Please read these Terms of Use ("Terms") carefully. By downloading or using Sober Tracker ("the app"), you agree to these Terms. If you do not agree, do not use the app.
1. NOT MEDICAL ADVICE
Sober Tracker is a self help and motivation tool for tracking sobriety. It is not a medical device and does not provide medical, clinical, psychological, or addiction treatment advice. It is not a substitute for professional care, a treatment program, a doctor, a therapist, or a support group. Always seek the advice of a qualified health professional with any questions about alcohol use, withdrawal, or your health. Alcohol withdrawal can be dangerous and in some cases life threatening; do not stop drinking abruptly without medical guidance if you are a heavy or dependent drinker.
2. EMERGENCIES
The app cannot help in a crisis. If you are in danger, are experiencing a medical emergency, or are having thoughts of harming yourself, contact your local emergency services or a crisis line immediately. The app is not monitored and cannot respond to emergencies.
3. LICENSE
We grant you a personal, non exclusive, non transferable, revocable license to use the app on devices you own or control, for your personal, non commercial use, subject to these Terms and the App Store Terms of Service.
4. ACCEPTABLE USE
You agree not to misuse the app, including reverse engineering, decompiling, tampering with the app, or using it in any unlawful way, except where such restriction is prohibited by law.
5. YOUR DATA
The app stores your data on your device. You are responsible for your device, for any backups or exports you create, and for keeping your device secure. We are not responsible for data loss caused by device failure, loss, deletion of the app, or actions you take with exported data. See our Privacy Policy for details.
6. SUBSCRIPTIONS AND PURCHASES
The app is free to use. Optional Premium is offered as an auto renewable subscription (Weekly, Monthly, or Yearly) or as a one time Lifetime purchase. Prices are shown in the app and may vary by region.
For auto renewable subscriptions: payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription, and turn off auto renewal, in your device's App Store account settings after purchase. A one time Lifetime purchase does not renew.
7. REFUNDS
Purchases are processed by Apple. Refund requests are handled by Apple under the App Store terms, not by us.
8. INTELLECTUAL PROPERTY
The app, its design, content, and trademarks are owned by the developer and protected by law. These Terms do not transfer any ownership to you.
9. DISCLAIMER OF WARRANTIES
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or that the app will be uninterrupted or error free. Your recovery outcomes are your own; the app does not guarantee any result.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the app. To the maximum extent permitted by law, total liability for any claim relating to the app will not exceed the amount you paid for the app, if any, in the twelve months before the claim.
11. CHANGES
We may update the app and these Terms. Continued use after changes take effect means you accept the updated Terms. Material changes will be reflected by updating the effective date above.
12. TERMINATION
You may stop using the app at any time by deleting it. We may suspend or end the license if you breach these Terms.
13. GOVERNING LAW
These Terms are governed by the laws of [GOVERNING LAW JURISDICTION], without regard to conflict of law rules, except where mandatory consumer protection laws of your country of residence apply.
