2. Description of the Service

Spacely is an iOS application that allows users to organize their items digitally for personal or business use. Key features include:

• Assigning items to rooms and sublocations

• Managing multiple “homes” (projects)

• Using emojis and images for items

• Generating and scanning QR codes with the phone's camera

• Managing expiration dates with notifications

• Setting item statuses (e.g. in use, expired, lent out)

• Built-in search and statistics

• Theme customization

• Exporting item lists as PDF

• Support for multiple languages

Registration is required to use the service.

3. Conditions of Use

To use the Spacely app, users must register with a valid email address, username, and password. The email address cannot be changed later, but the username and password can. Users are responsible for keeping their account secure.

4. Subscriptions

Spacely offers various subscription plans based on storage capacity. Subscriptions are billed monthly via the Apple App Store. Payment and invoicing are handled by Apple and subject to Apple’s terms and conditions. Users can cancel their subscriptions at any time in their Apple account settings.

5. Data Management

Spacely stores the following data:

• Registration data (email, username, encrypted password)

• Item data (name, emoji, image, dates, status, QR code)

• Notification settings

• Last login and registration dates

• Theme settings, usage statistics

All data is securely stored and processed via Firebase. Data processing complies with the EU’s General Data Protection Regulation (GDPR). A separate Privacy Policy is also provided.

6. Limitation of Liability

The service provider makes reasonable efforts to ensure the app works without error but does not guarantee continuous availability or error-free operation. Users acknowledge that technical issues, data loss, or service outages may occur, for which the provider assumes no responsibility.

7. Termination

Users may delete their account at any time via the app’s settings or by email. Deleting the account also permanently deletes all associated data.

8. Governing Law and Dispute Resolution

Any disputes between the provider and the user will be resolved primarily through mutual agreement. If no agreement is reached, Austrian law shall apply, and the competent courts of Austria will have jurisdiction.

9. Final Provisions

The provider reserves the right to modify these Terms. Users will be notified of changes via email or in-app message.

2. Purpose of Data Processing

The purpose of data processing is to operate the Spacely app, manage user accounts, store item data (e.g. expiration dates, status, image, emoji), and provide subscription-based services.

The app collects the following data:

• Registration data: email address, username, password (encrypted)

• Item-related data: name, emoji, image, expiration date, status, QR code

• System data: last login time, registration date

• Settings: notifications, theme, language

• Subscription data: plan type, activation date (payment handled by Apple)

4. Legal Basis for Data Processing

• Account creation and operation: performance of a contract (GDPR Article 6(1)(b))

• Subscription and service delivery: performance of a contract

• Preferences and usage statistics: legitimate interest (GDPR Article 6(1)(f))

• Expiration notifications: legitimate interest or user consent (depending on settings)

5. Source of Data

All data is provided directly by the user during registration and app usage.

6. Data Storage Location and Method

Data is securely stored in Google Firebase services (Firestore, Firebase Auth, Firebase Storage) with encryption. Google complies with GDPR and EU data storage regulations.

7. Data Retention

• Registration and user data are retained until account deletion

• Subscription information is retained for 1 year after termination

• Data may be deleted immediately upon user request

8. Third-Party Data Sharing

Personal data is not shared with third parties, except:

• where required by law

• where necessary for technical operation (e.g. Firebase – Google)

9. User Rights

Users have the right to:

• Access their personal data

• Request correction of data

• Request deletion of data

• Object to data processing

• Request data restriction
