App is intended for a mature audience and is not intended for children under the age of 13.

• External Links: Links to external sites (e.g., music composers) are governed by their own respective privacy policies.

9. INTELLECTUAL PROPERTY AND LICENSING

• Ownership: All graphics, code, and dialogue within the App are the exclusive property of the Developer.

• Music Credits: Audio content is used under license from Kevin MacLeod (Incompetech) under Creative Commons 4.0.

• License: You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial entertainment use only.

10. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION

THIS SECTION LIMITS YOUR RIGHT TO SUE IN CERTAIN LOCATIONS AND FORMS.

• Governing Law: These Terms shall be governed by and interpreted in accordance with the laws of the Developer’s country and region of residence.

• Exclusive Jurisdiction: You agree that any legal action or proceeding shall be brought exclusively in a court of competent jurisdiction in the Developer’s location. You hereby consent to the personal jurisdiction of such courts.

• Waiver of Jury Trial & Class Action: All dispute resolution proceedings will be conducted only on an individual basis. YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS-ACTION LAWSUIT.

11. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and the Developer.
